Dear Mr. Byrne:
At the regular meeting of the Butte County Board of Supervisors held August 26, 2003,Tentative Subdivision
Map creating 36 residential parcels with two additional parcels. One for a community sewage disposal system,
and one for storm water retention. Domestic water supply to be provided by Cal Water (note: revision to prior
submittal)on property located at the southwest corner of Eaton Road and Gorman Avenue, in the north Chico
area was approved subject to the conditions attached.
A Notice of Determination (NOD) must be filed for purpose of completing the California environmental
quality Act requirements. The fee for filing the NOD is a $36.00 document handling fee. A check made
payable.to the Butte County Treasure in the amount of $36.00 should be submitted to the Planning Division
in order to complete the process.
The time within which judicial review of this decision must be sought is governed by California Code of Civil
Procedure Section 1094.6. Judicial review must be sought not later than the 90th day following the date on
which this decision becomes final, except that where a shorter time limit is provided by State or Federal law,
such shorter time limit shall apply.

Tentative Subdivision Map for John and Sharon Byrne, TSM 01-06
(Eaton Ranch Subdivision)
I. CONDITIONS OF APPROVAL:
Planning Division Conditions
1. Place a note on the additional map sheet that states: "Wood stove and fireplace
inserts installed in any home within this subdivision shall be EPA approved and
designed to meet emissions standards of the California Clean Air Act of 1988 as
amended." (Mitigation Measure #1)
Plan Requirements: All requirements shall be shown or noted on Final Map and
building plans.
Timing: Prior to issuance of building permits, compliance with above mitigation
is required to authorize fireplace or wood stove inserts.
Monitoring: The Building Division shall review EPA approval for applicable
building permit applications and shall inspect improvements to ensure
construction in compliance with approved permit(s).
2. Place a note on a separate document which is to be recorded rconcurrently with
the map or on an additional map sheet that states: "Dust generated by the
development activities shall be kept to a minimum with a goal of retaining dust on
the site. Follow the dust control measures listed below (Mitigation Measure #2):
(a) During clearing, grading, earth moving, excavation, or transportation of
cut or fill materials, water trucks or sprinkler systems are to be used to
prevent dust from leaving the site and to create a. crust after each day's
activities cease:
(b) During construction, water trucks or sprinkler systems shall be used to
keep all areas of vehicle movement damp enough to prevent dust from
leaving the site. At a minimum, this would include wetting down such
areas in the later morning and after work is completed for the day and
whenever wind exceeds 15 miles per hour.
(c) Soil stockpiled for more than two days shall be covered, kept moist, or
treated with soil binders to prevent dust generation."
Plan Requirements:. The note shall be placed on the Final Map. All
requirements shall be shown on building plans.
Timing: Requirements of the condition shall be adhered to throughout all
grading and construction periods.
Monitoring: The Planning Division and the Public Works Department shall
ensure that the note is placed on the Final Map. Building inspectors shall spot
check and shall ensure compliance on-site. Butte County Air Pollution Control
District inspectors shall respond to nuisance complaints.
3. Place a note on the map or additional map sheet stating: "Should grading
activities reveal the presence of cultural resources (i.e., artifact concentrations,
including arrowheads and other stone tools or chipping debris, cans, glass, etc.;
structural remains; human skeletal remains), work within 50 feet of the find shall
cease immediately until a qualified professional archaeologist can be consulted
to evaluate the remains and implement appropriate. mitigation procedures.
Recommencement of development activities shall not occur until clearance is
provided by the Butte County Department of Development Services. Should
human skeletal remains be encountered, State law requires immediate
notification of the County Coroner. Should the County Coroner determine that
such remains are in an archaeological context, the Native American Heritage
Commission in Sacramento shall be notified immediately, pursuant to State law,
to arrange for Native American participation in determining the disposition of
such remains." (Mitigation Measure #2)
Plan Requirements: This note shall be required to be placed on the Subdivision
Map or on a separate instrument recorded with the Subdivision Map.
Timing: This measure shall be implemented during site preparation and
construction.
Monitoring: Should cultural resources be discovered, the Planning Division
shall coordinate with the developer and appropriate authorities to avoid damage
to cultural resources and determine appropriate action.
4. Prior to Final Map recording, a sound wall shall be developed along the rear
property lines of lots 22 thru 28, sufficient to attenuate noise from East Eaton Road
traffic to a 60 decibel CNEL noise level in the proximity of residences and rear
yards. The design of the sound wall shall be reviewed by the Planning Division.
