There now exists an opportunity to have a driveway constructed at an attractive price and our clients wish to take advantage of this opportunity. Pursuant to UBC section 301 (B.7) no permit is required for driveway construction. However, I am told by the Land Development Department staff that if the excavation required in conjunction with the construction of this driveway amounts to 1000 cubic yards or more, then a grading permit is required. I have provided a sketch of the proposed driveway and estimate the construction yardage to be approximately 400 cubic yards. I therefore conclude that no permit is required.
