August 2,6,, 1985 This is a proposal to divide 1.05 acre homesite from 14 acre parcel. The present zoning is A-40. The Land Use Plan Map of the General Plan designates this area as Orchard. and Field Crops. There are n5 specific or community plans for the area. The proposal does not conflict with County zoning nor any adopted or proposed element of the Butte County General Plan nor any County, specific or community plan. A drainage fee will not be assessed at this time. In order to do the County must first adopt a drainage study and fee schedule. A Use Permit was approv,,4d on June 16, 1983 by the Planning Commission to segregate the I acile homesite From the balance of the property. Validation of the Use Permit did not occur, until April 15, 1985. A Negative Declaration regarding environmental impact was adopted by the Planning Commisizion for 'the Use Permit application. The same environmental determination is recommended for action by the Advisory hgency on the Tentative Parcel Map. INFOE A!_1_Q1! 1. The SuttQ Count), Fire Department did not have any requirements for water supply or fire proteebion requirements for this parcel map. 2. Reclamation District #2056 expressed concerns about increased drainage resulting from the land division. Since Parcel 2 is restricted from residential development for '10 years unless rezoned, there will be no net increase in drainage as a result of this land division in the short-term. If the'County can legitimately collect a drainage fee for this land division, we would recommend that a proportionate share be assessed to this applicant to enlarge and improve facilities of Reclamation District #2056. This matter will be further discussed in the forthcoming Planning Director's report. Refer to -(-,he attached comment sheet. 8. Revisions to the homesite segregation ordinance are currently being considered.