The design shall be accompanied by a report from a qualified acoustical engineer
or specialist that demonstrates that the sound wall attenuates noise to the desired
standard for lots 22 thru 28. Design and materials used for soundwall
construction shall be reviewed by the Butte County Department of Development
Services. The soundwall shall be designed of high quality attractive material.
Landscaping shall be provided along the East Eaton Road frontage of the
soundwall of a design to be approved by the Department of Development
Services. All landscaping shall be provided with an irrigation system necessary
to ensure that plantings become self sustaining or are provided with permanent
source of water. A homeowner's association shall be formed and given the
responsibility of maintaining the landscaping median, if built, and the front of the
sound wall.
(Mitigation Measure #5)
Plan Requirements:, The mitigation requires the submittal of a plan for a sound
wall to the Planning Division for approval and development of the sound wall
prior to Final Map recording.
Timing: The sound wall shall be developed prior to Final Map recording
Monitoring: Department of Development Services, Planning Division
5. To ensure that construction noise does not become a nuisance to neighbors,
construction activities associated with subdivision development such as clearing,
road building, grading, and infrastructure development shall be limited to the
hours of 8:00 am to 5:00 pm. (Mitigation Measure #6)
Plan Requirements: The mitigation requires that construction activities be
limited to the hours of 8:00 am to 5:00 pm.
Timing: The mitigation shall be effective during all times of subdivision
construction.
Monitoring: Department of Development Services, Planning Division
6. Provide a deed disclosure notice, acceptable to the Airport Land Use Commission,
for the sale of all resulting lots notifying purchasers of the proximity of the airport
and the potential for possible noise related impacts.
7. The two lots shown to be less than 6,500 square feet on the Tentative Map (lots
29 and 30) shall be combined or enlarged to exceed 6,500 square feet in order to
comply with the General Plan and Zoning.
8. Place a note on the map or on an additional map sheet stating: "Lot "A' as
shown on this Subdivision Map is restricted from further division or residential
development. The use of Lot "A" shall be restricted . to the development of a
community sewage disposal system necessary to serve the subdivision with
sewer service for 36 parcels (in accordance with Environmental Health Condition
26 i). In the future, should lot "A" not be needed for a community sewage
disposal system, it shall be devoted to other open space uses deemed suitable
by the Department of Development Services."
Fire Department Conditions:
9. Butte County Fire/California Department of Forestry Requirements:
(a) Place a note on the map or on an additional map sheet stating: "Fire hydrant
identification, reflector or post reflectors shall be installed acceptable to the
County Fire Warden."
(b) Place a note on the map or on an additional map sheet stating: "Instruction,
installation or development of structures on the parcels/lots shall comply
with the latest California Fire Safe Regulations (Public Resources Code
Section 4290) and all other applicable State and County codes, ordinances
and regulations in effect at the time of application for improvement permits."
(c) Place a note on the map or on an additional map sheet stating: "Building
identification and/or addresses shall be installed in conformance with Public
Resources Code Section 4290 and shall be posted at the beginning of
building construction and maintained continuously thereafter."
(d) A pressurized community water system for fire protection is required. The
specific locations and fire flow requirements shall be in accordance with the
Fire Department specifications and to the satisfaction of the County Fire
Warden. Average required hydrant spacing shall be 500 feet, hydrant size
shall be 6 inches, and residual fire flow shall be 1,000 gallons per minute.
Submit plans to the Fire Department for review and approval prior to
construction of facilities. (Mitigation Measure #7)
Plan Requirements: Submit plans to the Fire Department for review and
approval prior to construction of facilities.
Timing: This Mitigation shall be implemented at the time of site
construction and prior to issuance of final building permits.
Monitoring: The Butte County Fire/California Department of Forestry shall
ensure compliance with the requirements of this mitigation.
Public Works Department Conditions:
10. Provide street name signs per requirements of the Department of Public Works
prior to recordation of the Final Map. Street names shall be approved by the
County Address Coordinator prior to the recordation of the Final Map. A
minimum of 5 alternate names for each new street shall be submitted.
11. Provide a cul-de-sac, designed and constructed to County standards as specified
in the County Improvement Standards. The Final Map shall show the cul-de-sac.
12. All access rights shall be reserved by deed, per County Ordinance, and offered
for dedication and depicted on the Final Map.
13. Pay the recording fees then in effect for recording the Final Maps and related
documents.
14. Deed to Butte County, in fee simple, 30 feet of right-of-way from the centerline of
Godman Avenue and 40 feet from the centerline of East Eaton Road. The right-
of-way shall be sufficient for the installation of a standard No. S-5 at all street
intersections.
