Oroville, CA 95965 RE: Application for permit to install mobile home; AP -21=17-39 Dear Mr. Sweet: We are writing this letter on behalf of Mrs. W. D. Ingram, owner of the subject parcel. Mrs. Ingrain no longer resides on the property in question and has made arrangements with Mr. and Mrs. Martin Ellis for them to reside on the premises as caretakers. Mrs. Ingram does not intend to charge the Ellises any rent. Mr. Ellis has assisted in the application for and processing of the permit. It is our understanding that your department has withheld issuance of the permit because of your question whether the parcel in question was legally created. It has apparently been suggested that if the parcel was not.legally created that application should be made for a certificate of compliance or a parcel map should be filed. Apparently, the position tentatively reached was that the parcel in question was created by the grant deed from Mr. and Mrs. Ingram to Mr. and Mrs. Dewsnup, dated January 30, 1964, and recorded on February 19; 1964, at Book 1297, page 289, and that the division.was'therefore subject to the provisions of Ordinance 772. It is our position, however, that the parcel in question was created prior to the effective date of Ordinance 772 and is not subject to its provision's., It is our intent in writing this letter to describe the circumstances.of the actual creation of the parcel and to urge issuance of the permit, without the necessity of a certi- fi.cate of compliance. The parcels now designated as 21-17-38, -39, -40 were originally purchased by Mr. and Mrs Ingram in the 1940's and were farmed as one unit. There was a residence on the property, which had been originally.constructed in the 1860's, and various outbuildings. The drainage ditch of District No. 2056 cut through the property at that time and formed a portion of the southern boundary of the property. The Ingrams resided on the property continuously from 1951. A new house was built on the property Department of Public Works September 24, 1974 Page 2 in about 1963. Upon its completion, the Ingrams moved into it and the old house was partially dismantled, with portions being retained for storage purposes. Mr. Ingram died in 1971. Mrs. Ingram continued to reside on the property until August; 1972, and then moved. Shortly after she moved, the newer house was destroyed by a fire. When the Ingrams first purchased the property, the acreage was devoted primarily to permanent pasture, alfalfa and vetch, with certain areas undeveloped. The Ingrams were involved in a dairy operation and had a number of outbuildings used in connection with their dairy herd. In 1951 the Aagrffs sold their dairy interests and in 1962 they leased what is now AP -21-17-40a o Junior and Beatrice Dewsnup. We have been unable to obtain a copy of this lease. However, we have discussed it with Mrs. Ingram, her son, John Ingram, and with Mrs. Dewsnup. (Both W. D. Ingram and Junior Dewsnup are now deceased.) Mrs. Ingram and John Ingram indicate that the lease was written but was not recorded. Mrs. Dewsnup tells us she has financial records showing existence of the lease in 1962. We have also discussed the matter with Mr. Farris of Libby; McNeill & Libby in Gridley. Mr. Farris tells us Libby's records indicate existence of a pumpkin contract between Libby' -s and the Dewsnups in 1962 and states he believes the contract related to the Ingram property. Both Mrs. Ingram and Mrs. Dewsnup recall the existence of the pumpkin contract and use of the land for growing pumpkins. The existence of the pumpkin contract corroborates existence of the lease between the Ingrams and the Dewsnups since, without the lease, the Dewsnups would have been unable to enter the pumpkin contract relating to the property. It would appear that execution of the Ingram-Dewsnup lease created the parcel now referred to as AP -21-17-39. The boundaries of this parcel coincide with the boundaries of the parcel retained by the Ingrams for their own use. The south and east boundaries of the parcel. -retained coincided with the existing ditch line. The north line of the parcel retained was defined in a manner to recognize the boundary of the existing cultivated area to the north. There was a small uncultivated strip between this area and the barn. The cultivated area was, at that time, in pasture. This cultivated area is now in peaches. The barn has now been torn down, but the concrete foundation is still plainly visible. The west boundary of the parcel retained by the Ingrams coincides with the present west boundary of AP -21-17-39 and was drawn in a manner to recognize the existence of the barn and a concrete run extending in a north and south direction west of the barn and.west of the old calves' barn. The concrete run is still plainly visible and the calves' barn is still partially standing. The area west of the parcel retained was largely undeveloped, being unlevel and with native oak trees. However, this area was used by the Dewsnups for parking and servicing of equipment. The area south of the Ingrams' residence on the parcel retained was apparently uncultivated at the time of the lease and had not yet been leveled. . . ,: Department of Public Works September 24, 1974 Page 3 Thus, while we have not been able to obtain a copy of the actual lease, it appears that the parcel now referred to as AP -21-17-39 was created in 1962 when this property was retained by the Ingrams for their use and the balance of their properties, now known as AP -21-1.7-38 and -40 was leased to the Dewsnups. Under these circumstances, Ordinance 772, which was not enacted until 1963, would not be applicable. We recognize, however, that Ordinance No. 557 may be applicable. If you conclude that Ordinance No. 557 is applicable, then the prerequisite for issuance of a permit relating to AP -21-17-39 would be compliance with County Code Section 20-41(B). Actual access to the parcel in question is not a problem as there is an existing graveled road leading from the county road along the south boundary of AP -21-17-38 crossing the drainage ditch and entering the parcel.
