Noise, dust, and odors are consistently. mentioned as impacts to the neighborhood. As a result of these complaints, this. department has re-examined the history of your use and previous determinations regarding compliance with zoning and building regulations. A brief listing of pertinent chronological event's, according to -our file is attached as'exhibit "A". It is acknowledged that you did contact the Planning Division'as to the zoning requirements around August of 1991 and were told that a Use Permit was not required for a riding or boarding stable. It should be noted that this determination was based on information from you, that your parcel was in excess of 5 acres. When the situation was again evaluated in early 1992, the fact that your property, consisted of two 4 acre parcels came to light. The Planning Division came to the conclusion that the acreage of the two parcels could be considered together to reach the 5 acre requirement. This was an incorrect determination. You should have been told to merge the two parcels or, so long as the parcels remained, to apply for a Use Permit pursuant to Ordinance 2794 because: 1. As separate legal parcels, you could sell either parcel parcel at any time, thereby reducing the acreage to less than the required 5 acres and creating a problem with the number of animals as stipulated in Ordinance 2794; 2. The lots are physically separated by a road easement; 3. You were not using the parcel, south of Hutton Way in conjunction with your riding facility; Since you never obtained a building permit for the barn, and therefore never lawfully established the equestrian facility use, the County could now take the position that the use is not legal and a Use Permit is now required. However, since the error on the part of the County occurred so long in the past and you have been operating on the assumption your use was allowed, to require a use permit now, would not be fair or reasonable to you. The ordinance required a Use Permit for boarding and riding stables on parcels less than 5 acres. f 08/19/91 Stearns filed a fictitious business statement with the County. This establishes a known date regarding' the establishment of the Stearns' business. No record exists in County Planning files of operation prior to this date. Proving a prior starting date is not critical unless the date is prior to 11 /21/89, the adoption of Ord. 2794. i 11/05/91 11/18/91 11/22/91 1/08/92 4/21/92 Complaint received by County alleging unsanitary conditions, 17 horses, 12 sheep, 50 ducks, operating riding stables. General nuisance. Code Enforcement field :investigation documents 2 horse barns, 20 horses, and the. operation of boarding/training facilities on the premises. Building -permits were -not obtained. New complaint to County alleging 27 horses, 20 sheep, ducks, geese; turkeys. ! Board Discussion Item 9,1-529 - Board makes an interpretation of the zoning code that a use permit should be required for all -boarding and riding stables, regardless of parcel size. Ten day warning letter to Stearns from Building Division stating agricultural exemption permit must be obtained for those buildings erected without a building permit.. j Agricultural Building Permit applied for by Stearns, but placed on hold pending a zoning determination. i Site visit by code enforcement officer documents 18 to 20 horses, 10 sheep, 6 Iambs, chickens, and ducks on the site. Letter to Stearns from Building Division indicating building permits are required, agricultural !exemption permit is not appropriate for structures allowing access to public, and the use in the A-5 zone is not a zoning violation. The determiriation that the use was not a violation, was made by the Planning Division and was based on the fact that you have a total of. Inspection by code enforcement officer documents situation same as previous, 2 barns, 20 horses, riding lessons, boarding facilities, etc.. 3/23/93 Courtesy Notice sent to;Stearns from Building Division indicating building, permits are required for horse barn. 5/3/93 Formal Warning Notice ;sent to Stearns from Building Division requiring building permits to be obtained. 7/7/93 Letter sent to Stearns from Building indicating building permits needed and that consultation with Bill Farrel, County Counsel and Planning Staff indicate a Use Permit is required.' .8/20/93 Letter to Stearns from Building Division indicating a site visit was performed by Scott Rutherford and Bill Farrel. They concluded that building -perm its are.. . required, but the facility is a legal nonconforming use and no -use permit is _ . required. 9/30/93 Second Notice sent to Stearns from Building Division in response to July 7 letter. 9/20/94 New complaint filed by numerous neighbors complaining of excessive noise, odor, destruction of fences by horses, operation of a commercial boarding and training facility, 15-45 horses and other animals on site. 11/17/94 Formal Warning Notice letter sent to Stearns from Building Division, building permits required. I observed approximately 18 to 20 horses, 10 adult lambs, 6 baby lambs, chickens and ducks on the property. Robyn Stearns stated the Lambs and the chickens/ducks are 4-H projects for her children. Butte County Code allows educational projects to be exempt up to 4 adult lambs and no restriction on chickens and ducks. The Stables are used by members who pay approximately $140.00 annually for the boarding care and feeding of the horses. The annual membership fee is determined by the extra care which the member is requesting ie; bathing & exercising. The use appears to most resemble a Boarding -Stable, as feed is included in the membership fee. The members use the arenas to work with their horses. Instructions are given to members on a one. to one basis. Open public riding lessons are not given. Mr. & Mrs. Stearns own Lot #100 (3.97 acs.) and Lot #101 (4.00 acs) side by side. Using -the formula given in Butte County Code 24-35.2 ANIMAL MAINTENANCE REQUIREMENTS; Lot #100, minus the home, allows 16 horses. Lot #101, No Buildings, allows 17 horses. Total 33 horses. Butte County Code 24-35.2 also states; Properties which are five (5)1 acres or larger and are within zoning districts that allow livestock, there are no area requirements for the keeping of animals. If you take the entire area of both parcels (Lot #100 & 101) the area exceeds five acres. -2- -Continued - The property was attractive, animals were kept in a clean and sanitary condition with bedding changed often. I did observe a pile of waste bedding/manure approximately 10 X 40 in area. This manure has been stored upon the property longer than the usually 10 days. The property was cleared of trees, plowed and leveled. The recent rains have made the ground soft and the truck unable to get to the pile. The pile is largely wood shaving/bedding material. There is no smell-and'no flies at present. Robyn stated that the waste is removed every 10 days normally, weather permitting. F411 YT I4 ick It is my opinion based upon my investigation that Mr. and Mrs. Stearns are not presently in violation of zoning laws but could be required to obtain a use permit for their activities. The maintenance of more than 16 horsed if they later choose to sell Lot # 101 (4.00 areas) leaving them with only 3.95 areas and under the five area exemption. The condition upon the property, leads me to believe that the manure pile will soon be gone and during the hot weather when flies and smell is a real problem regular removal maintenance will be performed. I do not understand the request for plans and engineering that the county has presented to you. I have been in this industry for 18 years, and have friends and associates in the business all over the western United States. I know of no authority that has required such a thing for this type of product. In the first place, counties do not generally regulate fencing, particularly agricultural fencing, and especially portable fencing. That would require permits for every cow corral and dog kennel, and I doubt they would want to get into that. I am fairly sure that if you check around, you will find that they have not required this for others with similar equipment, even much larger facilities. Secondly, though most counties require plans, permits and engineering for more substantial permanent structures such as barns, they usually have an exemption procedure for agricultural structures. Even if this were a permanent structure such as a building, (which of course it is not) it is clearly an unoccupied agricultural structure meant to contain only livestock. rWe have sold hundreds of corrals like these, from little single corrals for Pack yards, to large 30 or 40 corral setups at places such as boarding stables, horse breeding ranches, and campuses of the University of California. In no case has this type of process been required. I also know of many instances where these corrals have been moved from place to place, and the owners have not been required to go through any process. I hope this answers your questions.
