When the property was rezoned to A=R in 1983, the use became a pre-existing nonconforming use. Change or expansion of a nonconforming Uso requires a use permit under Butte County Code Section 24-37. If approved, this use permit would be the second such expansion granted to Sigler Pest; Control. A use permit was issued in March of 1986 for a 500 sq. ft. +/7 addition. The applicant met all the conditions, bit No. 4, which states "'Meet the requirements of Butte County Parking Ordinance."- The parking lot needs to be landscaped. Construction of an additional 28.8 sq. ft. for',office use, will require the construction of one additional parking ~space. Butte County Code Section 24-35 requires that 5% of the parking area be landscaped and the parking lot be separated from East 9th by a l0 foot landscape strip. This strip should goallalong the property kine breaking for, the existing driveway. In order to .approve an expax►5ion of a,pre-existing nonconforming use, the Planning Commission must make the necessary findings under County' Cole Section ``24-37 and 24-47, Given the proximity to Fighway 99 and frontage on E. 9th Street., the property is not suited for Low Density Residential uses. Expansion of the pest control should not be detrimental to s g es because it will result in little, ' ..urr-oundin residences if any,, additional,traffic, acid ,produce only, a limited amount of noise. The Sigler family ;owns three parcels adjoining the offices which' further buffers surrounding residences from noise,and activity.
