Pursuant to the provisions of the Zoning Ordinance of the County of Butte •and the special conditions set forth below: Gertrude Hon is hereby granted a Use Permit to establish a commercial dog kennel for boarding of up to 20 dogs on APN 006-680-004 on Camas Court. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 1 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. Follow the dust control measures listed below: a During clearing, grading, earth moving, excavation, or transportation of cut or fill materials, water trucks or sprinkler systems are to be used to prevent dust from leaving the site and to create a crust after each day's activities cease. b During construction, water trucks or sprinkler systems shall be used to keep all areas of vehicle movement damp enough to prevent dust from leaving the site. At a minimum, this would include wetting down such areas in the later morning and after work is completed for the day and whenever wind exceeds 15 miles per hour. c Soil stockpiled for more than two days shall be covered, kept moist, or treated with soil binders to prevent dust generation." 2. If significant demolition, reconstruction, or construction of a new building is required, such activities will require additional review by the Butte County Air Quality Management District (BCAQMD), and any feasible measures recommended by the BCAQMD shall be implemented. 3. If significant demolition, reconstruction, or construction of new buildings is required to comply with Butte County Code requirements (including the Uniform Building Code), such activities will require review for potential impacts on biological resources by the Director of the Department of Development Services, or his or her designee. Any measures recommended by the Department of Development Services to reduce impacts on biological resources must be implemented. 4. As a condition of the approval of the Use Permit, the applicant is required to prepare and submit four sets of construction plans and make an application for a Building Permit. Construction shall comply with federal, State, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. P 5. Proposed improvements constitute a "change in use" or "change in character of use" asstated in the Building Code. Improvement plans shall incorporate all code -required elements for the new use. 6. All structures shall be made accessible to the disabled. Disabled accessible parking and an accessible path of travel shall be provided. 7. Proposed improvements shall comply with Title 24 energy conservation regulations. Appropriate compliance forms (two sets) shall be submitted indicating compliance with those standards. 8. Development fees for the proposed residential or non-residential improvements shall be paid prior to the issuance of Building Permits. The fees shall be those in effect at time of application and shall include,. but .not be limited to, School Fees, Park ---and Recreation District fees, Water and Sewer Service Fees, Permit and Plan Check Fees, and Fire Protection Fees. 9. The applicant must comply with Uniform Building Code requirements for property line clearances considering use, area, and fire -resistiveness of existing buildings. 10. Existing building/s shall be made to comply with current Building and Zoning regulations for the intended new use of the building/s or the existing building/s shall be demolished. 11. The applicant shall provide for percolation and other tests deemed necessary by, and to the satisfaction of, the Department of Environmental Health for the septic system proposed on-site. All feasible measures recommended by the Department of Environmental Health to reduce potential impacts associated with the septic system shall be implemented. 12. Place the following conditions on the building plans: a Identify the usable sewage disposal area proved to meet the requirements of the County Improvement Standards Appendix VII. b Place a note on the map that states that no water well may be placed within 100 feet of the Usable Sewage Disposal Area. c Show the 50 -foot setback from the high water mark of Mud Creek. 13. All especially noisy dogs shall be kept indoors or equipped with bark collars. 14. If a pattern of noise complaints attributable to the kennel is established, the Planning Division shall measure the level of noise at the project property lines. If the noise level of the barking dogs exceeds the "normally acceptable" range established in the Noise Element of the General Plan, revocation of the Use Permit shall be considered by the Planning Commission. 3 15. The installation of the kennel shall comply with all applicable building and electrical codes. 16. The Facility shall have a 12 -foot wide all-weather access to a publicly maintained road capable of supporting a 40,000 -pound fire apparatus with 15 feet of vertical clearance. 17. All Facilities that are not in continual use for a period of six months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within 30 calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within 30 days, the County may remove the Facility at the applicant's and/or landowner's joint expense. 18. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 19. The applicant shall contact the Planning Division for a field inspection to verify all conditions, of approval and ordinance requirements have been met. 20. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Building Division 21. Building permits are required. Provide plans and calculations prepared, sealed, and signed by a California licensed architect or registered engineer verifying adequacy of building for proposed use. Design shall be in compliance with the 1998 California Building Codes. Environmental Health Department 22. Under County permits, expand existing leachfield to accommodate additional septic loading or make other improvements or changes in operational plans necessary to dispose of the dog waste as determined through Environmental Health Department review.
