AP 011-110-042 (ptn) ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Butte County Fire Department is hereby granted a Use Permit in accordance with application filed: 7/10/90 to allow a fire station in the FR -5 zone for property located on the east side of Butte Creek, south of Honey Run Road, in the Butte Creek Canyon area. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. SPECIAL CONDITIONS: 1. The gift deed shall be drafted in such a manner to provide a reversionary clause which states the following: "If said property described herein this gift deed is no longer used for public purposes, the property shall revert back to the adjoining parcel(s) as necessary to meet the requirements of the zoning classification. This parcel created by gift deed shall not be sold separately". 2. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 3. To mitigate the hazardous geometry of the roadway and increase site distance at in the intersection of the fires station driveway and Honey Run Road, it is recommended that the driveway to the fire station be graded to remove or reduce the bluff to allow a minimum site distance of 100 feet or more in both directions on Honey Run Road. (M) I hereby declare under penalty of perjury that I have read the foregoing conditions, that they are in fact the conditions which were imposed upon the granting of this use permit, and that I agree to abide fully by said conditions.
