Frank Cook, Code Enforcement Officer SUBJECT: REQUEST FOR CITATION - Gordon Robert Dise 2735 Eskin Maidu Trail Chico, CA 95928 AP#011-270-004 DATE: January 7, 1992 On December 30, 1992, in North County Municipal Court, Case No. CR-53780.(The People of the State of California v. Gordon Robert Dise, Defendant) was adjudicated by the Honorable Darrell Stevens. The court found the Defendant not guilty on all counts. The court says that "almost" all structures noted as violations were on the property before the Defendant bought the property. That the proof was not beyond reasonable doubt in that Section 301 of the U.B.C. does not prohibit using, occupying or maintaining a building in violation (of the U.B.C.) and that, since P.V. Martin (Case Law) says only public welfare statutes can be violated with no intent, that these statutes cannot be because they are not public welfare statutes. The court implied that the case should have been filed civilly. This ruling by the court on December 30, 1992, effectively legalizes all structures which were addressed in the complaint as being in violation. However, this ruling does not prevent further actions to be taken if violations are created in the future. In summary, this case file is closed. Unless the violation(s) is (are) so corrected or abated, a citation shall be issued to you to appear in court for said violation(s) and for failing to comply with this notice. Upon conviction of said_violation(s) or for failing to comply with this notice, penalties shall be imposed and a Notice of Violation recorded in accordance with Section 41-7 of the Butte County Code. I met with the property owner, Gordon Dise,-and his girlfriend at 2735 Eskin Maidu Trail. 'I found Mr.. Dise and his companion to be,very coopera- tive and anxious to find a resolution to their building violations., The infractions are listed by count numbers filed at the Municipal. Court in the County of Butte. Counts #1 and #2 consist of an open deck approximately 12' x 16' in size. This deck is in excess of 6' off the surrounding ground level and does not have suffi- cient guard "rail. Counts #3 and #4 address a block wall. The block wall is retaining a surcharge of soil approximately 3' in height. An additional 6' height of block wall is located above the retaining portion, bringing the total height to 9'. This wall is "L" shaped, approximately 15' in one direction and 35' in the other direction. This wall is located adjacent to an existing garage of approximately 500 sq.. ft. and has a pit located between the wall and the garage. Counts #5 and #6 refer to an open deck 18' x 14' with a portion 3' x 6' that has been deleted, making the deck "U" shaped. This deck is in excess of 15' above the surrounding soil without an approved guardrail, and is unsafe. Counts #7 and #8 pertain to a wooden deck located adjacent to a Nomad Travel Trailer. This deck is approximately 12' x 18' and 4' above the ground level. The guard rail does not conform to the minimum code standards and additional sup- port of the deck is needed. All of the aforesaid count numbers are for construction violations at this parcel. None of these structures appear to meet the minimum requirements of the Uniform Building Code. This inspection was to address the additional violations as per"the amended infractions of July 6,1992. i The first twelve counts of this complaint have been addressed in'my previous investigation report. Count numbers thirteen through fifteen; inclusive, per-' tain to a Nomad travel -trailer. The travel trailer did not' have any utilities connected to,it at this time. Mr Dise stated that the travel trailer is only -used for occasional company and is only then connected with an electrical extension cord. At the request of Mr. Dise, I made measurements of the open deck adjacent to the travel trailer, listed as counts ten through twelve. Rod Taylor,.Supervisor Building Standards/Training FROM: Glenn Gibbons, Building Inspector II SUBJECT: Infraction Complaint RE: Gordon Dise DATE: July 24, 1992 On July 23, 1992, I'was requested to conduct'a status inspection of A.P. #011-270-004. I met with the property owner, Gordon Dise,'and his girlfriend at 2735 Eskin Maidu Trail. 'I found Mr.. Dise and his companion to be very coopera- tive and anxious to find a resolution to their building violations. The infractions are listed by count numbers filed at the Municipal Court in the County of Butte. Counts #1 and #2 consist of an open deck approximately 12' x 16' in size. This deck is in excess of 6' off the surrounding ground level and does not have suffi- cient guard rail. Counts #3 and #4 address a block wall. The block wall is retaining a surcharge of soil approximately 3' in height. An additional 6' height of block -wall is located above the retaining portion, bringing the total height to 9'. This wall is "L" shaped, approximately 15' in one direction and 35' in the other direction'. - This wall is located adjacent to an existing garage of approximately 500 sq.. ft. and has a pit located between the wall and the garage. Counts #5 and #6 refer to an open deck 18'.x 14' with a portion 3' x 6' that has been deleted, making the deck "U" shaped. This deck is in excess of 15' above the surrounding soil without an approved guardrail, and is unsafe. Counts #7 and #8 pertain to a wooden deck located adjacent to a Nomad Travel Trailer. This deck is approximately 12' x 18' and 4' above the ground level. The guard rail does not conform to the minimum code standards and additional sup- port of the deck is needed. All of the aforesaid count numbers are for construction violations at this parcel. None of these structures appear to meet the minimum requirements of the Uniform Building Code. _ _ — _ - y _ Glenn.
