Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use. for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one-year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or State regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. The project applicant shall prepare a specific plan for disposing of dog waste, which shall be submitted to the Environmental Health Department for approval in conjunction with their review of the septic system. The project applicant shall implement any measures recommended by the Environmental Health Department and Animal Control Division for disposing of the dog waste. 2. The applicant shall provide for percolation and other tests deemed necessary by, and to the satisfaction of, the Department of Environmental Health for the septic system proposed on-site. All feasible measures recommended by the Department of Environmental Health to reduce potential impacts associated with the septic system shall be implemented. The Department of Environmental Health will also assess the applicant's plans regarding outdoor dog waste to ensure that the project will not significantly degrade water quality. Any feasible measures recommended by the Department of Environmental Health to reduce water quality impacts shall be implemented by the project applicant. 3. As a condition of the approval of the Use Permit, the applicant is required to prepare and submit four sets of construction plans and make an application for a Building Permit. Construction shall comply with federal, State, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. The following conditions shall be placed on the building plans: • Identify the usable sewage disposal area proved to meet the requirements of the County Improvement Standards Appendix VII. • Place a note on the map that states that no water well may be placed within 100 feet of the Usable Sewage Disposal Area. 4. Proposed improvements shall comply with Title 24 energy conservation regulations. Appropriate compliance forms (two sets) shall be submitted indicating compliance with those standards. 2 5. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of Building Permits. 6. The applicant must comply with Uniform Building Code requirements for property line clearances considering use, area, and fire -resistiveness of existing buildings. 7. The applicant shall identify a location for the proposed kennel building toward the center of the property. The new location shall be chosen such that the existing home or barn may provide noise attenuation for the neighbor to the south. Planning Division staff shall review and approve the precise location of the proposed kennel building. The established noise level standards is 65 dBs maximum at the property line. If complaints are filed with the Planning Commission in the future and the Commission requires a noise study, the study shall be paid for by the applicant. 8. If the Department of Development Services or other County departments receive noise - related complaints regarding the project and the level of noise is in excess of established standards, the applicant shall implement recommendations of the Department of Development Services to reduce the noise impacts. In response to any pattern of noise complaints, the Development Services Department, at the expense of the applicant, shall conduct a noise analysis to establish the compliance of the project with standards in the Noise Element of the General Plan. Currently, the Noise Element establishes that acceptable levels of noise for the project area of up to 60 decibels Ldn or CNEL. If noise levels are in excess of established standards, the project applicant is required to reduce noise levels through recommendations of the Development Services Department, which may include, but are not limited to, keeping the dogs inside the kennel building at noise - sensitive times of the day, building noise attenuation devices that provide gome relief to nearby homes, installation of doors or sound insulation in the kennel building, limiting the applicant to a particular number or size of dogs based on noise levels, or other recommendations. Any implemented recommendations to reduce noise would be subject to Building Permits and other applicable conditions. 9. The installation, of the kennel building shall comply with all applicable building and electrical codes. 10. All facilities that are not in continual use for a period of six months shall be considered abandoned. Abandoned facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the facility is abandoned, the applicant may be required to return the site to its original condition within 30 calendar days of receipt of notice to abate. If the site is not returned to its original condition within 30 days, the County may do so at the applicant's and/or land owner's joint expense. 11. The facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 12. Prior to use of this project, the applicant shall remove all refuse/junk on-site according to County code provisions and contact Butte County Code Enforcement to verify that refuse/junk has been removed. 13. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 14. , Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Building Division 15. Building permits are required for the kennel building. Applicant must provide plans and calculations prepared, sealed, and signed by a California licensed architect or registered engineer verifying adequacy of building for proposed use. Design shall be in compliance with the 1998 California Building Codes. Environmental Health Department 16. Obtain a permit to operate a kennel from Butte County Health Department, Animal Control Division 17. Under County permits, establish new septic collection and disposal system and make other improvements or changes in operational plans necessary to dispose of the dog waste as determined through Environmental Health Department review. 18. ` The kennel permit required by the applicant to establish the kennel use shall be obtained from the Animal Control Division within 30 days of the issuance of the Use Permit. All conditions required by the Animal Control Division shall be implemented prior to issuance of the kennel permit. 19. The Use Permit is limited to a maximum of 8 dogs. The 12 dogs that are kept by the applicant at the time of the approval of the Use Permit are allowed, and are required to be registered with the Animal Control Division. The existing 12 dogs are allowed until they are reduced in number by attrition. The applicant is required to prepare records of the 12 dogs' name, age, sex, and breed; provide the Animal Control Division with these records; and notify the Animal Control Division when any of the dogs die. 20. The Animal Control Division shall inspect the kennel quarterly for the first year of issuance of the Use Permit, and annually thereafter. Any recommendations made by the Animal Control Division to address environmental, planning, nuisance, safety, or sanitary conditions at the subject site shall be implemented and financed by the applicant.
