He has received a letter from you dated February 21, 1992, indicating that there is a failure to obtain final inspection and approvals for a skylight prior to expiration of a permit and requesting that he correct the matter. Briefly, Mr. Cripe's situation is the following. Mr. Cripe purchased the property in October of 1990 from S �R Ernest Mena and Ruby Dickey.and at that time received a i2 disclosure statement indicating that they knew of no defects in the property in the area under discussion. Mr. Mena and Ms. Dickey in turn had purchased -the property in June of 1988 from a Ms. Boze and Mr. Cowan. In the disclosure statemient given to Mena and Dickey, the seller disclosed that the skylight in the living room installed without permits presents no problems. This disclosure in turn was not revealed to Mr. Cripe. It appears that Mr. Cripe purchased the property withoj.it any knowledge that there was in fact an unfulfilled correction notice dated March 9, 1988. It is clear that this was not disclosed to him by the sellers at the time he purchased and in turn it was not properly disclosed to those sellers at the time they purchased the property. I'm in the process of notifying the parties involved in the transactions of their responsibilities to correct the matter. I believe that legally Mr. Cripe has a claim against the sellers to him and in turn they have a claim against the seller to them to correct the problem. W --. The purpose of writing this letter is to inform the Building Department of the situation and request that Mr. Cripe be given some time to work out the problem with all the parties involved. He has no desire to avoid the problem and in fact has an interest in getting it taken care of. But I have advised him that it would be unwise on his part to correct the problem unilaterally without first advising the other parties of their responsibility and giving them an opportunity to get independent estimates and work out their areas of responsibility. Accordingly, I'm requesting that Mr. Cripe be given a reasonable amount of time to allow me to work out an equitable settlement with the parties if possible.
