(VIDEO A video tape was shown of the project site.. The Commission waived the reading of the Staff Findings. The hearing was opened to the public. No one was present to speak on this item. The hearing was closed. Staff suggested that this permit, if approved, also be changed to say "adult" dogs. Commissioner Lynch 'had no problems with this permit. It was moved by Commissioner Lynch, seconded by Chairman. Recommend clearance for this project ANAL ISi This project is a Use Permit to allow a training kennel on property located along the west side of Pennington Road approximately 1/2 mile south. of the Gridley-Colusa Highway. The site is 38 acres is used for rice production. The remaining two a 40 acre parcel of which approximately acmes consist of a raised area that is suitable for development. Within the raised area the applicant proposes to place a mobile home and a kennel structure to house up to twenty-four (24) hunting dogs. The remainder of the site will be used as a training area and will be kept in rice production for a while but, ultimately, will be allowed to revert to a natural state and be managed as a wildlife habitat. A Use Permit is required for kennels in all agricultural zones as determined by the Board of Supervisors in an interpretation made March 5, 1986. Kennels require a Use Permit because of the potential to impact surrounding residences and the need for sewage disposal. The project site is zoned A-40 (Agricultural 40 acre minimum parcel size). The General Plan designation is: Orchard and Field Crops. The proposed project is consistent with the intent of the A-40 zoning classification which allows the following land uses: General agricultural farming, horticulture, commercial livestock and poultry production, growing and harvesting of forestry products, warehousing and storage, mining, quarrying, hunting and fishing camps. The boarding of dogs as compared to the nd uses described above should not be any more intense of a land use. The generation of noise was considered in the Initial Study and .determined to be insignificant. The kennel will be set back from Pennington Road approximately o t feet and will be; 360 feet away from the southerly property line. The closest residence to the kennel is approximately 300 yards away on the southeast side of Pennington Road. No other residential, commercial, or, agricultural structures exist within 1./2 mile of the project site. Agricultural areas are not, • p animals and considered as sensitive for noise as are residential neighborhoods. The presence of a animal noises are common occurrences in the rural areas of the County. The Health Department will require that all animal wastes will be directed into a septic system. DEPARTMENT OF ENVIRONMENTAL HIF,ALTH: "All animal wastes and run-off from wash downof Kennel to be, confined to an approved subsurface sewage disposal system." DEPARTMENT OF FISH AND ' GAME: "No impact to ,the greater Sandhill Crane habitat. Recommend clearance' for this project." ANALYSIS: This project is a Use Permit to allow a training kennel on property located aloi.g the west side of Pennington Road approximately ' 1/2 mile south of the Gridley-Colusa Highway. The site is a 40 acre parcel of which approximately 38 acres is used for rice production. The remaining two acres consist of a raised zrea that is suitable for development. Within the raised area the applicant proposes to place mobile home and'a kennel structure to house up to twenty-four 24 hunting dogs. The remainder of the site will be used as a training area and will be kept C ) g g g P in rice production for a while but, ultimately, will be allowed to revert to a natural state and be managed as a wildlife habitat. A Use Permit is required for kennels in all agricultural zones as determined by the Board of Supervisors in an interpretation made March 5, 1986. Kennels require a,Use Permit because of the potential to impact surrounding residences and the need for sewage disposal. The project 17 � P g site is zoned A-40 (Agricultural 40 acre minimum parcel size). The General Plan designation is Orchi xd and Field` Crops. The proposed project is consistent ,with the intent of the A-40 zoning classification which allows the following land uses: General agricultural farming, horticulture, Commercial livestock and poultry production, growing and harvesting of forestry products, warehousing and storage, mining, quarrying, hunting and fishing camps. The boarding of dogs as compared to the land uses described above should not be any more intense of a land use. The generation of noise was considered in the Initial Study and determined to be insignificant. The kennel will be set back from Pennington Road approximately 180 feet and will be 360 feet away from the southerly property line. The ciosest residence to the kennel is approximately 300 yards away on the southeast side of Pennington Road. The, project site is bounded on the north, west and south sides by the Grey Lodge Wildlife area. No residences are expected to be constructed, within the wildlife area. No other residential,, commercial, or agricultural structures exist within 1/2 mile of the project site. ,Agricultural areas are not considered as sensitive for noise as are res.Aential neighborhoods. The presence of animals and animal noises are common occurrences in the rural 'areas of the. County. The Health Department will require that all animal wastes will he directed into a septic system. The applicant proposes to place a single family dwelling and a 2400 square foot pole bam kennel on site. This represents less than 0.25% overeovering on the 40 acre site. This is not a significant amount. 1g. The majority of the parcel is currently under rice cultivation. This use is expected to continue in conjunction with kennel use for a period of time. There is an existing raised homesite ;area 'on site that is not being cultivated. Eventually, the property owner plans to allow the land to return to a "natural" state and manage it as a wildlife habitat. Ih: All of Butte County is within a Moderate Earthquake Intensity Lone VIII. Adherence to Building Codes for seismically active areas should provide adequate, mitigation. 1 3j: The majority of the parcel is flooded annually for rice production. There is an area approximately 1 1/2 acres in size that is raised approximately 2 to 3 feet above the rest ot; the parcel.. This is the area where development will take place and it is not subject to flooding. 4d: See discussion for Item No. 1g. 5b;c,d: The project is contiguous to the Gray Lodge '(3`dil:ilife Area on the northwest and, south sides. This wildlife area is managed for migratory water fowl and provides winter habitat for thousands of birds each winter. The entire area also provides wintering grounds for the Greater Sandhill Crane which is a State threatened species. The current estimate of breeding pairs is approximately 200. ApproximatF;ly 70 to 80% of these pairs are on private lands. The use of this site for dog kennels could effectively eliminate this 40 acres as habitat for the Sandhill Cranes. Comments from the Department of Fish and Game have not yet been received to 'determine whether or not this habitat loss will be significant. 61a: Some noise is currently generated on site. This nt,ise comes the agricultural activities that take place and is limited to the planting and harvesting of the rice crop. The use of the site for a dog kennel will introduce year round noise to the project site. The kennels will be located at least 500 feet away from the one and only residence in the area. Due to the large surrounding parcel sizes and the fact that the project is surrounded on three sides by the State Game Refuge, the noise issue is not expected to be significant. 1 : There will be some additional traffic genera('ed by this project. Patrons will bring their dogs to this facility for training and leave them for extended periods. At the most, one or two additional vehicle trips per day could', be expected as a result of the dog training kennel operation.
