They failed to gain permanent approval from the California Building Standards Commission (CBSC) after an extension to the emergency regulation had been granted. The emergency regulations dissolved on September 29, 1994. Generally, building permits must comply with those regulations in effect at time of application, and regulations which were mandated by emergency methods usually are approved and become law prior to their sunset date. The situation with pool barriers is unique regarding the reversal of regulatory requirements. In light of HCD's failure to gain approval from CBSC and sunset of the pool barrier requirements, I find it unsatisfactory to impose regulations which are more restrictive than those currently in effect by state mandate without adoption of a local ordinance. Our property is located at 49 Eagle Nest Drive and I have included, for your review, some pictures that will illustrate the reason that we are requesting this exception. For one, we live in a gated community of approximately twenty lots. Ten of those lots are located on the cliff side of the development. We are the first home to have built and completed our home and pool in this development. As you can see by the view, coming off our pool, is the cliff which is probably totally not climbable by anyone. To the east of our property, there is an adjoining lot that is not developed and we are in the process of planting a floral barrier between our property and the adjoining property. From a southern position, we have a very steep grade up to the road and again, the majority of this is not passable by the sheer height of the cliff because we dynamited the property to have a level foundation. We will have gates as part of the landscaping plan on the side preventing people from walking down the driveway and gaining access without going through a gate. So, it is my opinion and my request of the County, to give us the exception as we already have natural barriers and it would be financially a tremendous burden to attempt to enclose this property with a fence and at the same time, would take away the natural beauty which is one of the reasons we built here. I have been informed by Mr. Stachelek of Adonis Pools that his current pool permit will expire on June 18, 1995. I would appreciate not having to pay an additional fee because of a week or two of missing the deadline. Cindy and I would be more than happy to meet with a building inspector on our property so that we can get the final on our pool as we are very proud of our property and future landscape development that we are in the process of completing. It has been successfully used for dowelling threaded rod, bent rebar, and smooth dowels to concrete. In addition, it has been used to anchor the HFA internally threaded insert, eyebolts, and steel cable into diverse solid base materials such as cut stone and rock. There are 4 basic components to the HIT C-100 system: • HIT C-100 adhesive, • HIT dispenser, • Fastener, • Drill and bit. HOW IT WORKS The C100 adhesive cartridge contains parallel tubes of resin and hardener. They are dispensed through a mixing tube which insures proper mixing and eliminates any possibility of measuring errors. The dispenser has a dual piston system to ensure the accurate dispensing of the resin and hardener. The mixed adhesive is injected directly into the hole drilled in the solid base material. Barrier is a fence, wall, building wall or combination thereof, which completely surrounds the swimming pool and obstructs access to the swimming pool. Spa, portable, is a nonpermanent structure intended for recreational bathing, in which all the controls, water -heating and water-cirtudating equipment are an integral part of the product and which is cord connected (not ,permanently electrically wired). Swimming pool is any structure intended for swimming or recreational bathing that contains water over 24 inches deep. This includes in -ground, aboveground and on -ground swimming pools, hot tubs and spas. Swimming pool, indoor, is a swimming pool which is totally contained within a residential structure and sur Bounded on all four sides by walls of said structure. Swimming pool, outdoor, is any swimming pool which is not an indoor pool. REQUMEMCENTS outdoor Swimming pool: An outdoor swimming pool, including an in -ground, aboveground or on -ground pool, hot tub or spa shall be provided with a barrier which shall comply with the following: 1. The top of the barrier shall be at least 48 incites above grade measured on the side of the barrier which fates away from cite swimming pool. The maximum vertical clearance between grade and the bottom of the barrier shall be 2 inches measured on the side of the barrier which faces away from the swimming pool. (See flguse "A") Where the top of the pool structure is above grade, such as in an aboveground pool, the barrier may be at ground level, such as rite pool structure, or mounted on top of the pool structure. (See fYgure "B') Where the barrier is mounted on top of the pool structure, the maximum vertical clearance between the top of the pool stricture and the bottom of the barrier shall be 4 inches. (See ftgtue "C"). 2. Openings in the barrier shall not allow passage of a 4 -inch -diameter sphere. 3. Solid barriers which do not have openings, such as masonry or stone walls, shall not contain indentations or protrusions except for tooled masonry joints. 4. Where the barrier is composed of horizontal and vertical members and the distance between tops of the horizontal members is less than 45 inches, the horizontal members shall be located on the swimming pool side of the fence. Spacing between vertical members shall not exceed 1-3/4 inches in width. Where there are decorative cutouts within vertical members, spatting within the cutouts shall not exceed 1-3/4 inches in width. (See Fig. "D"). 5. Where the barrier is composed of horizontal and vertical members and the distance between the tops of horizontal members is 45 inches or more, spacing between vertical members shall not exceed 4 inches. Where there are decorative cutouts within vertical members, spacing within the cutouts shall not exceed 3/4 inches in width. (See figure ' 1 6. Maximum mesh size for chain link fences shall be 1-1/4 inch square unless the fence is provided with slats fastened at die top or the bottom which reduce the opening to no more than 1-3/4 inches. The wire shall be not less than 9 gauge. 7. Where the barrier is composed of diagonal members, such as lattice fence, the maxituum opening formed by the diagonal members shall be no more than 1.3/4 inches. S. Access gates shall comply with the requirements of Items 1 through 7 and shall be equipped to accommodate a locking device. Pedestrian -access gates shall open outward away from the pool and shall be self-closing and have a self -latching device. Gates other than pedestrian gates shall have a seif-latching device. Where the release mechanism of the self -latching device is located less than 54 inches froth the bottom of the gate, (1) the release mechanism shall be located on the pool side at least 3 inches below the top of the gate and (2) the gate and barrier shall have no opening greater than 1/2 inch within 18 inches of the release mechanism. (See figure "F') 9. Where a w211 of a dwelling serves as part of the barrier, doors with direct access to the pool through that wall shall be equipped with an alarm which produces an audible warning when the door and its screen, if present, are opened. 'lite alarm shall sound continuously for a minimum of 30 seconds immediately atter the door is opened, and be capable of being heard throughout the house during normal household activities. 'lite alarm shall automatically reset under all conditions. The alarm system shall be equipped with a manual means, such as a touchpad or switch, to temporarily deactivate die alarm for a single opening.
