(LPW) (Continued closed from August 13, 1.992,) Staff gave a brief rundown of the previous hr`aning. Staff submitted the opinion from County Counsel regarding whether or not the owner/ocqupant had to reside on the propertl, before the Commission could consider the, 'second resident. Staff said it is very clear that the law does not require the owner to reside on the property, Commissioner Lan bert asked 'about information fxom Code Enforcement, on the violation, being available to the Commission? Staff said the Code. Enformnient files are not available to the Commission. Commissioner Lambert said she received a phone call from the applicant about attending this meeting and she told the applicant the heaiin was closed. and the only purpose for the Commission. his presence would be to respond to any direct questions from Commissioner Nelson said there are certain findir�+.gs that have to be made in approving a Use Permit. Commissioner ;Lynch said the commission could add a condition for the "applicant to comply with :zoning codes as they exist" or the Commission could deny the project. Commissioner Lambert said if this Use Permit was approved, she would like a, one year j limit on the permit. She wanted the. permit to come back to the Commission with a e report on any complaints, 1 Staff said the, reason for this Use Permit is for a permanent second dwelling for senior citizens, Staff said there is a violation on the property and this application is to correct that violation. Commissioner. The site presently has two mobile homes, one as the primary dwelling '(10 x 60) and the other authorized under an. agricultural worker affidavit, now expired (10 x 50). The primary dwelling was placed in 1974` and the agricultural worker unit in 1983. The agricultural worker unit is presently in violation of the zoning code and will require a Use Permit or the removal of the unit. The surrounding properties are zoned FR -5 with a General Plan designation of Agricultural Residential. 'The neighboring properties contain mostly single family homes; of typical construction or mobile homes on parcels ranging from 1.85 acres to over 14 acres in size. The requested second unit is permitted in the FR -5 Lone only with a Use Permit.
