A video of the site was shown. Commissioner Nelson asked ,if it was possible to move the mobile in both directions so that it will be placed outside of the setbacks? He said he did not understand what the hardship was. Staff said the proposed garage behind the proposed mobile is something the applicant is trying to keep. Commissioner Lambert asked if the plot map was correct denoting 13 feet between the property line and the proposed garage? Staff said this was correct, Commissioner Lambert said if the garage was moved to within 5 feet of the property line it would give them another 8 ft, for :the mobile and would move the mobile out of the setback off of Jackson. Staff said the problem with moving from the Wisconsin Street side was the septictank and leachfi.elds. Commissioner Ferguson 'asked if there were any future City plans for a sewer system? Staff said Environmental Health has noted a sewer service, storm drainage agreement for hookup in the event one is available as a condition of this variance. i The hearing was opened to the public. Carl Leveroni, contractor for Mr. Purdy, said the new septic system and leachfield area make it difficult to place the mobile outside of the setback area. Commissioner Nelson questioned putting the septic system on the other side of the mobile. Mr. Leveroni said there would be a problem with doing this because of the proposed garage/carport. He said the variance is re,quired because Mr, ,Purdy is proposing a mobile home which ;is a different configuration than the previous home. Commissioner Matson noted that this would be a 1990 mobile home and would meet HUD standards: The hearing was closed: Chairman Lynch said the mobile home will be better for the neighborhood, He said the mobile will be farther away from the street and lessin the setback than replacing the existing home. He noted that this was a substandard lot. Commissioner Nelson questioned making the findings for this variance. Staff (said. Chapman/Mulberry is unique, that there is an "Area Plan" being prepared for that community. When considering a variance regwest, the Planning Commission must determine whether strict application of the zoning code deprives the property of priveleges enjoyed„ by surrounding propertiev in the vicinity and under identical zoning classification. Variances from the terms of. the: zoning ordinance should be granted only when, because of special circumstances applicable to the property including, size, shape, topography, location or surroundings, 'the property is descriminated against by a given requirement of the ordinance. In addition, State law requires than any variance granted shall be subject to such conditions as will assure the that the adjustment thereby authorized will not constitute a granting of special priveleges inconsistent with l.i.mitations upon other properties in the vicinity and zone in which such property is situated.
