The,hearing Was opened to'the 'public. Larry Loerke discussed the road condition. He said the Cost of this condition would be approximately $48,000+ and if the condition remains it would stop his project. HES discussed the illegal businesses on the road with commercial trucks tearing up the road. He said he would not be repairing any trucks an his site. He discussed :the damage done to the'road b the garbage trucks He did not think he should y g g and others. have to improve the whole road, but he was willing -to do his part of the road. He said he has done all the work, on -Lhe road to date. He said there is a, maintenance agreement on the road now. Commissioner; Peabody asked about, the 42 loads of gravel Mr. Loerke put on the road already. He asked if these were transfer loads.,Mr. Loerke said yes: Commissioner Lambert asked what the County's involvement was in aIRoad' Maintenance Agreement and staff said note. She asked about the County's authority over other uses that were established under the A-2 tonin in the e area. The effect of the A-2 zoning on this neighborhood Is striking. Along the Esplanade there is Basque Norte restaurant and two large apartment complexes. East of this warehouse is Town and Country Disposal, and to the northwest is another warehouse, The remaining lots are vacant, In agricultUral production or developed with one single family house. Expansion of the warehouse would not Ise Incompatible with surrounding land uses, although' It is Inconsistent - with' the -General Plan and recently adopted A-5 zoning. The 'A-5 zoning was adopted March 1, 1088 and 'wIll be In effect March 31, 1988. A Use Permit for a 6000 square'„foot warehouse, could be considered under Butte county Code Section 24-37, eXpansion 'of a pre-existing noncon;ormfng use. This use permit has.been published as an Item on which environmental' documents have not been completed, An initla'i study was prepared and malled to the applicant December 7, 1987. Although staff has contacted' Mr. ;Gore repeatedly and spoken with he and Mrs. Loerke, no mitigation measures were ever received. A' record search Is needed to determine whether an archaeological survey should be required.
