Jose Oliver, a neighboring property owner, said that as long as there is no negative impact on the environment, he has no problems with weddings on the property. As a result of the discussions additional conditions were suggested. Commissioner Lambert was concerned that more activities besides just weddings might take place on the property. Mr. Lucassaid that Conditions 2 and 3 should cover concerns regarding additional activities. Commissioner Lynch suggested modifying Condition 7 to include the wording, "or one portable toilet per each one hundred people, whichever is greater." The property is zoned FR -5 (Foothill Recreational acre min.) and FR 16 (Foothill recreational 10 acre min.), This project is located in Supervisorial District 5. RELATED 17'EMS Nene FOR: Planning Convmssion Meeting of November 9, 199 ABSTRACT, This application is for a Use Permit to allow outdoor weddings, receptions, and imeetings. The proposed use is conditionally consistent with the kit 5/FR 10 zoning and is a secondary use in the Agricultural Residential and Grazing & Of= Y ands General Plan designations. Staff recommends approval with c mditions and findings contained in this, report. PROJECT CHARACTERISTICS: This project is a 'Use lPernfit request to allow outdoor weddings, receptions and other meeting related functions on 19.6 acres of laud located on the east side of Centerville Road and on the west side of Butte Creek approximately 300 ft south of the steel bridge at 13386 Centerville Road in Butte Creek Canyon. Aowss is from Centerville Road, Presently there is a 5,796 sq. ft. home located on the propefty that is served by an individual septic tank/leachfield system and'a private well. The proposal will however, utilize portable chemical toilets 'and bottled water for ,guests. Additional existing site inipro cements include apaved circular driveway, a large gravel parking area, a large patio area,, a stage platform, a gravel beach along `Jhe creek, several storage buildings and considerable landscaping. The surrounding properties are all fairly large in size with parcels ranging from 1.5 acres to 40 acres. The 1.5 acre parcel is the smallest in the area; generally the parcels are, 5 acres or larger. There are few residences in the area, the closest one is located approximately 500 ft to the west on the adjacent parcel. There are no structures on parcels located' to the east or north. ANALYSIS: The proposed use has,a s ncerms that must he addressed. in order T number issues and co to accurately assess the I project. These issues/concems3 are land use, traffic, environmental hetrlth concerns, and the potential impact to Butte Creek, w Butte County Department of Develct,)Tw t Services - Plarnting Division AGENDA ffEM I -and Use 'Me project site is dually zoned FR -5 (Foothill Recreational -5 ac. ruin) and FR -10 (Foothill Recreational - 10 acre min.) which allows commercial outdoor recreational facilities on parcels not less than 5 acres as conditional uses. The site is designated by the Butte County General Plan as Moth Agricultural Residential and Grazing & Open bands, these designations allow for outdoor recreation facilities as Secondaq Uses. The project substantially conforms to bath ;the General Plan and zoning. The general area surroun0a ng this site consists of rural residential homesites and rugged opens spitces. The proposed functions will occur between the rear of the house and the creek with parking only to the front of the house. 'There is one small older home located approximately 500 #t. to the west of the property that is screened from sight by dense vegetation and separated by a chain link fence. The 1emain ng three sides of the site are characterized by dense vegetation, the -creek .and a steep cliff. The proposed use is; unlikely to create either a noise or visual nuisance to any other property owners because of the isolated location of 'the site. The potential conflicts for this project have been thoroughly addressed in the Initial Study and barb mitigation measures and conditions have been developed to minimize the impacts presented by the project. The conditions include limiting the hours of operation to between 9.00 am. and 11:00 p.m. on Saturdays, Sundays and officially recognized County holidays, restricting the use of amplified music, and requiring all functions to be conducted to the rear of the house where all noise and visual impacts can be screened. Road and Traffic ima,Icts The vroposed use will, utilize Honey Rim Road and Centerville Road for access. The expected number of vehicle trips generaitedby this use will be between 40 and 60 trips per day of use, during some functions these numbers may be considerably lower. This is not significant because the applicant will only use this site on weekends and holidays and primarily during the summer months. The cumulative annual impact of the traffic generated by this use is incremental compared to the average daily traffic counts found on Centerville Road and lbney Run Road. An Environmental impact Report was prepared for the Butte Creekside Subdivision located on Honey Run Road and it was determined that the Level of Service on Toney Run Load was above .Level "C;°, the minimum County standard. The traffic count were done during peak hour on weekdays, while this project will be limited to use only during weekends when traffic counts are significantly lower. An allied issue .pertaining to this project is that these roads are narrow at spots and during summer weekends can be used by large number of people conducting recreational pursuits aloag Butte Creek. The 35 mph roads have been the top:c rf much discussion concerning the safety' 0f people driving' at excessive speeds and often alcohol use is a serious factor. The proposal will have the potential to place an additional 4.0 to 60 vehicle trips on these roads during the weekends, trips that would likely arrive at a common time and depart at various intervals. Considering the hour of the expected functions are likely to place the majority of guests at the site when others are using the creek