We have been informed by the Public Works Department that the effective date of this bond (United Pacific Bond No. U486952)'Is October 19, 1982. Substantially, there has been no effortto meet the improvements for which the bond is based upon'. Public Works also .advises that they have been contacted by the.bonding company on a 'periodic basis asking if the improvements have been met, I do not believe it, is the intent of our Public Works Department at this point in time to call ,�apon the bonding company to make the` improvements. This wouldn't be wise particularly at this juncture. However, some discussion and decision has to be made concerning the improvements. Land Use Issues Starr Brown of our Planning Department has advised' that the subject Property is reflected on the, County General Plan map as low density residential. Also, the existing zoning is agricultuiral-residential. The draft Chapmantown-Mulberry Specific Plan reflects the Chico -San property is currently used for ind# ' ►1 purposes, but is ro osed far residential. The is Specific Plan is scheduled for hearings before the Planning Commission to commence August 27.' As I have shared with you, staff is of the opinion that the Planning Commission will question the draft specific plan which will undoubtedly result' in substantial delays. In summary, the property has to be classified as a nonconforming building and nonconforming use. As a result, any change of business; (from'Chico-San) will require a`use permit, Based upon the foregoing, the status of the application, avid a plan for the fut ure, the following should be considered: 1. Chico -San may want to consider making an application to the county for a General Plan amendment and rezone. 2, The Butte County Economic Development Corporation may want to initiate the General Plan amendment and rezone. 3. Regarding the Chico -;pan facility, located in Chapmantown,-Humboldt and Willow Street, 20,000 square feet of manufacturing facility and 4,800 square feet of'office space, attached is a copy of letter from H. J. Heinz on the proposed donation/sale. There are still. many items to resolve before the donation/sale'can take place. One item being the zoning. Application rapers for the general plan and amendment: and rezone have been forwarded to H• J. Heinz for, their review. In the meantime, H.J. Heinz has ,offered to lease"the facilities to the EDC at very low rates, only the office space. A Locating in the office would be'three full-time staff of the EDC and, one parttime. There is little traffic generated since we meet with most of our clients a"t their place of business. In October, mid to'late, two other staff from the Butte College GAIN assessment would occupy space for'int•..,.e purposes of GAIN eligible participants. OPERATING POLICIES Leases Leases on the building space should be as flexible as possible so as to aac^modate the wide variety of'businesses which we are likely to encounter. Likewise, the term of the lease will, vary -according to the business' needs.
