Both of the project parcels are owned by the applicant, and are located on the west and east sides of Centerville Road, approximately 750 feet south of Center Gap Road, Butte Creek Canyon area. Both of the parcels front on Centerville Road. Engineer: Sierra West Surveying. 1. The frontage of resulting Parcel 1 (APN 011-760-003) shall be at least sixty-five (65) feet as required by Butte County Code Section 24-75(c)(1). 2. New lot or parcel lines shall comply with setback requirements of applicable zoning and building, ordinances. Deeds and plats (if required) shall be submitted to the Department of Public Works, Land Development Division for checking and approval prior to recordation and shall contain the notes specified below. 4. Provide documentation from a title company of the applicant's choice verifying any deed of trust affected has been partially re -conveyed or modified to reflect the lot line adjustment and to prevent the creation of any additional lot or parcel. 5. Prior to recordation of deeds, provide documentation verifying payment of taxes as required by Subsection (b) of Section 20-95 of the Butte County Code and as specified in Article 8 of Chapter 4 of Division 2 of Title 7 of the Government Code, commencing with section 66492. 6. Prepare a plat showing approved Lot Line Adjustment. 7. Record plat with deeds if one or more of original lots or parcels was created by map. If a record of survey is prepared to show the lot line adjustment, recording of a plat is not required. C. Obtain Health Department approval for sewage disposal systems for all existing work. D. Because of the FR2 zoning, the garage living area must qualify as a guest house or office without a kitchen. The garage and the living area must be separated by a firewall on the garage side, ceiling and supporting walls. Provide heating and water heating facilities for the living area. E. All electric work must conform to code including grounding, proper circuitry, GFIs and pool wiring and bonding. F. All plumbing fixtures must be vented and connected to the building sewer. G. All mechanical and water heating equipment must be installed per code requirements. H. All structural work must conform to code requirements and the construction drawings when approved. I. Section 26-1 of the Butte County Code states that the County has adopted the 1979 Edition of the'Uniform Building Code. The Uniform Building Code requires that all persons constructing buildings within the County of Butte, except for agricultural buildings, are required to obtain a permit from the County Building Department. -Section 26-6 of the Butte County Code states that: "It shall be unlawful for any person, firm, or corporation to erect, construct,'alter, repair, move, remove, improve, convert, demolish or equip any building or structure in the unincorporated areas of the County or to cause the same to be done contrary to or in violation of any of the provisions of this chapter. "The use or occupancy of any building in violation of any of the provisions of this chapter is hereby declared to be a public nuisance and may be abated in a manner provided by law." Section 1-7 of the Butte County Code provides that any violation of any provision of the Code constitutes a misdemeanor, or in the discretion of the District Attorney, be charged as an infraction. The penalty for a misdemeanor is punishment by a fine not exceeding $500.00 or imprisonment. The punishment for an infraction shall be a fine not to exceed the sum of $500.00. The first was a large volume of precipitation which has been classified as a 100 year storm. (The California Department of Water Resources was called and said that the February 1986 storm produced the highest ever recorded flow on D.W.R. Guages on Butte Creek and the most runoff in the foothill:regions ever recorded; consequently the U.W.R. has called it a 100 year f100u. ) The second has the high velocity of water which came down a narrow:channel just North of the property (see diagram) which, because of the narrowness of the channel and the volume of water, created a very high velocity which *ate away the back of the property. This volume of water was pushed over the top of the bank near the pool and garage area. The pool and garage area were flooded even though the house (which is lower than the garage)-.:was:;not. This was due to the fact that th.e water was trapped in a bottleneck behind.the property and because of this bottleneck together with the velocity of the w'ate'r, forced the water up over the top of the garage/pool area and re-entered the creek in front of the garage at the low point of the property near the driveway. In conclusion, it appears that -the extensive widening of the channel would prevent any further flooding for the following reasons. 1. The narrow 5' wide channel now has been widened to 50± which will allow a greater volume of water at a slower velocity through the area without the bottle- neck effect or the soil erosion which was caused by the high velocity and narrow'thannel., 2505 ESPLANADE #9, P. 0. The area behind the garage and pool is in the process of being built up to an elevation 2' higher than the step area in front of the house which was not flooded in the recent flood (nor was it flooded in the floods of 1983 or 1964).
