Failure to obtain the'required permits, inspections and approvals from this office for the construction of a structure built within the County setbacks. Since permits and inspections are required for the above work, please submit three (3) complete sets of plans, apply for the required permits, and pay the appropriate fees. All work must stop until these permits are issued and you are authorized by our field inspector to proceed. The field authorization cannot be made until the existing work is inspected and approved. It is the County's goal to obtain voluntary compliance with the Butte County Code. However, you should be advised that Butte County has an active Code Enforcement Program which provides an effective means of enforcement if voluntary compliance is not obtained. Enforcement may be pursued. through the issuance of citations, fines and the recording of a Notice of Violation including a description of the action necessary to abate the violation. Pursuant to Butte County Code (BCC) Section 41-2, we sent you a courtesy notice dated June 11, 2002, notifying you that you are in violation of the BCC, and 1998 California Building Code (CBC), at the above -referenced location. As of this date, the following violations still exist: Failure to obtain the required permits, inspections and approvals from this office for the construction of a structure within the County setbacks. (a) Section 106.1 Permits Required (b) Section 108.1 Inspections Required (c) Section 108.4 Inspection Approval Required Before Use or Occupancy (d) Section 3405 Change in Use Requires Conformance to Code The above violations(s) shall be convected or abated by you by obtaining approval from the Development Services -Planning Division for the construction within the setbacks and submitting three (3) complete sets of plans, applying for the required permits, and paying the appropriate fees, including penalties or by demolition of the structure. After permit issuance and field authorization to proceed, the work must be completed and approved by this office within the permit specified time. This is your final warning. Unless you contact this office and make the proper arrangements to correct or abate the violation(s) voluntarily, within ten (10) days from the date of this letter, enforcement shall be pursued through the issuance of a citation (ordering you to appear in court) for said violation(s) and for failing to comply with this warning letter. Upon conviction of said violation(s) or of failing to comply with this letter, the court shall impose penalties (fines) and a Notice of Violation shall be recorded in accordance with Butte County Code Section 41-7. (a) The official copy of the plans maintained by the building department of the city or county provided for under Section 19850 shall be open for inspection only on the premises of the building department as a public record. (c) The building department shall also furnish the form of an affidavit to be completed and signed by the person requesting to duplicate the official copy of the plans, which contains provisions stating all of the following: (1) That the copy of the plans shall only be used for the maintenance, operation, and use of the building. (2) That drawings are instruments of professional service and are incomplete without the interpretation of the certified, licensed, or registered professional of record. (3) That subdivision (a) of Section 5536.25 of the Business and Professions Code states that a licensed architect who signs plans, specifications, reports, or documents shall not be responsible for damage caused by subsequent changes to, or use of, those plans, specifications, reports, or documents where the subsequent changes or uses, including changes or uses made by state or local governmental agencies, are not authorized or approved by the licensed architect who originally signed the plans, specifications, reports, or documents, provided that the architectural service rendered by the architect who signed the plans, specifications, reports, or documents was not also a proximate cause of the damage. (d) The request by the building department to a licensed, registered, or certified professional may be made by the building department sending a registered letter to the licensed, registered, or certified professional requesting his or her permission to duplicate the official copy of the plans and sending with the registered letter, a copy of the affidavit furnished by the building department which has been completed and signed by the person requesting to duplicate the official copy of the plans. The registered letters shall be sent by the building department to the most recent address of the licensed, registered, or certified professional available from the California State Board of Architectural Examiners. (e) The governing body of the city or county may establish a fee to be paid by any person who requests the building department of the city or county to duplicate the official copy of any plans pursuant to this section, in an amount which it determines is reasonably necessary to cover the costs of the building department pursuant to this section. (f) The certified, licensed, or registered professional's refusal to permit the duplication of the plans is unreasonable if, upon request from the building department, the professional does either of the following: (1) Fails to respond to the local building department within 30 days of receipt by the professional of the request. However, if the building department determines that professional is unavailable to respond within 30 days of receipt of the request due to serious illness, travel, or other extenuating circumstances, the time period shall be extended by the building department to allow the professional adequate time to respond, as determined to be appropriate to the individual circumstance, but not to exceed 60 days. (2) Refuses to give his or her permission for the duplication of the plans after receiving the signed affidavit and registered letter specified in subdivisions (c) and (d). 19852. The governing body of a county or city, including a charter city, may prescribe such fees as will pay the expenses incurred by the building department of such city or county in maintaining the official copy of the plans of buildings for which it has issued a building permit, but the fees shall not exceed the amount reasonably required by the building department in maintaining the official copy of the plans of buildings for which it has issued a building permit. The fees shall be imposed pursuant to Section 66016 of the Government Code. 19853. This chapter shall not apply to any building containing a bank, other financial institution, or public utility. The house is to be constructed on Lot 3, Sunset Oaks Drive, east of Paradise. The most recent (1990) traffic volumes on Pentz Road in the vicinity of this project were provided by Bob Jones of Butte County Department of Public Works. The measured ADT was increased by the amount of medium- and heavy-duty trucks on Pentz Road, using the model of the Federal Highway Administration. The Federal Highway Administration (FHWA) model for estimating day -night noise levels (Lao) produced a combined value for all vehicular traffic of 60 dB at the house walls nearest Pentz Road (See worksheets pages 1 & 2, plus workcharts). Peak noise events can exceed 76 dB as trucks accelerate uphill. The construction drawings of this.home indicate that it exceeds minimum UBC and State of California energy standards. These design improvements ensure that highway noises will not produce interior levels reaching 45 dB Ldp. The struc- tural elements are summarized on the Building Envelope sheet attached to this report. Walls facing towards Pentz Road will produce 39 dB of attenuation. Windows which occupy about 40 percent of the surface of walls facing towards the road should produce 30 dB of attenuation. The combined exterior wall noise rating will be 34 dB ( See attached work sheets), reducing day -night noise levels from Pentz Road to 26 dB, and peak episodes to 46 dB or lower. Peak episodes are most likely to occur during normal working hours, based on observations of Pentz Road traffic.
