AP 28-09-2.28-23-9 ASSESSOR'S PARCEL NO. Pursuant to the provisions of Chapter 13 of the Butte County Code and the special. conditions set forth below: H. Earl Parker, Jr. is hereby granted an amended Mining Permit to allow a change in Condition #14, and as a condition of approval, to provide for the reclamation of this mined area in accordance with the approved Reclamation Plan on file. 1. As a condition of approval for the permit or the reclamation plan, or both, periodic inspections of the site by the public works department shall be made to evaluate continuing compliance with the permit and the reclamation plan. 2. The Public Works Director may suspend the permit for a period not to exceed fifteen (15) days where continuation of a violation will adversely affect the public. In the event of a suspension, or should the Public Works Director request disciplinary action, the Planning Commission shall immediately set a hearing thereon with not less than five (5) days' notice to the operator. The Planning Commission, after completion of the hearing, may suspend or revoke the permit, or modify the permit, or may place the operator on probation should the violation found to exist be of a serious nature, adversely affecting the health and welfare of the residents of the County. 3. Upon a finding by the Planning Commission that a supplemental guarantee. for the reclamation of the mined land is necessary, a reasonable surety bond, lien on the property or a portion thereof, or other security conditioned upon the faithful performance of the reclamation plan shall be . filed with the public works department. SPECIAL CONDITIONS: 1. Preserve the trees north and east of the quarry site to provide a visual screen from La Porte Road and Los Verjeles Road. 2. The. eastern and northern portions of the site to be preserved in a natural 3. state, leaving the visible hillside undisturbed. Quarry operation to be conducted in the southern and western areas of site as proposed. Provide traffic control and stop La Porte Road traffic during actual blasting operations. 4. Operations, including maintenance, warmup of equipment, truck operations with the operating hours being from 6:00 a.m. to 6:00 p.m. Monday through Saturday,- and blasting hours will be between 10:00 a.m. and 2:00 p.m., Monday through Saturday. No blasting will be allowed on observed national holidays as stated (January 1, Martin Luther King Day, Easter Sunday, Memorial Day, July 4, Labor Day, Veterans Day, Thanksgiving Day, and Christmas). There will be no chain saw operations on-site after the specified hours. 5. Construct an access road approach to improve the encroachment driveway and to protect the La Porte Road roadbed. 6. Erosion control measures shall be implemented at the time of quarry operations, including: a. Stabilization of all graded areas and exposed soil surfaces. Access road to be gravelled. b. Proper development of roadside drainages. 7. Grading permits shall be obtained where required as per the 1976 Uniform Building Code. 8. The access road to be regularly watered as needed to control dust. 9. If any archaeological sites are encountered during quarry operations, a professional archaeologist is to be . contacted immediately to survey the discovery prior to further site disturbance. Obtain streambed alteration permit from the Department of Fish and Game for the bridge structure to be constructed over the intermittent drainage near Site A. 11. Design the backslope of the excavated material to withstand an earthquake with a magnitude of at least 6.5 on the Richter scale. 12. Comply with the proposed reclamation plan for the areas to be mined. Reclamation shall take place as mining progresses. Once a particular open pit area is finished as far as mining, reclamation - shall begin immediately for that area. (Planning Department) 13. Submit to periodic inspection of the sites by the Public Works Department to evaluate continuing compliance with the mining permit and reclamation plan. (Planning Department). 14. Applicant will be required to repair any extensive damage which may occur to roadways as a result of heavy hauling. It is understood and agreed that permittee, at its own discretion and expense, may contract the services of a registered engineer to examine the subject 'road before- any job begins and then examine road when the job is completed to aid in determing the extent and responsibility of damage in cooperation with the Butte County Department of Public Works. (Department of Public Works) 15. Comply with any applicable regulations that may be required by the California Regional Water Quality Control Board. (Environmental Health) 16. Comply with any requirements or regulations of the Butte County Environmental Health Department.- (Environmental Health) 17. Comply with all other applicable State and local statutes, ordinances, and regulations.
