ANALYSIS The proposedproject is a'request to locate a Butte County Fire Station oh a lot to be created for such purposes in the Butte Creek Canyon Area i,iearCentery lle, To accommodate a fire station on this site it is necessary to grant a variance and a use permit. The variance is needed to E.1 low a 2.21 acre lot for a fire station site in an Fit --5 zoning cla_..,ification. The required minimum tat size as stipulated by the Bptte County Code Section 24-112.4 is 5 acres. A variance of 2.79 acres is requested to the Code to accommodate the proposed fire station. This staff finding willaddress both the variance and use permit requests. , variance 2 The lot size of the proloct site was predetermined by the topographical constraints created by the,Creek and the Cantron Walls. The site pl annin.g on this subdivision to create a 5.6.1 acre site reflected the residential development requirements of the zone, and did not contemplate a public use for the pi ;aert-y. . The Zoning Ordinance was not written to address all special circumstances which may arise and thus the variance procedures were established within the code. It is the common practice of the County to allow parcels of smaller size to accommodate a public purpose. A fire station established on Coutolenc Road was done so on a smaller parcel than allowed by the zoning' of the area The requested var!9nce will not increase the allowed density of 'residential devel�,ment under the FR-5 zoning. The project site will still only allow one residential dwelling unit. In the event the fire station ceases to exist the land would revert back to the original parcel.' The Firo Department submitted a request to the Butte County Planning Commission in. October 1988 to determine if the proposed project site conforms to the Butte County General Plan. -,he Butte County Planning Commission .G aund that the site submitted by the CDF complies kith the Butte County General Plan and all of its elements. The Commission also found that the Butte Creek Canyon supports a small community which; is not readily accessible from existing fire stations and is in need ;of a, volunteer fire company at a very,mnimum. The proposed fire station in the Butte Creek _Canyon area near Centerville wil increase the fire fighting capacity of the existing Butte County Fire Department According to Dave Minton, Battalion Chief for the California Department of Forestry/Butte County Fire Department, the Department has a hole in their file protection net in the general location of Centerville. Under the present conditions, should a fire break out in Centerville, Paradise would come down from Haney Pun Road under the Mutual Aid Agreement. CDF'would run an engine from Chico up the long grade to Centerville and the time is estimated at over half an .hour to respond to a given fire in the Canyon. The project site was chosen by the Butte County Fire Department as the optimum location to service the area and bridge the gap in the current fire protection` net. Negative Declaration was prepared in accordance with the California Environmental Quality ,Act and is recommended for the J,,eoposed variance and use permit. Chief Brown said it would be too far south and too close to Chico Station 1. He said you have to look at population as well as being Located on the west side of the tracks_ Commissioner Lambert was concerned with response time if a fixe truck was stopped by a train on the tracks. She said she could be happy to see a station on the west side of the tracks. Chief Brown said the only site on the east side is on East Avenue which is too far north, He said there is ,no proposal for a`site on the east side Commissioner Lambert agreed this site was in conformance with the General Plan. It was moved by Commissioner Lambert, seconded by Commissioner Peabody, and 'unanimously carried to find the sites in conformance with the General. Plan as follows A. Memorandum TO: Butte County Planning Commission FROM: Laura Tuttle, Associate Planner SUBJECT: Proposed Fire Stations in West Chico and Butte Creek Canyon DATE: October 6, 1958 Chief Brown has requested the Planning Commission review proposed locations for new fire stations in Chico and Butte Creek Canyon.'' The Chico station is proposed to be located approximately between Oak Way and Kennedy Avenue along Highway 32. Tlnrao.gh this corridor,, there are a variety of zoning districts including C 1', C-2, S• -•R., g-1, R-3, and A- 10. With the exception of A-10, all of these zoning districts permit public/quasi-public uses with a use permit approved by tale Planning Commission.._ The A--10 zoning district has no pLOVisio.n for public/quasi-public uses. General Plan designations along the Highway 32 corridor, include Agricultural Reside nt;ial, Low Density Residential., Medium Density public/quasResientiali.