Kelly on AP 11-36-1 BATEi Adguot ll, 1986 This is a proposal to divide 40 acres to create two parcels. The present zoning; is FR -10 and 20 ( Foothill Recreational, - 10 and 20 acre parcels) (adopted June 27, 1978). The Lancs Use Plan Map of the Butte County General Plan designates this area as Agricultural Residential. There are no specific or community plans for the area. The proposal does not conflict with County zoning nor any adopted or proposed element of tlie Butte County General Plan nor any County, specific or, community plan. The proposed parcels comply with most policies of the General, Plan at twenty (20) acres in size. Conditional criteria apply for parcels less than 20 acnes in size for the Agricultural Residential designation. The California Department of Fish and Game (DFG) has submitted two letters on this project) one dated February 27, 1986 and one dated May 81 1966. Both letters hold to the position of 40 acre parcels for the critical deer winter range, Mitigation of the migratory deer factor was offered by the applicant by way of clustering the hamea;i,tes with no fences on the property lines. In the absence of DFG acceptance of clustering -the homesitesy denial of the tentative map is recommended based on Section 66474(e_) of the ;State Subdivision Map Act and policies of the General Plan concerning preservation of migratory wildlife habitat (Conservation, Open Space, Land Use Elements).
