Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. SPECIAL CONDITIONS: i 1. Prior to public sales, all pesticides, herbicides, and fertilizers used at the nursery shall be clearly labeled and stored in an enclosed structure restricted from the public. 2. The nursery shall be open to the public only between the hours of 8:00 a.m. and 6:00 p.m. daily. o 3. This Use Permit shall restrict the sale of any pre-packaged or retail accessory items such as hoses, tools, fertilizers, and other similar items. This restriction does not apply to bulk landscaping materials,such as, but not limited to, mulch, bark, decorative stone, and similar materials. 4. Prior to issuance of Use Permit the applicant shall submit a detailed parking plan to the Planning Division for approval. The plan must comply with the Parking Regulations of Butte County Code Section 24-35, providing 10 or more parking spaces and providing adequate turning area for traffic. 5. Prior to issuance of Use Permit the applicant shall obtain an encroachment permit and construct a 20 foot wide driveway access or a 15 foot driveway access with detours, in accordance with Department of Public Works standards. Construct 20' wide driveway from edge of pavement to 30' north. Construct remainder of driveway in accordance with PRC 4290. 6. The Use Permit will permit the installation of one (1) advertising sign not to exceed 25 square feet and a minimum of 15 feet from the edge of LaPorte Road. 7. The Butte County Fire Department requires that all new structures must meet the Fire Safe Regulations of Butte County and PRC 4290. 8. Applicant shall also comply with all other State and local ordinances, statutes, and regulations. Note: Minor changes may be approved administratively by the Director of Development Services or designee upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for an amendment.