-public usesea.sla secondarand Commrcal. The Chico Urban Reserve policy statement can be found in the Land Use Element following page 75. In order for a fire station to be located on the east side of Highway 32, the property would need to be rezoned to a zone whichwould permit or cond,it,.onally permit public-qu0si-public uses. In addition, future development must comply with all Ui the Urban Reserve policy statements dirRcted towards minimizing traffic impacts and providing -4 ,afrastructure. Chief Brown indicates on his enclosed memo that property at Oak Way and Highway 32 would meet their needs in terms of size, location and access to service area. If West 8th Avenue is extended,''the site becomes even more desirable. From a general Plan standpoint, any of the _properties , on the west side of Highway 32 from immediately south of Oak Way to Kennedy Avenue would be appropriate for a fire station. Butte- County Planning Commission YROM: Laura Tuttle, Associate Planner SUBJECT: Proposed 'Fire Stations in west Chico and Butte Creek Canyon DATE October 6 1988 Chief Brown has requested the Planr4ing Commission review proposed locations for new fire stations in Chico and Butte Creek Canyon. The Chico station is proposed -co be located approximately between Oak Way and Kennedy Avenue along Highway 32.. Through this corridor, there are a variety of, zoning districts including C•-1, C-2, S-R, R-1, R,3, and A- 10. with the exception of A-10, all of these zoning districts permit public/quasi-public uses with a tise permit approved by the Planning Commission. The A-10 zoning district has no provision for public,/quasi-public.uses. General Plan designations along the Highway 32 corridor include Agricultural Residential, Low Density Residential, Medium Density Residential, and Commercial. All of those designations list public/quasi--public uses as a secondary use. The property zoned A-10 located on the east side of Highway 32 is also in the Urban Reserve. area. The Chico Urban Reserve policy statement can be found in the Land Use Element following Page 75. In, order for a fire station to be located on— he east side of Highway 32, the property would need to be rezoned to a stone which would permit or conditionally permit,public-quasi.-public uses. in addition, future development must comply with all of the Urban Reserve policy statements directed towards minimizin,g traffic impacts and providing infrastructure Chief Brown indicates on his enclosed memo that property at Oak Way and Highway 32 would meet their needs in terms of size, location and access to service area. if West 8th Avenue is extended, the site becomes even more desirable. From a General Plan standpoint, any of the properties i on the west side of Highway 32 from immediately south of Oak 'Way to I' Kennedy Avenue would be appropriate for a fire station. The preferred site is located at the southeast corner of Oak and 'Highway 32. If all goes as planned, the Fire Department, CARD, and Chico Unified School District will develop adjoining properties resulting in a small public complex surrounded by open space and recreational facilities. This would be a very efficientland use pattern. A second location of the County proposed for a ne-fire station is Butte Creek Canyon. In order for Mr, Cussi k to create a lot and dedicate it to CDF, a variance would be required from the Planning Commission, This variance would be for minimum lot size. '.Vhe variance should have a stipulation on it to require the reversion to acreage of the two acre parcel with an adjoining lot in the event CDP does not.construct a fire station or closes the fire station on that site. Both of the parcels_in. the north end of the canyon (near the cemetery and Mr. Cussick's) would house the engine. CDF has requested approval of a"second location in Butte Creek Canyon for eTaipment storage and apparatus. A squad would.work out of this locat16n and respoiid to ' medical. emergencies and small fires- All. of the properties tinder review by CDE1 are zoned FR, -5 and FR -10. It is anticipated, that the Butte County Grading Ordinance will mitigate any adverse impacts associated with development earthwork. Very little change in the topography is anticipated. If: Earthwork associated with the devOlopment of the' Fire Station at this site may result in significant increases in soil erosion and subsequent silta-l" on of Butte Creek. It is anticipated that the Butte County Grading ordinance will mitigate any soil erosion associated with the grading and devel.oj.,,,nent of the project site. All of Butte County is within a Moderate Earthquake Intensity Zone VIII. According to Dave Minton, Battalion Chief for the California Department of Forestry/Butte County yire Department, the department, has a hole in tYeir fire protection net in the general location of Centerville. Under the .present conditions, should a fire break out in Centerville, Paradise would come down from Il'oneyrun. Road under the mutual aid agreement. CDF would run an engine from Chico up the long grade to Centerville and the time is estimated at over h,-lf an hour to respond to a rriven fire in the canyon. 20a: The project area is considered to be very sensitive for both historic and prehistor.tc cultural resources.
