Commissioner Lynch kyondered what would happen with Condition, 4, if the property was,
transferred without being sold.
The hearing was opened to the public.
Lion Lancaster said he agreed, to the conditinns.
Vice-chairman Matson asked about adding a condition for. Mr. Lancaster to modify his sign, out
in front of this property.
Commissioner Lynch said the regulations of the Dome Occupation code section would control 'the
j size of the sign.
The hearing was closed..
Comaiiss.ioner Lambert said she had no problems with approval of this project4 She said there is
development occurring in the area.
It was moved. by Commissioner Lambert, seconded by Commissioner Ostrowski, and unanimously
carried for approval as follows:

Public orks: "1. Install curb, gutter, sidewalk and necessary 'road paving along property
frontage. Install necessary drainage improvements. Submit plans for drainage and roadway
improvements to the Department of Public Works for approval."
This is a Use Permit request to allow a machine shop business as a hoarse occupation. `'.Che
property is located. on the north side of Henshaw Avenue, approximately 1/4 mile west of the
Esplanade in Chico.
Mae applicant constructed a 1200 square foot structure in 1987. The building permits were issued
for a hobby shop/garage: In October 1989 Mr. Lancaster was found to be operating a machine
shop in the garage and was notified by the Building Department of the Building and zorii.Ig
violation. Mr Lancaster promptly made application for this Use Permit.
The structure houses a varietyof metal shaping machines including grinders, lathe, drill
p g press,
etc. The shop is located on the rear portion of a I acre parcel.
The two main concerns of this project are traffic generation and noise. Traffic generated by the
project is not expected to be significant. Mr. Lancaster has stated that he gets, on the average,
less than one customer a day. He is retired and this machine shop is more of a hobby for him
than a business. This amount of traffic generation is far ,less than would be generated by division
of the property and development with 3 additional homes.
The noise generated from the project could be significant. The processes involved in metal
fabrication have the potential to emit loud, but generally short duration, noise levels. The shop
structure is located within 10 feet of the easterly property boundary. Currently, the parcel to the
,east is vacant, but it is planned for residential development with densities up to 6 dwelling units
pes acre, As this parcel develops a conflict in _land ,use could occur. Generally noise levels of
50-60 dB CNEL,'are compatible with residential neighborhoods. The CN7EL scale is a weighted
scale that gives a higher value to noises occurring between 10:00 p.m. and 7:00 a m. Peak noises
that have a short duration are also averaged with quiet periods.
The shop structure is finished inside with sheetrock and has been insulated. This will provide
substantial`
nose attenuation. As longas the doors, to the building axe not open,noise levels
should not exceed tis dB at the property lines.

At the regular meeting of the Butte Countf planning Commission held July 26, 1990, your request
for a 'Lose Permit to allow a machine shop business as a home occupation on property zoned A-
R located on the north side of Henshaw Avenue, Chico, was approved subject to the following

Project description: This is a Use Permit application to allow a. shop building to be used as a
machine shop in -conjunction with a residential use as a home occupation. The shop building
exists on-site and no new construction is ,proposed. The project site is 3 acre in size. .
Ib,3b No soil disturbances will occu, from this project. All structures are existing onsite. As
a tesuft no additional runoff will be generated"
6a: The proposed use will 'probably generate noise levels higher than normally occur from
residential uses. The machine shop will be operated entirely within a building. Noise attenuation
is going to be a concern as this type of use cart generate occasional noise; levels of 30 db within
the structure. The proposed use will probably generate noise levels greater than normally occur
from residential uses. The ]Butte County Noise Element States that noise levels of 50-60 dB
CNEL are normally acceptable for a residential neighborhood. Noise levels up to 70 dB CNEL
can bo conditionally acceptable. The CNEL noise is a weighted scale that gives a higher value
to noises occurring from 10 pm to 7 am. Peak noises that have a short duration are also
averaged with, quiet periods. Peels noise events of 75 to 30 dB could occasionally occur within
the shop structure. Attenuation of these noises will be required. The shop building has been
finished on the inside with sheet rock and, according to the applicatit, has leen insulated. This
should provide adequate noise attenuation of no more than 65 dB at all property lines except the
east property line which is only 10 feet away from the shop building. Additional mitigations to
ensu
re acc,,ptable noise levels along this property line may be necessary.
8: The Butte County General elan Land Use Element designates this area Low Density
Residential. The surrounding properties have bewi developing at a density of 3 to 5 dwelling
units per acre. It is expected that the 5 acre parcel directly to the east of this parcel will develop
with single family dwelling at a similar density within the next 3 years. A conflict between the
proposed use and the surrounding uses may not be present today but may arise as surrounding
parcels are developed.

welding out'it. This posesa possible risk of explosion or release of acetylene in the event of an
accident. The containers should be secured to prevent tipping.
