The Commission waived the reading of the Staff Report. A video of the site was shown.
Steve Hackney gave a .brief summary of the project. He saidthe applicant was informed
at the final inspection the the variance would be required. hie said the County has to
take some responsibility for not catching the violation at the foundation inspection time.
Fla said there are physical constraints on the property limiting the placement of the
garage.

Chairman Lambert stated that other garages and carports in the neighborhood do .not
encroach into the setback.
Commissioner Bergman asked if the garage Was built with building permits?
Mr. Hackney said yes.,
Commissioner Lynch asked what part did the County play in the error?
Mr. Hackney . -iid on Mrs. Souza's original map it indit ated a 50 ft.` setback ands the
Building Department stamped the plan as requiring a 50 ft, setback.
Commissioner Lynch asked if Mrs. Souza moved the garage into the setback and was
not tagged' by Builoing?
Mr. Hackney said this is correct.

Unda Souza submitted before and after pictures of the property. She said the violation
was not caughf, until the
final building inspection. She said tho 'kitchen was extended 8
ft. and this made the garage 8 ft into the setback area.

The hearing was closed.
Commissioner Bergman said there was a 5 ft:. error in the width of the street to start with
and a 3 . error on the property. He was in favor of granting this variance.

Chairman Lambert was concerned with setting a precedence where there are no other
encroachments in the neighborhood. She said the problem is the garage is already built.
She said the Commission needs to discuss finding a solution for structures that are
already built and how to abate the 'problem.
Commissioner Lynch said the applicant submitted building plans and obtained building
permits. He said one problem was the lack of information to the Building Department
from the applicant that the plot plan was changed.
Staff said the dimensions remained the same, that the error was in the setbacks, not the
size of the garage.
;Commissioner Lynch said the applicant did move the structure on -,site diffet,ent from the
plans spbmitted to the Building Department. He said where the setback was, not checked
at the time the foundation was put in, he would vote in favor of the variance. He was
concerned, however, with the intent, to build the garage other than how it was shown on
the plans.
It wasmoved by Commission Nelson, seconded by Commissioner Ferguson, and
.;
unanimously carried for approval,so, follows;
A. Find that the proposed project is categorically exempt from provisions of the
California Environmental Quality Act in accordance with Section 15305, Class 5 (a)
of the California Public Resources Code; and
B. Find that the strict application of thischapter (Government Code 65905 and 65906)
deprives the property of privileges enjoyed by other property in the vicinity and
under identical zoning classification because zoning allows for this use, does not
create a health or safety problem; and other properties in the neighborhood have
garages; and
C. ,Approve the proposed Variance to allow the existing garage to remain on AP 007-
080-010 (Linda Souza).

The dilemma is that the subject property does not meet the physical
criteria for special circumstances (size, shape, topography, location
or surroundings) as given in California Government Code section 65906
allowing for a variance, yet the garage has been constructed after the
applicant followed county building permit procedures and had his
structure pass a number of inspections.
The question as what are the proper findings to make in order, to
determine the appropriate staff recommendation? section 65906 also
says that any variance granted "shall not constitute a grant of special
privileges inconsistent with the . . zone in which such property is
si.tuated.B1 Also, this section states "A variance shall not be granted
for a parcel of property which authorizesa use or activity which is
not otherwise expressly authorized by the zone regulation governing the
parcel of property."Granting a variance for this structure would not
be giving the owner special privileges inconsistent with the zone or
allowing the owner a privilege denied to his neighbors, in as much as
other houses on the street have garages, and the zone allows for
garages.

The purpose of a setback is to provide for the health and safety of the
citizens. The existence of the garage does not appear to impede
access 'or emergency services, obstruct pedestrian or bicycle traffic,
or interfere with street traffic in any way. An automobile can be
parked in the driveway and still leave room for public passage on the
right-of-way. El Paso Way serves 16 residences from East Avenue to
White Avenue. There is limited traffic on this street. The general
appearance of the neighborhood is enhanced with 'this newer structure
( including landscaping) .

An alternative would he to require removal of the

leave the owner with a stiiucture which would not serve the purposes of
a garage, that is, parking a standard size vehicle inside. Granting

use of'his property as enjoyed by other homeowners in the neighborhood.

Each zoning classification and laird use has an associated set of development
standards which are specifiad io the Butte County Code. The Co4G also estab-
lishes a procedure to grant variances from these standards whP.re unique
circumstances exist to warrant relief from the strict application of these
standards.
A vari.arxce can ,be granted only U specific findings are made to indicate that
unique circumstances do, in fact, exist. These specials ircumstances may
include factors such a5 the size, shape, topography, location and surroundings
of a piece if property.
The courts have clearly indicated that variances are not intended to rewrite

I am writing to respond to your announcement regarding the public hearing
scheduled for 2/24!94 in order to discuss tre excemption for Linda A. Souza 'Variance
to the front yard set back. As a home owner sharing boundries with the said address
(2422 El Paso Way), I am writing to state my opposition to Unda's regiiest for an
excemption. Some of my :reasons are as follows:
First, I find the S feet projection of the garage into the street to 'be`too'noticeabily
out of compliance to the rest of the neighborhood and the general stated county code.
Secondly, because of its non conformity to the neighborhood, it is visually disturbing
and does in effect block and binder my view from my property to the .rest of the street
southof my home.
Thirdly, granting an excemption to this variance, I believe will be setting a precedent
that says its okay` for every property owner in this neighborhood' to initially ignore and
violate the, county code for one, two to three years, after which
retract, ;apply and simply
