Butte County Fire Dept./CDF: "Must have 30' of clearance for fire safe defensible space per
PRC 4290, or non-combustible exterior walls if less than 30 feet of clearance."
Environmental Health Deal:,: "This department has no requirements for use permit, based on
information submitted indicating facility will be unmanned and will not store hazardous
materials.,'
ANALYSIS.
Thisis a, Use Permit request to allow the installation of a 50-60' tali radio translator with
equipment shed: The site is located on the south side of Highway 32 and on the north side of
Humboldt Road, approximately 3/4 mile from the intersection on the ridge. KPPL FM Radio
j has made arrangements to lease a 30'x30' portion of the 49.59 acre parcel.; The proposed tower
location will be approximately 70 feet from the edge of Humboldt Road and is proposed to be

50 to 60 feet tall.
The tower is not located near any airport and is less than the 200' height that would require a
permit from the Federal Aviation Administration. This Use Permit is 'being heard as a public-
i quasi public use in an agricultural zone, basad upon a determination by the .Board of Supervisors
made on September 22, 1992. It appears that the proposed use will be compatible with the
surrounding land uses and will not be detrimental to the neighborhood.
According to the California Environmental Quality Act this project is considered to be a Class
3 Categorical Exemption (the construction and location of limited numbers of neNy, small facilities
or st- actures),
RECOtydMENDATI
Staff recommends approval of the project, subject to the conditions listed.
A. Approve; the Use Permit to allow a radio translator and equipment shed on AP#
011-040-027 (I PPL Fri) subject to the following conditions:
1• Applicant shall deed the requested 30' right-of-way strip to the County_of Butte,
2. The colors of the equipment shed and translatur tower shall blend with the natukal
environment and be approved by the Director of Planning or designee.

approximately 3/4 rnile southwest of their intersection, identified as AP#011-

A video of the site was shown, Staff said that the video covered the entire
project and that the shed does not require a building permit because of the size
and the naMare of the structure.
Commissioner Nelson asked if there were going to be any lights?
Staff said that there would be no lights and that it would be a short tower,
Chairman Lynch said that in reading the permit, it allows up to a 65 foot pole.
Staff said that was a, number they came v. p with because of the locatiorii treat
Humboldt Road. They did not want too tall of a tower which could have, an
impact on future development or the roadway,.
Commissioner Fergu;aon was concerned with the height of to towet and if it
were to fall towards Humboldt Road.
Staff said it would only. be into the right-of-way area and not they roadway. Staff
said that the pole u 0l be buried a distance of approximately five to eight feet.
The hearing was opened to . public.
Brad Fuller, representative for KRRL radio and for Dan Drake,, owner of
underlying ,property, introduced himself.' Mr. Fuller said that they have entered
into an easement agreement with Mr. Drake to use the area directly around the
shed. Mr. Fuller said' that the pole is 58 feet and the hole is about 7 feet deep.
The shed will be renovated with a"fence placed around it and there will be no
high voltage on site. Mr. Fuller sail ,at they concur with tl�rw conditions,
Commissioner Belson asked` it it wasgoing to be a pole only or, if there was
going, to be a transmitter also

Mr. Fuller said that it would be a pole with two styles of antennas at the top,
One is a receiving antennae which catches microwave signals coming from the
radio station in Chico ane the other antennae is the one that transmits it to the
Chico area.

Chairman Lynch questioned the Fire Department's condition of a 30 foot

dearance of grass and brush from the structure.
Mr, Fuller said that there was a mutual concern of the clearance of the grass
and brush, because they are worried that kidsmight drop cigarettes and start a
fire.
The hearing wa closed to the public,
It was moved by C.vmmissioner Nelson, seconded by Chairman Lynch and
carried unanimously, for approval as Follows;
A. Approve the Use Permit to allow a radio translator and equipment S' hed
on AP#011-040-027r (KPPL. FM) subject to the following conditions:
1. Applicant shall deed the requested 30' right-of,way strip to the
County of 'Butte.
2. The colors of the equipment shed and translator tower 'shall blend
with the natural environment and be approved by the Director of
Planning or designee.,
S.. Applicant shall obtain all necessary building perinits from the
Building Division of the Butte County Development Services
Department..
4� Applicant shall provide ;and, maintain, clearance of brush and grass
a minimum of 30 feet from structures. '
5. The tower height shall' not exceed 55 feet.
6. Minor changes may b13 approved administratively by the Director
of Development, Services upon receipt of a substantiated written
request by the applicant. Prior to such approval, verification shell
be made by each Department orDivision that the modification is

Dear Mr. Cheff-,
This letter is intended to confirm the County's agreement regarding the dedication
of the 30' right of way on Humbolt Road as a condition to the use permit allowing
KPPL Radio to install a translator site on Mr. Drake's property. According to Mr.
Mike McEnespy 0i Northstar Engineering, itis our understanding that the you on
behalf of the County, have agreed t0 forgo the imposition of this standard condition
until there is furthercievelopment on the subject property and that it will not be
necessary to prepare a Legal description or deed for the right of 'way in connection
with this use permit. Mr. Drake has agreed to issue a letter to the County stating his
consent to this future condition and that letter will be forthcoming within the week.
Based on this understanding, KPP L and Dan Drake tvill allow the time Tines for
appealing the con&-inns on the use permit to expire on today's date and will not
appeal said cond,*

Recently enactedlegislation, (AS 3158, Chapter 1706, Statutes of 1990 effective
January 1, 1991) requires that the Department of Fish and Game impose and collect
filing fees as specified to defray the cost of managing and protecting fish and VAIdlife
trust. resources. These tiling fees ar collected during the environmental review process
and are to be paid at the time the County files a "Notice of Exemption" with the County'
Clerk pursuant to Section 21152 of the Public Resources Code.

to the County Clerk and provided the County authority to collet a $25,00
documentary handling fee. The fee due for your project is 525,00. A check made
payable to the Butte County Treasurer should be submitted to this department by
September 20, 1993.
Project applicants should be aware of Section 21089(b) of the Public Resources Code,
provides that any project approved under CEQA is not operative, vested, or final until
the filing fees are required under Section 711.4 of the Fish and Game Code are paid,.
