With reference to the above subject and your request for inspection of the pro-
posed conversion from storage building to studio apartment (M to R3) at 2910
Morseman, the inspection was made on May 5, 1992.
A reasonable visual inspection was made without going on the roof, under the
building, .or in the attic and found the following items which must be done or

Health Department approval for sewage disposal.
(3) The use of this building as an efficiency dwelling unit will not be
permitted unless conformance with Section 1208 of the Uniform Building
Code (UBC) is obtained, ie total area required for living room of 220
square feet.
The additional items that would be required, should you decide to proceed with
this project, would be:
Adequate foundation, properly sized roof framing members, conformance with
National Electric Code requirements, water heater, weep screed on stucco,
attic ventilation, conformance with Title 24 energy requirements and conform-
ance with a minimum five foot sideyard setback.
In addition to the above requirements, it was noted by a review of our records
and the Assessor's records that the conversion of the main house to a duplex
was not done with permits and appears to have been done within the last five
years. The duplex would have to be converted back to a single family or obtain
the required permits and approvals to do so.

Dear Mr. Benson:
This is a warning letter to notify you that .you are in violation of the
Butte County Code at the above referenced location as follows:
(1) Failure to obtain the required permits, inspections and approvals from
this office for remodeling residence.
Since permits and inspections are required for the above work, please contact
this office within ten (10) days of the date of this letter, submit three
(3) complete sets of plans, apply for the required permits, and pay the
appropriate fees.
(2) Failure to obtain the required approvals for creation of a duplex from
a single family residence creating an additional living unit.
Since the additional living unit is not permitted In the zone, the duplex
would have to be converted back to a single family or obtain the required
permits from the Building Department and Planning Department.
All work must stop until these permits are issued and you are authorized
by our field inspector to proceed. This field authorization cannot be made
until the existing work is inspected and approved.
Please be aware that Butte County has entered into a Code Enforcement Program
that seeks voluntary compliance with the Butte County Code but provides
an effective means of enforcement if such compliance is not obtained. If
voluntary compliance is not obtained, enforcement will be pursued through
the issuance of citations, fines, and the recording of a Notice of Violation.
Your cooperation in resolving this matter would be appreciated. Should

Code. However, you should be advised that Butte County has an active code enforcement
program which provides an effective means of enforcement. A re -inspection will be made to
determine compliance. If voluntary compliance with this notice is not accomplished by `
correction of the above -referenced violations, enforcement may be pursued through the issuance
of a citation to appear in the Butte County Municipal Court.
Upon conviction and per Section 41-7 of the Butte County Code, violators may be fined and a
Notice of Violation may be recorded which include a description of the action necessary to
correct the violation.
Furthermore, failure to comply will result in the Franchise Tax Board being notified of
your non-compliance. You will then be prevented from claiming state tax deductions for

This notice is given to you pursuant to Section 24436.5 of the California Revenue and
Taxation Code.
