A BUTTE COUNTY ADVISORY AGENCY MINUTES OCTOBER 10, 1958 PRESENT: JOHN'MENDONSA, DAVE HIRONIMUS, HOWARD SNYDER ALSO: JOHN CHRISTOFFERSON, TED FOX, GARY LIPPINCOTT, MILE EVANS' A. TENTATIVE PARCEL MAPS FOR CONSIDERATI.ONz 1, John McAmi.s, Tentative Parcel Map, AP ii-41-i7i, 2 'parcels on the south side of Hohey Run Road, approx. one mile east of Skyway. Butte Creek Canyon area. Engineer: GDA John Christofferson: was present. There was a discussion of the need for the Planning Dept;; condition to remove the brush pile on the property. It was to remain because of the fire hazard. Mr. Christofferson suggested that conditions #3 and 4 from Planning be combined, regarding a no development area and the riparian vegetation area bein indicated on the map. He objected to havingto actually locate on the map the riparian vegetation itself. Mr.'Hironimus agreed) to delete the condition to locate the actual stands of vegetation. There was a discussion of Health Dept, condition #6 and the other Health Dept. conditions. Mr. Christofferson said that there is useable area ,for both parcels. He questioned the need to map out all the little ponds on the property. There was,a discussion of the Planning Dept, condition to meet the requirements of the FR-5 zone; which requires 300 ft: frontage on.a major road, or 220 ft. frontage on a .non-major road. Mr: Christofferson said that the reason ,for the 65 £t. frontage consisting of a driveway to the back parcel was a solution to the problem of providing, the back parcel. with the 5 acres required and still leave space between the new property line and the existing house. Therefore, a driveway is included in the Parcel acreage instead of having an easement over the front parcel. Mr: Hironimus said that although avariance would be required in order to meet. the requirements of the zone, he feels that there is sufficient reason that a variance; could' be granted, considering the septic areas: The, time lines are running Out On the project• and there has been some confusion regarding communication on this projec*. He feels the project could be ,actedupon now, even though a variance would be required to finalize the map: If the variance is not granted, the map could not be finalized, {lr1NV lX"J od" C/ BUTTE COUNTY ADVISORY AGENCY MINUTES PAGE 2 October 10, 1988 Mr. Hircnimus stated; 1 will make a motion to find that an initial. study Iwas completed in compliance with the California Environmental Quality Act, that said initial study and comments received thereon identified potentially significant environmental effects that the project may have had, but revisions in the project plans, the proposals made by or agreed to by the, applicant would avoid such effects or mitigate such effects to a point where clearly no significant environmental effects would occur-, and there is no substantial evidence before the County that the project as revised may have a significant effect on the environment. The proposed negative declaration has been completed in compliance with CEOA and is approved and adopted by this action, also finding that the negative declaration together with any comments received: during the public review process have been reviewed and considered and approve the proposed tentative parcel map to allow the ,creation of a 5 and a 12 acre lot on AP 11-41-171; for John.McAmis subject to the following conditions. Public forks conditions.; 1. Provide two-way traversable access RS -8-1,D712 to each parcel from a county maintained road or state highway,. 2. As flows in Butte "Creek rise, ground water levels will also rise. During the winter and spring, the property may be subject to high groundwater levels. Construction of septic tanks, cdells, and homesites may lead to degradation of water quality in Butte Creek. The vegetatim community on-site is riparian,, adjusted to cycles of inundation and drought. Riparian habitat supports a great diversity of wildlife, and is considered the most productive habitat per unit area. Development will necessitate the removal of numerous trees and vines. A large heap (10 ft. x 30 ft. x 6 ft.) of limbs and brush along Honey Run Road are evidence of pass/clearing activities. Comments will be solicited from the Department of Fish and Game to determine the significance of the riparian vegetation and what. ,steps if ;any should be taken to preserve 4b,c: According to the recent printout of the Natural Diversity Data Base, there are no rare or endangered species in the vicinity. 5d On previous land division activities in the area, Department of Fish and Game has contmented on the high habitat values of Butte Creek, They havt:; supported requiring 100 ft. building setback Line from Butte County to protect wildlife values. 8: The Land Use Plan of the Butte County General Plan designates this area for Agricultural -Residential uses. The zoning on-site is FR -5. Rural residential uses has been anticipated in this area, and is consistent with the General Plan. However, the proposed lot design does not conform to the requirements of the FR -5 zoning district. Each Lot shall have a minimum 300 ft. frontage along Honey Run Road. The map will need to be revised to meet the frontage requirementsi if the applicant wishes to proceed with the parcel map in the present configuration, they must fir4it apply for and secure a Variance from the Planning Commission.. 9b Use of the properties for residential purposes will impact on sand and gravel resources. Once houses are constructed and occupied the minerals are, not likely to be mined, In addition; residents may object to other properties being mined. Removal of sand and gravel sites from production can be a significant impact. However, land Use trends in the area are well established. This land division is only contributing to an existing trend.' 11,12: Division and subsequent development will increase the number of families living in the Butte Creek Can on area. h s y x i area is subs ec+- to high fire hazards and restricted access for emergency vehicles 13a; The new house is expected to generate up to 10.7 vehicle trips per day. 13f: Additional, traffic on a narrow road may increase conflicts be tw een vehicles and bicyclists. 14a; Fire hazards up and down the canyon are high. The danger to residents and property, is exacerbated,by the limited access in or out, The Board of Supervisors has adopted a resolution recgtlirirg all subdividers beyond ::ommunity water to contribute $200,00 per lot for the ,purchase of w'ate), tenders, 14b,e,f: Division anddevelopment will increase demands for. aJj, governmental services. The addition of one lot is not significant. l6c,d Community water and server are not available to service this property. individual systems will be required. Groundwater, :i.:7 e-;pected to be plentiful, sufficient to supply domestic needs. Septic systems will be very difficult to install given the lack of soil and presence of cobble. Two leachfiel.d areas are shown on the southerly corner of the property. The house on Parcel 2 will be able to gravity feed into the l.eachfield site shown. The location of the soils suitable for leachfields is a constraint to parcel design. it may not be possible to meet the requirements of the zoning district, Ind provide a leachfield on each parcel. The lack of soil and Presence of water may make the property unable to support two housing units, 1.8: Some area residents may find the large brush pile along. Honey Run Road aesthetically offensive. The brush is a fire hazard and should be removed pursuant to the requirements of California Department of Forestry and the Air Pollution Control District. 19The high recreational values of the creek would be comprom4ed if the land was tamed for residential use. For example, construction of fencing or decks right along the creek would convert a public: resource into private use. The 100 ft. building setback noted on the original map creating this lot should beredefined as a l00 ft no-development area Recommended Mitigation Measures: 1. Preserve riparian vegetation within 100 feet of 3utte Creek or 25 feet from the top of the bank whichever is greater. 2. identify sc,:rce of water crossing Parcel 2's access', 3. Channel all 'chafer to approved dr-,inage facilities and/or modify pond construct on to eliminate flow. 4. Show all areas of inundation on final map as no-development areas. 5. One Hundred foot building seth@ck lune shall be redefined as a "no-development area's on the ,map, Anticipated Conditions of .A22E2val 1. Pay $200.00 per lot towards the purchase of 'Witer tenders. 2. Revise map to conform with the minimum 300 foot frontage requirement of the FR-5 zone. 3. Remove the large brush pile along Honey Run Road pursuant to CDF and Air Pollution Control District requirements. 1 jXpplicant; John McAmis Assessor's Parcel # AP 11-41-•171 Lag # 8'8-03'-30--Q2 'DATA SHEET A.
