Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below:- Lisa Lucas is hereby granted a Use Permit in accordance with appiication filed: 121 iGi96 to allow a preschuul center for 24 children as a quasi -public use on property zoned R-3 located on the north side of Burnap Avenue approximately 500 ft. north of Lassen Avenue in Chico. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(c), construction of new small structures not involving the use hazardous substances and with an occupant load of 30 persons or less; and Section 2:2oning Ordinance Findings. A. The proposed use is a conditional use of the property which pursuant to Butte County Code Section 24-35 will not conflict with, impair or be detrimental to the uses both permitted and conditional in the R-3 zone and the Medium Density Residential General Plan designation in which it is located and/or adjoins because these land use categories allow for small lot, multi -family and public -quasi public uses; and B. The proposed use would not be unreasonably incompatible with, or injurious to, surrounding properties in that the project is conditioned to reduce associated impacts to a level of insignificance that are similar to existing conditions and uses in the area; and C. The proposed use of the property would not be detrimental to the health, safety, and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County because the proposed use will not create any significant noise or traffic related impacts beyond present levels and operating conditions added will further reduce any associated impacts to a level of insignificance. Section 3: Action A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, approve a Use Permit for Lisa Lucas on APN 007-150-047 to allow a preschool for 24 children as a quasi -public use subject to the conditions listed herein. B. Minor changes may be approved administratively by the Director of Development Services, Public Works or Environmental Health, or their designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions: The child care center shall be limited to a maximum of 24 children and shall be restricted to operating between the hours of 6:00 a.m. and 6:00 p.m. Monday through Friday. -- 2: - The maximum number of employees is two (2). 3. Prior to issuance of building permits applicant shall install all sewage disposal infrastructure under permit from the Environmentai Health Division (EHO) for "Lille use and meet all regulations concerning the provision for adequate septic system installation and water quality/availability. -� 4. Prior to issuance of Use Permit submit a final site plan to Planning Division for review and approval showing two entrances connected by a pull through drive, a minimum of three (3) parking spaces and indicating required landscaping pursuant to the Butte County Code Section 24-240, including, but not limited to, parking lot landscaping. 5. Prior to paving driveway or parking area, the applicant shall provide a permanent solution for drainage and submit construction and drainage plans to Department of Public Works for approval and install the required facilities. 6. Property owner shall sign an avigation easement granting the right of continued use of the Chico Municipal Airport in the airspace above the project parcel and acknowledging any and all existing or potential airport operational impacts. 7. Preschool operator shall have all clients read and sign a disclosure statement acknowledging that the property is located within 1.25 miles of the Chico Municipal Airport and may be subject to the overflight of aircraft. 8. Building identification and/or addresses shall be installed and maintained in conformance with Public Resources Code 4290. 9. The preschool use shall be inspected by the State Fire Marshall. 10. Provide all weather access to all structures, which is designed to carry a 40,000 pound fire . apparatus at least. 10 feet wide with 15 feet vertical clearance. 11. Prior to issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to county standards, as specified in County Improvement Standards. 12. Prior to issuance of building permits deed to Butte County, in fee simple, 30 feet of right-of- way from the centerline of Burnap Avenue. The right-of-way shall be sufficient for the installation of standard No. S-5* at all street intersections. 13. Prior to issuance of building permits, sign and record an Agreement running with the land postponing the installation of road and drainage improvements on Burnap Avenue to RS - 2A road standard, including but not Limited to P.C.0 curb, gutter and sidewalk and the required street section. This agreement must be reviewed and approved by the Department of Public Works prior to recording. 14. Prior to issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural publicly maintained drainage channel and shall provide that there is no increase ;n the peak flow run-off to -said channel. !f drainage is detained on-site provide a $4200.00 per acre drainage fee for future permanent facilities. 15., Applicant shall comply with all other applicable state and local ordinances, statutes, and regulations. I hereby declare under penalty of perjury that I have read the foregoing conditions, that they are in fact the conditions which were imposed upon the granting of this use permit, and that I agree to abide fully by said conditions. General: The Hilti, Inc., fasteners described in Table 1 of this report are used to attach wood sills to concrete foundations. The fasteners are designed to be installed with a Hilti low-velocity powder -ac- tuated tool in accordance with the manufacturer's recommendations. The wood sills, seasoned to a moisture content of 19 percent or less and used under continuously dry conditions, have a 2 -inch nominal thickness. Findings: That the Exterior or Perimeter Silt and Interior Plate Anchorages are an alternate method of anchoring wood sill plates to that of the 1994 Uniform Building CodeTM, subject to the following con- ditions: 1. Fastener spacings comply with Table 1 of this report. 2. Exterior sill fasteners are centered in the wood sills a minimum 13/4 inches from the concrete edge. 3. Spacings in Table 1 are based on a maximum 100 -pound -per - foot shear load. For greater shear loads, see Evaluation Report No. 2388 for spacing. 4. C. The sale or lease by the City of property within the boundaries of the Chico Municipal Airport and other land within the 55 CNEL shall be subject to reservation of an avigation easement either by incorporation in the grant deed conveying title to the property or as a condition of a lease agreement. IV. PROCEDURE A. Avigation easements for private property located in the vicinity of the Chico Municipal Airport and within the 55 CNEL 1.