15. Construct one-half street section plus 12 feet on Godman Avenue to an RS -2A
Road Standard with vertical curb, gutter, and sidewalk and 2 inches of AC, and 8
inches of AB, SC 250 prime, fog seal and 95 percent relative compaction.
Construct full street section on interior streets to RS -26 road standard with
vertical or rolled curb, gutter, and sidewalk and 2 inches AB, and 8 inches of AB,
SC 250 prime, fog seal and 95 percent relative compaction. Submit design to
Land Development Division for approval. "R" value determination and other data
may be required to support the section design.
16 Prior to recordation of the Final Map, a permanent solution for drainage shall be
submitted for consideration and approval to the Department of Public Works.
The drainage plans shall specify how drainage waters shall be detained on site
and or conveyed to the nearest natural or publicly maintained drainage channel
or facility and shall provide for no net increase in the peak flow of runoff to said
channel or facility. (Mitigation Measure #4)
Plan Requirements: The mitigation requires the submittal of a drainage plan to
the Department of Public Works.
Timing: The mitigation shall be required prior to recordation of the Final Map.
Monitoring: The Department of Public Works shall be responsible for ensuring
compliance with this mitigation.
17. Dedicate a one foot "no access strip" or relinquish abutter's rights to Butte County
along the East Eaton Road and Godman Avenue frontage of all parcels, except at
approved access points.
18. Show on the additional map sheet or on a document to be recorded concurrently
with the Final Map a 50 foot building setback from the centerlines of Godman
Avenue and interior streets, and a 25 foot building setback from the right-of-way
line of East Eaton Road.
19. Street lighting shall be provided in accordance with Butte County requirements,
accepted design criteria, and recommendations of PG&E. If the developer
chooses to install the street lights and pay energy costs through a County
Service Area (CSA), he must complete the formation of the CSA prior to
recordation of the final map. The CSA formation process will require the
Developer to fund the service until the beginning of the first Fiscal Year in which
service charges can be collected for the CSA, and agree to an annual maximum
service charge to insure continued operation of the facilities.
20. Show all easements of record on the Final Map.
21. Prior to or concurrently with the recordation of the Final Map, pay in full any and
all delinquent, current and estimated taxes and assessments as specified iri
Article 8, of Chapter4 of Division 2 of Title 7, of the California Government Code
commencing with Section 66492
22. Prior to Subdivision Map recording, provide a design plan to the Department of
Public Works for review and approval proving that vehicle speeds would be
limited to 20 MPH at the Godman Avenue and East Eaton Road intersection for
vehicles traveling from East Eaton Road and turning right (southerly) onto
Godman Avenue. The developer shall be required to install the required facilities
approved under the design plan. (Per letter to John Byrne from the Land
Development Division, dated May 16, 2002.)
23. A Construction Storm Water Permit will be required by the State Water
Resources Control Board if the project results in a disturbance (including
clearing, excavation, filling, and grading) of one or more acres. Construction
activities that result in a land disturbance of less than one -acre, but which are
part of a larger common plan of development, also require a permit. The Permit
must be obtained from the State Water Resources Control Board prior to
construction.
24. Construct on -half street section on East Eaton Road to RS -2A, 4 -lane (32 feet to
face of curb) road standard with vertical curb, gutter, and sidewalk and 3" AC, 12"
AB, prime coat, fog seal and 95 percent relative compaction. Centerline
alignment to be developed by applicant's engineer in cooperation with the City of
Chico and County Departments of Public Works. Final alignment to be approved
by the County Director of Public Works. "R" value determinations and other data
may be required to support section design.
As an alternative to construction, the developer may pay an in lieu fee for
roadway improvements considered the responsibility of the subdivider. These
improvements would include curb, gutter, sidewalk and an 18 foot pavement
structural section of 3" AC and 12" AB.
Environmental Health Division Conditions:
25. WASTEWATER HAZARD ZONES
(a) Provide a 150 -foot community sewage facility setback area around any
existing wells within 150 feet of the property boundaries.
(b) Identify on the additional map sheet a 50 -foot sewage tight -line set back
from existing well sites on parcel identified as AP# 007-260-090.
26. PUBLIC WATER SUPPLY
(a) Prior to recordation of the Final Map provide a letter or other
documentation from Cal -Water Service stating that they are willing and
able to supply domestic water to lots 1-36.
(b) Place a note on the additional map sheet that states "Development of lots
1-36 will require connection to a public water supply".
27. NEW COMMUNITY SEWER
(a) Prior to improvement plan approval and/or before initiating any site
improvements provide Waste Discharge Requirements issued by the
Regional Water Quality Control Board (RWQCB).
