Poteete 2222 Honey Run Road Chico, CA 95926 Re: Certificate of Compliance and variance conditions (Setback and Fire Sprinklers); AP 11-26-19, was 11-26-18 Dear Mr. Poteete This letter is to follow up on our telephone conversation on January 11, 1993 and our conversation on January 21, 1993. I have also reviewed your letter of January 20, 1993, and the attachments to it. I am writing directly to you, rather than to Mr. wilson, because you told me his work for you is now confined to pursuing remedies against your grantor. In our conversation you asked the County to simply delete the requirement for the installation of .fire sprinklers in your home and to delete the requirementfor the 200 foot setback. Your goal is to have the "clouds10 removed from your property to enhance its future marketability. I have met with other County staff members to review this. matter. Those attending the meeting were Bettye Kircher, Planning Director; Stu Ede --1, Chair of the Development Review Committee; and Jim Glander, Chief Building Inspector. We discussed the history of your parcel, the County's subsequent involvement, and possible courses of action now. The parcel was initially lgifteated band recorded, ACertificate establishing of Compliance was applied � for, issued the legality of the parcel, subject to certain conditions. Tc comply X17 th the conditions of the Certificate of Compliance, a variance regarding the parcel size was applied for. The variance was ultimately issued by the Board of Supervisors; with the requirements that there be a 200 foot setback from the swale and that fire sprinklers be installed in the residence. The approved plot plan for the variance showed the "pole1° of the "flag lot0° beg eyed cone ed back to the grantor, subject to a mutual easement for ingress and egress. To cha requirements, it would be necessary to file an apP lication to amend the variance conditions. You should ralso request a fee waiver in connection with the application.. You may also include in your application a request that the sprinkler requirement be deleted from .the variance Conditions,, However, since this is a standard condition being requested by the Fire Department, County staff will not concur in this request. We can clave no assurance whether your request regarding deletion of the sprinkler requirement' would be approved ,by the Planning Commission or by the °Board of :supervisors, on appeal. This notice would retain the 200 foot variance requirement as originally required, but would also note that pursuant to permits duly issued by the County a home had been lawfully constructed and a well drilled in locations which encroach into the setback area. The effect of this would be to acknowledge that your; home and well have been lawfully Constructed but that no additional structures could be constructed within ,the setback. in view of the above,, and in ordFr to move this matter towards a final resolution, you are requested to apply for an amendment to your variance or to obtain a building permit to'` nstall the fire sprinklers, within 30 days of the date of this letter. On May'28, 1991, 1 walked the drainage way, and adjacent area to more accurately determine dra,i:nage patterns and the potential for surface sheet flow' or groundwater to enter the drainage way from the Poteet.e property. The vast majority of the Poieete prooerty slopes paralle.to the drainage way. A small areaeast of the propbsed building site slopes at, an angle toward the drainage way.It' is ,pos:;ible that during periods of heavy rainfall. or excessive irrigation that drainage from the proposed building,, site could reach the drainage way. M�4M 6014, DISCUSSII?iN OF ENVIRONMENTAL EVALUATION AP # 011-260-018 lb,c,h: '`fire granting of the Variance to this project site to allow the proposed subdivision and subsequent development will require large amounts of earth work due to steep slopes and rugged terrain associated with the Butte Creek Canyon area. The project site ranges in elevation from approximately 400 feet to 480 feet above sea level. Slopes on the project site range from 2% to over 15%. Development of the project site will result in soil disruption, displacement, compaction, overcovering, and local changes in the topography. These impacts could potentially lead to significant increases in soil erosion and subsequent siltation of Butte "Creek. Cuts into Aeep slopes may increase soil erosion. It is anticipated that the Butte County Grading Ordinance will mitigate any significant impacts caused by the necessary earthwork associated with residential development on the ptoject site. 1g: No loss of prime agricultural productive soils will occur as a result to this project. Property is characterized as residual soils from lava flows, rough rock outcroppings, boulders, and shallow boils. The .property is located within the Butte Creek Canyon Lands which has not lent itself to commercial agricultural production. The project site is not of relative size to be of any value for commercial grazing purposes. 1h Some seismic activity has occurred within the Butte Creels Canyon area, Two faults have been. identified in the Butte Creek Canyon area however, their activity is unknown. All of Butte County is within the Moderate Eari:llquake Intensity Zone VIII. Construction of buildings to the Uniform Building Code Standards for seismically activity, areas should provide adequate protection to residents incase of seismic .activity. 3b: The proposed subdivision will ca-use some minor changes in the absorption rates and resulting amount of surface runoff, due to the impervious surfacer, related to paving, driveways, and 'roof tops, etc. No significant altering of the basic drainage pattern is antici;q gated. Intensity of the proposed project of one dwelling unit per 2.5 acres will minimize the amount of impervious surfaces to leso than 5% per lot. 3c: The proposed subdivision will require a new sixty (60) feet wide roadway be established -to accbss the back lot as proposed. Such a new roadway will create, a new intersection which will require some minor drainage improvements and perhaps a new culvert installation to facilitate the storm runoff from the newly created impervious surfaces. 