BUTTE COUNTY ,BOARD OF SU-t!'4ISON ' tINUTES September 14 1982 Clerk Butte County Board of Supervisors County Center Drive. Oroville, C- 95965 Ref: Tentative Parcel Map AP 21-01-01 & 18 Waiver Application Honorable Board,; On August 23, 1982, the Advisory Agency denied the Ter,-,tative Parcel Map Waiver Application for Mrs. Jean Trueblood. The denial of this map was based upon Chapter 20 of the Butte County Code. In Particular,' the: lack of proven septic disposal area. On behalf Of my client., I wish to appeal the Advisory Agency's denial. Mrs. Jean Trueblood owns two parcels of rice ground. One parcel is 233 acres and the other is +- 43 acres, to eliminate the existingMr's• Trueblood wishes: dividing :line between the two parcels as they now exist and reestablish it in a location which would define one parcel of 87 acres and another of 190 acres. The soil, on this property is typical. of sails throughout the valley on which rice is grown. At present and for many years past, this property has been used for the cultivation of rice and other field crops There is no intention to deviate from the present use. Butte County Ordinance requires that adequate septic disposal. area be proven before now parcels are 'created or before boundaries are realigned. 1 believe that, in almost all cases, this is a justifiable regulation. However, in this particular instance, it should not apply. This is a proposed realignment of property limes to facilitate lease or sale: of agri-cultural property for agricultural purposes and not for ,domestic residence: K y 4+ d It is my understanding that this is not the first time this situation has been before the Board. Perhaps it would be to the benifit of both the Board and to thepublicto incorporate into the Butte County Code an option to the ordinance which the County Sanitarian could exercise in cases such as this i am sure that it would save time and money for all parties concerned On behalf of my client; I respectfully request that you uphold this appeal.