(b) Prior to� initiating any site improvements provide additional soil test,
mounding analysis, disposal field size calculations or other information
deemed necessary by the Regional Water Quality Control Board for the
placement and approval of a community sewage treatment and disposal
system.
(c) Prior to initiating any grading or site improvements, submit improvement
plans for review and approval for the construction of a community sewage
collection, treatment and disposal facilities. At a minimum, these plans
must meet the following standards and criteria:
1. Comply with all State and local law regarding the design,
placement and construction of a wastewater collection and
disposal system;
2. The design must be included as an integral part of the grading and
site improvement plans, subject to approval by both Butte County
Environmental Health and Public Works Departments;
3. Provide a detail on the plan demonstrating encroachment. of
private sewer lines in public road rights -of way and their
placement in public easements;
4. The plan must be complete and detailed, submitted by a licensed
civil engineer, showing a continuous flow-through system. This
plan shall specify construction details with appropriate
construction notes, materials to be used and show elevations of
various gravity -fed components in relation to site plan (commonly
called a hydraulic profile cross section). This plan must be
finished and detailed sufficiently with construction specifics that
would allow a contractor to install the facilities in accordance with
the above referenced criteria.
(d) Prior to recording the Final Map, construct a community sewage
collection, treatment and disposal facilities in compliance with Regional
Water Quality Control Board, the Butte County Code, California Health
and Safety Code, California Water Code and other applicable codes and
regulations governing the design, construction and operation of the
facilities.
(e) Prior to recordation of map, provide an "encroachment agreement" to be
recorded concurrently with the map, satisfactory to the Department of
Environmental Health and Department of Public Works for the operation
and maintenance of community sewage' disposal facilities in the public
road rights -of way.
(f) Prior to recording the Final Map provide a Homeowner's Association or
other legal entity acceptable to the Regional Water Quality Control Board
adequate to insure the operation, maintenance or repair of the sewage
collection, treatment and disposal facilities. An entity other than a
Homeowner's Association (such as a community services district)
approved by the Regional Water Quality Control Board shall in addition to
meeting Regional Water Quality Control Board requirements meet the
following:
1. Insure financing of operation, repair and maintenance;
2. Provide qualified individuals and operational procedures for facility
operations, repair and maintenance;
3. Provide adequate resources to comply with all monitoring and
other Regional Water Quality Control Board Requirements;
4. Provide adequate resources for facility inspections and reports;
5. Provide adequate resources and/or mechanism to insure
adequate funding of a major sewage treatment and a disposal
facility replacement or reconstruction if necessary;
6. Provide a liability risk assessment for review by the County of
Butte;
7. Indemnify the County of Butte and Community Services District or
other government entity for all claims and liability that may occur
relative to the sewage disposal facilities.
(g) If a Homeowner's Association is formed as a responsible entity for the
maintenance and repair of the sewage collection, treatment and sewage
disposal system, obtain approval of the By-laws and CC&R's by California
State Regional Water Quality Control Board and Butte County
Environmental Health. Approval shall be obtained prior to recordation of
the Final Map.
(h) Place a note on the additional map sheet that states "Development of
Lots 1 through 36 will require connection to the community sewer
system."
(i) Place a note on the additional map sheet that states "Lot A is to be held in
common for the benefit of the homeowner's association for the purpose of
providing a community sewage disposal system."
(j) Place a note on the additional map sheet that states "Lot 28 shall be
designated common area for repair or replacement of the community
sewage disposal facilities." Lot 28 shall not be released from common
area designation for lease, sale or finance until a written release has been
provided by Butte County Environmental Health Department and the
Regional Water Quality Control Board. to the Homeowner's Association
and Developer. These provisions shall be incorporated into the
homeowner association by-laws and CC&R's.
(k) Provide a development agreement satisfactory to the Regional Water
Quality Control Board detailing the abandonment of the community
treatment plant and connection of.lots 1 through 36 to- City of Chico sewer
when available. The agreement must be prominently featured in a public
document such as the Department of Real Estate letter, Homeowner's
Association CC&R's and on individual lot deeds.
(1) If Lot A is proposed for open space after the community sewage disposal
system is abandoned, provide a plan acceptable to Butte County
Environmental Health Division and Public Works, detailing the restoration
and conversion of Lot A from a sewage treatment/disposal site to property
acceptable for open space.
(m) Provide for ownership or control of the sewage disposal area, sewer
mains, filter, dosing tank, re -circulating tank and. other facilities by the
wastewater system maintenance entity.
(n) Connections of Lots 1-36 to a municipal sewer system will eliminate
conditions relating to on-site community sewage systems.
