Last Saturday, at 5:50 A.M., one of his customers came to get his tractor. They have to drive thru our property to get to his business so needless to say the rude customer woke us up. I don't know how you feel about being woke up that early on your day off after working all week, but we feel it is ' \ inconsiderate and urmecessary to have customers run in and out all hours of the day and evenings including weekends. It doesn't matter that his shop door is closed, they still run in and out. Sunday his customers were picking up their semi trucks and running in and out to pick up their vehicles he had worked on. He wasn't even home. It wasn't just this last Sunday either. It has happened on other Sundays as well. He allows his customers to bring and pick up their trucks, vehicles, semi's and whatever else he has worked on all hours of the day and evening -7 days a week. He has no set business hours. About three and a half months ago, we called in another complaint because I saw one of his customers destroying part of our cement sidewall. The idiot was driving an 18 wheeler and couldn't figure out how to turn down the narrow road. It doesn't seem that the complaint was taken very seriously because we have more semi's and 18 wheelers running up and down the road than ever. It's like a truck stop. We called the Highway patrol because it was considered a vehicle accident with property damage. He came to our house and we showed him the damage that the 18 wheeler had caused. We asked hum if he would go down and get the customers name so we could make him fix our property. The officer said that because I didn't see the driver, but did see the truck damage the property, that McMillan or the driver would probably he and say it was someone else. So now every time a semi goes in or out we have to check to make sure that they haven't destroyed our property, get a description of the driver and the license plate of the truck. On another day an 18 wheeler decided he would use our property that is not on the easement to turn around. After he left we went out to make sure it didn't destroy or nun over any of our bushes and trees. If McMillan doesn't have enough room for these 18 wheelers to turn around on his property, then why are they allowed to go down a narrow road and use our property to turn around? Besides the fact that are destroying the road and making huge chug holes in it. Would you want to deal with this situation everyday? As time goes on this situation gets worse. It isn't fair that we should have to put up with this. We built our dream house and because of this we are seriously considering moving. How would you feel if you were in our shoes? As long as he has no one monitoring him or has no rules or regulations to follow, he will continue to take on new customers and do whatever lie wants to do. They will continue to come and go at anytime as they please because he has obviously no set business hours and we will be forced to continue to file complaints. His customers are rude and inconsiderate and it doesn't matter to any of them that they are driving and speeding down someone else's property and stirring up dust. When you have asthma it isn't a fun experience. How much more is he going to be allowed to get away with? We are at the point that we are considering hiring a lawyer. Wouldn't Evans Reimer Road be a better access road for his business? But that would cost hien money because he would have to build some kind of bridge over the ditch and we know he won't spend any money doing something that he doesn't have to do. This situation is getting old and very frustrating. Please do something about this. I am sure you are tired of the complaints, but something needs to be done to rectify this situation. The complain is against McMillen Ag & Air, 519 Jericho Court, Gridley. He has a business that. is behind our house, The road to get to his property or his business is on our property, so therefore his customers have to go through our property on a small gravel road to get to his business. In previous complaints, you will note that this area is not zoned commercial. As usual, his customers continue to be inconsiderate and bring their vehicles, semi -trucks, tractors, taco wagons, Amerigas trucks, Haro distributing trucks, trucks that haul rock, 18 -wheelers. Etc., (I am sure you get my point) in at inappropriate times. Last week, 2 noisy semi- s came in at 8:20 and 8:30 on a Friday evening. Now after working all day that is the last thing someone wants to deal with ,is their house shaking and rambling from the semi's going up and down the road. Evenings are for relaxing, not putting up with McMillen's rude customers bringing in crap to be worked on. The other night we were awakened by yet another noisy semi -truck coming down the road at 10:20 in the evening. That is totally ridiculous. Our home is supposed to be our place to get away from everything. But instead we come home to this every night. His business is opened 6 days_ a week, but his customers are in and out in Sundays too. The McMillens aren't even home on Sundays. He obviously doesn't have control of his business or his customers. So there is no peace and quiet. Many times his shop doors did not close until 7:30 p.m. Even if his shop doors are closed, they still bring stuff to be worked on. They bring tractors and other equipment in as early as 6:00 in the morning. His business is operating 10 to 12 hours a day. Why should we have to put up with this situation? There wasn't a business there 8 years ago when we bought the property. The McMillens had just returned from the Fiji Islands after being gone for ten years, so how is it possible that his business is legal. We even know the people that, stayed in their mobile home while they were gone. Our neighbors also state that there wasn't a business there in 1982 or whenever the law changed. He does whatever he wants when his customers want it done. Many times there are so many vehicles, that he has to park them in his orchard, on the easement or where ever he can. By having his business on his property, he doesn't have to worry about rules and regulations and certainly doesn't have to pay all of the fees involved if he were in a commercially zoned area. If his business were in a properly zoned area, code enforcement would not allow this stuff to go on. His business is getting bigger by the day and now has become a truck stop. They have torn up the road that we are responsible for and caused damage to our property. Nobody wants to do anything about it. We are trying to move, but this was our dream home and it is hard to find something this nice. This business is decreasing the value of our home. Not only do we have to put up with him and his customers, he has a family that lives in a trailer on his property. It is not fair. His customer's speed down the gravel road like it's a racetrack, stirring up dust. We have had a 5 -mile an hour sign posted on our property, but obviously they can't read As I have previously stated, I have asthma and that does not help matters at all. This situation is a health issue. Besides making us miserable it has raised our blood pressure. As long as it doesn't affect them, they don't care. PLEASE, PLEASE do something about this situation. It is out of control and needs a solution. Make him put a road on his own property off of Evans Reimer or better yet, make him move to a properly zoned area. Thank you. I realize that you are busy and so I thought it would be easier to put it in writing. Also with my work schedule at the school, I didn't know if there would be an actual time when we would be able to speak. Anyway, this complaint is against McMillan's Ag and Air, S 19 Jericho Court in Gridley. It is a business ran from his house. The road, in which his customers have to use to get to his business, is on our property. We realize that there is an easement, but if he is going to be allowed to operate this business in a non-commercial area, he should have to follow the guidelines that every businessman has to follow and not be an inconsiderate person. About a month ago, on a Sunday, one of his customers brought over a bank -out wagon on a trailer. He blocked the road off where people had to turn around and then left the bank -out across from our driveway. He didn't even take it down to McMillan's property where it was to be worked on which, was another 300 feet down the road. Last week on Wednesday, November 10, his employee decided to work on a four wheeler at 5:00 pm. The problem was the he didn't work on it in the shop, he decided to work on it on the easement road right behind our house. We had got home from work and listened to him revving up the motorcycle for 30 minutes. My husband finally went outside to see where he was because it was so loud. When the employee saw my husband, he drove the motorcycle back to the shop and left. He knew my husband was angry. Friday of the same week, McMillan's shop was open at 8:00 a.m. and still open at 8:30 p.m. We don't think he should be allowed to have his business opened 12 1/2 hours a day. We put up with this crap all of the time. Because he is not being monitored, he does exactly what he wants and doesn't seem to care whom it affects. I guess we could call the sheriff, but since it is not an emergency, I doubt they would show. We are asking you to do something about this. Look at his books, you'll see that his business has expanded and that he gets new customers all of the time. How much should we have to put up with before he is made to move his business into a commercially zoned area or made to put the road for his customers on his own property. We can't enjoy our home and we are tired of his inconsiderate customers and employee that he has no control of. Help us please!