elsewhere, ,it does not appear that there will be a significant overlap of vehicular traffic along Centerville Road or Honey Run Road. a Butte Cowto of Developnunt Services- Planning Division IN 2 i Farvironmentai Health concerns The project has been reviewed by the avironmiental Health Division OHM) and it was determined that the on --site existing septic system and well not adequate for this use. The well was installed without proper permits and the septic system is too small to accommcdate any number of guests. The applicant has met with County Counsel and an acceptable compromise was developed in the form of a condition to provide bottled potable water anal portable toilets. However, should the. Planning Commission have concern with the proposed compromise a reliable, permanent water source and functioning rest room facilities could be required. The use of bottled water and portable toilets may only perpetuate an unnecessary situation and provide logistical difficulties for the applicant who must prevent guests from using the existing plumbing on-site. Future improvements of the facilities are possible that would correct this situation and render the following conditions unnecessary. The EHD will require that the applicant provide guests uwith tilize the table well. `Vater either in the ford drinking of bottled water or some other manner that will not ut7h 1. Portable chemical toilets will also be required to be placed on-site under contract with a portable toilet provider and in a manner acceptable to the'.EhID. The Planning Division will require that the applicant maintain, and submit a copy of a rental agreement/contract with a portable toilet provider that will be in effect for all functions. The applicant will also be required to post signs at all entrances to the home stating that the inside facilities are not available for use for any reason. Butte Creek The project will utilize an area between the existing house and Butte Creels for the proposed functions. 'This area includes a stage, gravel beach and a large grassy area. The project has the potential to cause some minor.erosion on the west bank of the creek and possible erosion on the east bank if that area were to be developed for any uses. The west bank is presently developed to its fullest extent and only significant human use would lead to any impacts. The east bank of the creek is in its natural state and much more susceptible to damage. To mitigate these concerns the project is conditioned to disallow all facilities, seating areas and other intensive uses within 10 feet of the west bank and restrict all use of the east bank entirely. Other concerns The area of Butte Creek canyon is designated by the Butte County Fire Department/CDF as being a high fire hazard area. The proposal does not include the development of any new structures or other permanent improvements to the land that may result in a fire hazard. However; the increased use of the property by attendees of special outdoor events is likely to increase the potential for fire resulting from the careless use and disposal of flammable tobacco products, 'rhe use of torches for lighting, the use of outnt �)r barbecues and other potentially combustible products. To reduce the potential hazard from these items the applicant will be required to demarcate areas for safe smoking and provide adequate disposal areas for discarded cigarettes and the like. The well was. installed without proper permits and the septic systen► is too small to accommodate auy number of guests. The applicant has met with County Counsel and an acceptable compromise was developed in the form of a condition to provide' bottled potable water and portable toilets. Iawever, shoutd the Planning Commission have concern with the proposed compromise a,. reliable, permanent water source and functioning rest room, facilities could be required. 'The use of bottled water and portable toilets may only perpetual an unnecessary situa9ion and provide logistical difficulties for the applicant who must prevent guests from using the existing plumbing on -sit` Future improvements of the facilities are possible that wo,.'I correct this situation and render the following conditions unnecessary. The EFID will require that the applicant provide guests with potable drinking water either in the form of bottled water or some other manner that will not utilize the on-site well. Portable chemical toilets will also be required to be placed on-site tinder contract with a p )rtable toilet provider and in a manner acceptable to the FHD. Butte Creek The project will utilize an area between the existing house and Butte Creek for the proposed functions. This area includes a stage, gravel Mach and a large grassy area. The project has the potential to cause some minor erosion on the west bank of the creek and possible erosion on the east bank if that area were to be developed ,for any uses. The west bank in presently developed to its fullest extent and only significant human use, would lead to any impacts. The east bank of the geek is in its natural state and much more susceptible to damage. To mitigate these concerns the project is conditioned to disallow all facilities, seating areas and other intensive uses within 10 feet of the west bank and restrict all use of the east bank entirely: Qher concerns The area of Butte Creek canyon is designated by the Butte Colanty Fire Department/CDF as being a high fire hazard area. The proposal does not include the development of any new structures or other permanent improvements to the land that may -result in a fire hazard. However, the increased use of the property by attendees of special outdoor events is likely to increase the potential for fire resulting from the careless use and disposal of flammable tobacco product,, the use of torches for lighting, the use of outdoor barbecues and other potentially combustible products. To reduce the potential hazard from these items the applicant will be required' to demarcate areas for safe smoking and provide adequate disposal areas for discarded cigarettes and the like.