(o) Sewer lines and laterals for the community sewage disposal system shall
be designed and installed so as to facilitate future connection to the City
of Chico sewer system. In conformance with the City of Chico Sanitary
Sewer Master Plan, dated December 20, 1985, construct dry line sewer
mains to serve the project and stubbed out to the property line for future
public sewer connection.
28. SOLID WASTE DISPOSAL PLANS
(a) Place a note on a separate document which is to be recorded with the
map or on an additional map sheet of the Final Map stating "Solid waste
disposal shall be the responsibility of each property owner. Trash and
debris shall be picked up weekly by either a trash collection company
approved by the County of Butte or the property owner shall assume the
responsibility for taking trash and debris to a County approved land fill.

29. If this entire matter or any finding, action or condition of this matter is challenged
in any other action or forum, the applicant or any other developer/operator other
than the applicant agrees to.defend, indemnify and hold harmless the County of
Butte from liability or loss related to the approval of this project in the subsequent
action or forum and agrees to sign an indemnification agreement in a form
approved by County Counsel.
Processing Fees
30. Prior to .recordation of the Final. Map, pay any outstanding project -related
processing fees, and/or Department of Fish and Game fees.
II. NOTATION
A. Minor changes may be approved administratively by the Directors of
Development Services, Environmental Health, or Public Works upon receipt of a
substantiated written request by the applicant, or their respective designee. Prior
to such approval, verification shall be made by each Department or Division that
the modification is consistent with the application, fees paid and environmental
determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.

WELL SHARING and MAINTENANCE AGREEMENT �
The attached document is being recorded to satisfy an Environmental Health
Department condition on a Certificate of Merger Application for John Byrne, et ux., on
AP 007-260-081 and 082. The Certificate of Merger is being recorded concurrently with
this document.
The legal descriptions for parcels 1 and 2 noted herein, are the same as Exhibit A
(parcel 1) and Exhibit B (parcel 2) contained in said certificate of merger.
THIS PAGE ADDED TO PROVIDE ADEQUATE SPACE FOR RECORDING INFORMATION.
Well Sharing & Maintenance Agreement
This document is intended to cover the sharing and maintenance of the well located at
580 Rockin' H Circle, Chico, California, which will henceforth be referred to as Parcel 2. The
domestic well is located in the garage of the residence and is shared by two additional units
located on Parcel 1. An easement has been created in favor of Parcel 1 to access the well on
Parcel 2. However, due courtesy should be used with regards to the sharing and maintenance
of this well as noted below:
2. Each of the units located on Parcel 1 shall pay $15.00 per month to the owner(s) of
Parcel 2. Unoccupied units will not be subject to the $15.00 charge.
Maintenance of the well shall be done during normal business hours which would be
from 8:00 a.m. to 6:00 p.m., Monday through Friday, excluding recognized holidays.
A twelve hour notice shall be given to the owner of Parcel 2 before the residents on
Parcel 1 shall perform any repairs. The owner of Parcel 2 can choose to do repairs at
anytime with twelve hours notice to the residents located on Parcel 1.
3. Repairs to the well that result in a charge of $150.00 or less do not require agreement
between. Parcel 1 and Parcel 2. However, if the cost should exceed $150.00, prior
agreement must be made between Parcel 1 and Parcel 2. The cost of all repairs are to
be shared equally between Parcel 1 and Parcel 2.
4. Parcel 2 shall provide service to the existing units located on Parcel 1 until which time
the units are removed or destroyed.
Parcel 1 shall relinquish it's easement on Parcel 2 when both existing units have been
removed or destroyed and is no longer needed.
This agreement is intended to guarantee cooperation between Parcel 1 and Parcel 2.
The terms of this agreement are to be used to facilitate a common good for both parcels.
Disputes are ultimately to be resolved by arbitration and not through legal means.

demolition permit applicants are required to fill out this form.
"19827.5. A demolition permit shall not be issued by any city, county,
city and county, or state and local agency which is authorized to issue
demolition permits as to any building or structure except upon the receipt
from the permit applicant of a copy of each written asbestos notification
regarding the building that has been required to be submitted to the United
States Environmental Protection Agency or to a designated state agency, or
both, pursuant to Part 61 of Title 40 of the Code of Federal Regulations,
or the successor to that part. The permit may be issued without the applicant
submitting a copy of the written notification if the applicant declares that
the notification is not applicable to the scheduled demolition project. The
permitting agency may require the applicant to make the declaration in writing,
or it may incorporate the applicant's response on the demolition permit appli—
cation."
