Box 1477 BUTTE COUNTY Chico, CA 95927 BUILDING DIVISION Re: Community Sewage Disposal System for Rocky Bluffs Subdivision Phase II; APN: 011 420-005 Dear Mr. Horton: The sewage disposal permit for the Phase II bottomless filter expired on January 23, 2002. A site visit on May 8, 2002 confirmed that the construction of the Phase II filter has not been completed. Currently, there are homes in both Phase I & Phase II that are connected to the Phase I filter. The connection of some homes in Phase II to the Phase I filter was to be a temporary allowance that would permit the construction of those homes to commence while the sandfilter for Phase II was being built. The continued use of the Phase I filter by homes in Phase II is not acceptable. Until the Phase II filter is completed and approved, new sewage disposal permits and sanitation clearances will not be issued for homes in Phase II. Any current permitted residential septic tank effluent pump system installations will not be finaled until the Phase II filter is complete. In addition, if the design parameters are exceeded on the Phase I filter due to the connection of the Phase II homes then sewage disposal permits and sanitation clearances for the remaining lots in Phase I will not be issued. Effluent and groundwater monitoring data for the first quarter 2002 for the Phase I filter has not been submitted. The last sampling data received is from the fourth quarter of last year and the last operator's report was submitted on July 16, 2001. The filter is currently overgrown with weeds, which may indicate other maintenance items also may not be completed as required. This letter is notifying you that you are in violation of the map condition requiring a suitable sewage disposal facility for homes in Phase II and not meeting the Waste Discharge Requirements issued by the Regional Water Quality Control Board for the Phase I filter. You Horton Enterprises Page 2 May 13, 2002 need to arrange a meeting with Mike Huerta and myself on how you plan on completing the filter and to come into compliance with the Waste Discharge Requirements.
