RE: Building Permit No. B16-0964, B16-0963 APN 047-150-070
Dear: ALBERTSON, JAKE
Plans for the above referenced project have been routed to the Department of Public Works for review of
compliance with Butte County Code Sections 26-12 and 26-23 (available on line at
http://municipalcodes.lexisnexis.com/codes/butteco/). Based on our initial review of the information
provided, the Department of Public Works has determined that a portion of the proposed development is
located within a Federal Emergency Management Agency (FEMA) designated floodplain. As a federally
designated floodplain, special rules and regulations apply and an additional county development permit is
required to construct within the floodplain.
The requirements of construction within a floodplain are set forth in Article IV, Section 26 of Butte County
Code. Code Section 26-23 requires demonstration that encroachments by earthen fill, gravel, or
structures will not result in any increase in water surface elevations on neighboring properties. The
necessary information is normally provided by a registered professional engineer.
In addition to the requirements of Code Section 26-23, the following may apply per County Code Section
26-12:
1. Drainage plans and calculations shall be submitted to and approved by the Department of
Public Works. Engineering plans shall detail existing drainage conditions and specify how
storm water runoff will be either detained or retained onsite and/ or conveyed to the
nearest natural drainage channel or publicly maintained facility. Engineering calculations
shall show there is no increase in peak flow runoff leaving the property.
It is not clear from the information provided what type of encroachment there will be within the floodplain
or if there will be an increase in peak flow runoff. Please submit sufficient information to the Land
Development Division of the Public Works Department, 7 County Center Drive, Oroville, CA 95965 that
demonstrates compliance with County Code Sections 26-12 and 26-23. If construction plans and/or
engineering analysis are required, submit information in duplicate in accordance with County Improvement
Standards (available on line at
http://www.buttecounty.net/publicworks/Services/ImprovementStandards.aspx) along with a
$700.00 minimum plan checking deposit.
If you have any questions, please contact this office at (530) 538-7266, Monday through Friday, 8:00 a.m.
to 4:00 p.m.
Sincerely,
Eric Schroth, P.E., L.S.
