ANALYSIS: This project is a request for a variance from the 50 foot setback from the centerline of California Street. The, subject property is a corner lot which presently requires 50 ft. setbacks from all abutting streets. The proposed mobile home is slanted at an angle not parallel with Californis Street. Therefore a majority of the mobile home wouldbe 'located, in the setback area, The southeast corner of the mobile home is proposed at 31 feet,'six inches (31' 6") from the centerline of California; street. A variance is needed because of the _location of tine existing ,leachfield system. County Code requires buildings to be located at least five feet (5) from a septic tank and leach field. There are specific findings that must be made prior to granting a variance from the terms of the local 'zoning ordinance. These findings require evidence-that-special circumstances apply to the subject property that deprive the individual of privileges enjoyed by of xer property in the vicinity. Special circumstances that would justify granting a variance from the minimum setback standard would be physical constraints such as size, shape, topography, location "or surroundings. The special circumstances that could be considered for this request are the lot size and surrounding properties with similar setbacks. This property is located in the Chapmantown area of Chico. This area is characterized by substandard lot sizes that do not conform with the existing zoning regulations. Many homes and other structures in this area are located' within required setback areas. Many of the homes in the immediate vicinity of this project, particularly to the west along Martin Street, do not comply with the 50 foot setback. The. Planning Commission recently approved a similar variance request approximately three o of character with the neighborhood nor blocks to the north. Therefore, the request is not out g does it represent a granting of special privileges that other properties in the area do not enjoy. In addition, the applicant has attempted to minimize the variance request by angling the mobile home. This leaves only a portion of the mobile home in the setback area. The Butte County Environmental Health Department has indicated that the project will also `need to include leach field lines in the setback area. The County has permitted leach lines to extend 10 £t. into the setback area in the past. 2 v BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - May 19, 1993 This variance request has been determined to be ,a Class (5a) Categorically Exemption from the provisions of the California Environmental Quality Act (CEQAL). RECOMMENDATION A. Find that the project is Categorically Exempt from the provisions of CEQA; and B. Find that the lot shape -and the strict application of the zoning standard deprives the property owner of privileges enjoyed by other property in the neighborhood; and ' C. Find that there are other structures in the neighborhood located within the required street setback; and D. Find that approving the variance would not constitute granting a special privilege to the applicant that ,would be inconsistent with the ,application of the standards imposed on other property owners in the 'neighborhood; and E.