3.f: Continued residential development in Butte Creels Canyon area will result in higher exposure to pollutant's to the water Plows in butte Creek. Residential development along the creek will increase drainage into the creek and'subs�equent nutrient loading which results in e6f; ophication. Runoff from the pavFd ground surfaces and rooftops may carry organic materials ane; typical urbanp h ollutants into Butte Creek. Excessive fertilization of landscaped areas and irrigation runoff ' yards lg � rich clam, thus contributingto the ut ophation of Butte Greek drainage system Setback requi�ients of the Butte County Environmental Health Department and the Butte County Grading Ordinance are ` anticipated to partially mitigate such environmental issues. In addition, it is suggested that a 200 feet setback with a naturdi vegetation zone be created from centerline of each drainage swale and ditch which traverses the project site in order to further :mitigate the identified impacts. (14 4a,b: Butte Creels Canyon area is a highly sensitive botanical area within Butte County. Within the vicinity of the project site, locations of rare and endangered plant species exist. Disturbance caused by development may have an adverse impact upon endangered or rare plant species. As a result, abotanical survey should be conducted by a qualified botanist to determine the extent' of impacts, and mitigation measures if needed. g: The project site is designated by the Butte County General Plan as "Agricultural -Residential". The, zoning classification is FR -5 (5 acre minimum lost size). Granting of tho� requested variance would allow the project site to support double the residential density'allowed by the existing zoning. The proposed 2-1/2 acre lot size is not consistent with the surrounding parcels sizes which are five (5) to ten (10) acres. Granting a variance to allow' less than the required five (5) acre lot size may constitute a grant of special, privileges inconshitent will limitations upon other properties in the vicinity and zone in which the property is situated. 14a: New residential development in the canyon increases the risk and potential for fire. Fire hazards are considered high already for the canyon, and increased development would require. increased services for fire protection. Approval of tl, y proposed project will increase the service demands for fire protection beyond that which Butte County can expect to meet in the near future. Fire protection services for the project site is in jeopardy at this time due to the fiscal constraints being experienced by Butte County. Due to the high fire hazards of the project site it is critical to ensure fire protection services are available and adequate for the longterm. Until such time a dedicated funding source for Butte County Fire Department is developed there is considered an impact on fire protection services by the proposed project. The applicant will have to provide additional mitigation measures for fire protection services. 14b Butte County Sheriffs Department is responsible for law enforcement and protection in the project area. Rapid development ,in rural areas of the County and restricted budjets have reduced the departments capacity for preventive patrolling and rapid response to emergency calls.This is a countywide impact and cannot be readily mitigated by one individual project. 20a: The project area is considered to be very sensitive for both historic and prehistoric cultural resources. As such, it is necessary to perform a records check through the Department of Anthropology at ;California StateUryersity, Chico, in order to determine if significant sites can be located on the project site. The records check will also detennine whether an archaeological survey of the property will be necessary and whether any further mitigation measures will be required. Recommended Mitigation Measures. - 1. A botanical survey should be conducted by a qualified botanist to determine the extent of impacts and mitigation measures if needed. 2. Commissioner Matson asked if the Young'swere given encouragement at the Planning counter that this item could or would be approved. Staff said the applicant is made 'aware, at the Planning Counter, what findings are necessary to approve a, variance request. The hearing was`'opened to the public. Dennis Young said this was a plea to the Commission to help his father sell 1/2 his property so he can afford to keep his residence on the other 1/2 of the property. He said ,is father needs the money from the sale to make repairs on his house. He said they have met all the suggested Mitigation Measures. He said his father is 73 years old and ill. He requested this application be granted. Commissioner Lambert asked if this property wa already split into two parcels where there are two parcel numbers,' Staff .said there are two parcels for assessment purposes only. Mr. Young said his father gift deeded 1/2 of the property to him and he is gift deeding the property back to his father for financial reasons. A disturbed grassy opening Is bordered on the east and north by strips of Interior Live Oak woodland. A tiny (aoout 2 square meters) lava outcrop with a substantial soil cover Is situated near ' the southeast boundary, while a strip of chaparral runs along the remainder of the south border abovea s flat pad cut Into the hillside in the past. Below this pad, the center of the site contains an open Blue Oak savanna with more open grassland against the western boundary.
