The Commission waived the reading' of the Staff Findings. { Staff commented that the issue before the Commission is the,1 variance not the legality of the parcel. Staff said Mh e provisions for determining whether or not a parcel is "legal" is' the responsibility of the Advisory' Agency ansa/or the Board of Supervisors Commissioner Lynch asked if the variance is approved it would not necessarily mean the parcel is a legal lot? Staff said this is correct. Staff said the Advisory Agency, in determining a parcel` to be a legal lot, would have to find that the parcel was created prior' to the time of the zonixig being imposed, then in that case a' variance would not, be needed. Chairman Lambert asked about the timing of when this parcel was created having an effect on the zoning. Staff said this would be a zoning violation. The nearing was opened to the public. I Chris Dewsnup said :the purchased the property 2 yearn ago. He said the property was transferred with a gift deed. He said there is a problem with building a house on the property. He said there are other small parcels in the vicinity that can develop;. He said he has a piece of property that he can not live on or build on. He said the gift deed was recorded 8 months after the rezone was effective. He thought because the gift deed was granted, that the parcel could be built on. He said no one was notified that they could not build on the parcel. He said in 1986 there was a 1.3 acre parcel created 'across the street through the aq. segregation ordinance procedure. He said he would lik,c, to build on his property. He said the area is developing._ Commissioner Ostrowski asked if the land was vacarit and Mr. Dewsr�up said yes. He said he was willing to do whatever it takes to be able to build on this property. The hearing was closed. Chairman Lambert said she sympathizes with Mr. Dewsnup, but she could not make the necessary findings to grant a variance. She asked staff if a Certificate of Compliance goes through the, Advisory Agency and staff said yes. The A-40 zone vias; adopted on June 29, 1982, This parcel was created by gift deed iii 1983 from Daniel. Hendrix etal to Melvin Dewsnup. The gift deed did not create a legal parcel due to the zoning requirement of 40 acres. Apparently, Melvin Dewsnup never tried to develop the property and in 3.988 sold it to his brother. Chris Dewsnup. Chris applied for a building permit for a single family dwelling and at that time Learned the parcel was not legal. Where may be some question as to the validity of the :original gift deed and the subsequent sale of the property. Melvin Dewsnup and Daniel Hendrix are not related. if there was any consideration given in exchange for the parcel, including labor, the gift deed could not be 'considered valid. In addition, any parcel created for sale, lease or finance is subject to the requirements of the Subdivision Map Act Since this parcel has been sold, the Subdivision Map Act may be applicable. This parcel is located approximately 3 miles southwest of Gridley. The area is a mixture of, agricultural, and residential uses There are 10 parcels less than 1.5 acres within 1/'4 raile of this project. The average parcel. size within 1/4 mile is 6.6 acres. All of these smaller lots were created prior to the adoption of the A-40 zone except one which was created by homesite segregation in 1985, There doesnot appear to be any special circumstances to the property, including size, shape, topography, location, or surrounding that deprives this property of privileges enjoyed by other property owners in the vicinity and under identical zoning classifications, RECOMMENDATIONS A.
