One week prior to your code enforcement officer's visit, I took possession of the aforementioned property. I had moved two of my trucks and my travel trailer to this property. The travel trailer is not and has never been occupied. I own it solely for camping. Frankly, I could not live in a twenty foot camper. The weekend of Sept. 26, 2004 I spent all day Sunday removing all of the furniture, fowl carpeting and miscellaneous garbage from the interior of this house. Monday, Sept. 27, 2004, the day of your officer's visit, I was pressure washing the building. Your officer, Scott Johnson, approached me shouting, "Where is Ralph?". I stated, "I have no idea where Ralph is. I am buying this property 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 from him." Scott Johnson stated, "This property is unsafe to occupy and has several code violations." I told Mr. Johnson, "I went to the building department and asked for all the files on this property. The files indicated that it had been in violation in the past and that the violations had been corrected and final inspected by an officer of your employ." Mr. Johnson stated, "You are wrong, this property has numerous violations." I asked Mr. Johnson, "What, in fact, are the violations?" Mr. Johnson stated, "The roof and the foundation." I rebutted, "I was in the attic of the house during the last rain storm. The roof structure and the roofing material maintained it's integrity during the storm, and no leaks were evident in my inspection." At this point, your officer became hostile and shouted, "I'm not going to argue with you!", and handed me a pre -written correction notice. I read the notice. It stated that I should obtain the permits necessary for rehabilitation work. I told Mr. Johnson, "I was only cleaning up and pressure washing." Mr. Johnson replied, "If you're pressure washing, it's obvious that you're going to do construction work." Then I noted the second violation on the correction notice; do not occupy travel trailer. I told Mr. Johnson, "I'm not occupying that travel trailer and don't intend to occupy it." Mr. Johnson again stated, "I'm not going to argue with you" , and left the property. Hence this letter and visit to your department. I am a retired licensed general contractor, formerly a Calavaras County building and environmental health officer, and I am well versed in building and environmental health issues. The clean up work, performed by me on Sept. 26 and 27, 2004, does not constitute the need for permitting. The work performed was only for assessment, to develop working drawings for future rehabilitation of this property. Please find attached a copy of your code violation letter, correction notice and a letter from Ralph Allan Midkiff, (owner of record), giving me authorization to acquire all necessary permits while this property is in between his ownership and mine.
