This memorandum is in response to your request of April
15, 1988 as supplemented by your memo of April 22, 1988, regarding
the above.
As discussed below, the proper procedure to ;follow in this
instance is to :issue a conditional certificate of compliance
pursuant to Government Code §66412.6(b).
It may be arguable that the road dedication and its
acceptance by the County in 1936 effectively created the three
parcels. However,, the contrary argument is that a, road through a
parcel under common ownership does not create two separate parcels
the portions on either side of the road remain legally contiguous.
This is true under the current Subdivision Map Act (Government Code
§66.424),, and it was ,recognized; by the legislature in 1971 (Business
and Professions Code §11564 as enacted by statutes of 1961, Chapter
1446.) See 56 Ops.Cal.Atty.Gen►. 105 at 108. For purposes of this
memo we are assuming, but, not deciding, that dedication of the road
to the County and its acceptance by the County did not create any
separate parcels of real property.
Therefore, our analysis moves to the next :step which is
whether or noti the deed in 1937 improperly created separate parcels
in 'violation of the Subdivision Map Act in existence°at that °time.
A new, Subdivision) Map Act was 'enacted by Chapter 670 of the statutes
of 1937. Section 2(g) of that Act defined "subdivision" ' in part as
"''Subdivic;ibt" shall mean any land or
portion thereof shown on the last preceding
tax toll as aunit or as contiguous units
which ' is divided for the purpose of sale,
whether immediate or future, by a,tiubdivlder
into five or more parcels within any one
year. , ►'
Thus, it appears that the 1937 deed divided three
contiguous units into sib; parcels in violation of the Map Act.
However, the current Map Act provides in Government Code
§66412.6(b) that;
"(b) For purposes of thisdivisionor of a
local ordinance enacted pursuant thereto,
any parcel created prior to March 4, 1972,,
shall be conclusively presumed to have been
lawfully created if any subsequent purchaser
acquired that parcel for valuable
consideration without actual or constructive
knowledge of a violation of this division or
the local ordinance. Owners of pta,rcels or
units of land affected by the provisions of
this subdivision shall be required to
obtain a certificate of compliance or a
conditional certificate of compliance
pursuant to Section 66499.35 prior to
obtaining a permit or other grant of
approval for development of the parcel or
unit of land. For purposes of determining
whether the parcel or unit of land complies
with the provisions of this division and of
local ordinances enacted pursuant thereto,
as required pursuant to; subdivision (a) of
Section 66499.350the presumption declared
in this subdivision shall, not be operative."
The language in the abovo quote regarding presumptions is
confusing. However, it is our concl.uslon that Government Code
§66412.6(b) should be applied in this instance as follows: The -
parcels in question shall be.conclusively presumed to have been
lawfully created if the'Behr's present evidence to the Advisory
Agency establishing that they acquired the parcels for valuable
consideration without actual constructive knowledge of a. violation
of the Subdivision Map Act or any Butte County ordinance enacted
pursuant to the Subdivision Map Act, but the Behr's would still be
required to obtain a certificate of compliance or a -conditional
certificate 6f compliance pursuant to Section 66499.35 prior to
obtaining a permit or other grant of approval for development of the
parcels. In considering ',heir application for a certificate of
compliance, the advisory agency should not presume that the parcels
were lawfully created but instead should take a position that the
parcels were not lawfully created and the certificate of compliance
must be conditional and must require such .conditions as would have
been applicable to the division when the bearers acquired their
interest in the parcels in 1939.

As you have pointed out, Butte County did not have a.
subdivison ordinance until 1949. Therefore, in order to determin�
what conditions would have been applicable in 1930, we must turn x
the provisions of the Map Act which was in existence at that time.
I am enclosing for your information, a copy of the Map Act
as enacted in 1937.and effective August 2.7, 1937,
You will note that the 1937 Map: Act vested control of
design and improvements to the County and permitted the adoption of
local ordinances. See Section 1 and Section 2(f),
Section 6 provided in part that:
"In case there is no local ordinance, the
governing body may, as a condition precedent
to the approval of the map or maps of a
subdivision, require street's and drainage
ways properly located and of adequate width,
but may make no other requirements."
Also see Section 10 and Section 20.
Of course, the Map Act itself require, preparation of
maps, and the maps would have been required to comply with the Map
Act's provisions. See Sections 5, 12,, 13, and 14.
It appears that the requirements under the 1937 Map Acis
were rather minimal and that the conditions which would have been
applicable at the time the Behr's acquired the property could easily
be fulfilled through recordation of a record of survey, As you and I
have discussed.
