5 (Agricultural - 5 acre parcels) located at the southeast corner of French Avenue and West
Liberty Road, identified as AP 021-.320-018, Gridley,
The Commissionwaived the reading of the. Staff Findings and a video of the project site was
shown.
Commissioner Lynch suggested the Commission add to Condition 1 to include "and their children"
as discussed in the staff report.
The hearing was opened to the public.
Mr. TeStroete said the request is for himself, his wife, and their three children. He had no
problems with the conditions:

Commissioner Lynch asked if a new Use Permit has to be obtained if one member of the family
dies or moves' away'%
Staff-said'a new Use Permit is required only with a. change of occupancy, Staff said that if one
member of the family dies or moves away it would not trigger anew Use I"ex'mit application.
It was moved by 'Commissioner Lynch, seconded by Commissioner Ostrowski, and unanimously
carried for approval as follows:
A. Note that this project is categorically exempt from environxnental review; and
B. Find that this proposed use of the property will not impar the integrity and character of
the zone in which the land lies and that the use would not be unreasonably incompatible
with, or injurious to surrounding properties or detrimental to the health and general welfare
of the persons residing or working in the neighborhood or to the general health, welfare and
safety of the County because it fully complies with the Tentative Mobile Home provision
of the Code Section 24-304; and
C. Approve the Use Permit to allow a temporary mobile home as a second dwelling on AP
0217320-018 (Mark TeStroete) subject to the following conditions:
1. Occupancy of the mobile home is limited to Mark and Deborah TeS�oete and their
children.,
2. r' No rent' is to be charged to the occupant of the mobile home. -

Meet the requirements of the Butte County Environmental Health Department for
domestic 'Water supply, and sewage disposal.
4.
The mobile home is to be a temporary use on theI property pursuant to the
requirements of. Section 24-304 of the Butte County Code.
5.
llie Use Permit shall expire two years from the date of issuance of the Use Permit.
Upon application, the Planning Commission may grant an extension of the Use
Permit not exceeding one year.
6.
In the event that the applicant who is residing within the mobile home or the -
conventional residence, for any reason, moves to another location or is deceased,
then in that event, the Use Permit granted herein shall automatically expire and the
mobile home shall be removed within one hundred twenty (120) days. In the event
the mobile home is not removed within one hundred twenty (120) days pursuant to
the terms of the Use Permit, the County shall remove the mobile home and store
it at the owner's expense.
7.
The applicant is to pay a deposit or post a bond to cover the cost of removal in the
amount of $1;500.00 for a single -wide mobile or $2,000.00 for a double -wide mobile.
8.
Meet the requirements of the Building Division of the Butte County Department of
Public Works.

This is arequest for a Use Permit to allow a mobile home as a temporary second
dwelling, The project is located at the southeast corner of French Avenue and
Nest Liberty Road, west of Gridley.
The property- is owned by James and Lucy Osbourn who also live in the house on-
site. The mobile home will be occupied by their daughter, son-in-law, and 3
grand children. The proposed mobile home is a 1344 square , foot double -wide.
It will be located just south' of the existing garage in an existing grassy, area.

existing trees will have to be removed to accommodate the mobile home.
Butte County Code Section 24-304 provides for removal of the mobile home within
12Q days of the time that it is no longer being occupied pursuant to the code
ovision for the County requiring a bond ox
section. The Code also makes pr
deposit at the time of application of sufficient size to cover the removal
expense of the mobile home. This is to ensure that the taxpayers at large (via
the General Fund) are not charged those expenses should the County be forced to
remove the mobile home pursuant to the code. Of course, if the applicant
removes this mobile home " voluntarily, then the bond or deposit would' be
returned. Similarly, if the County removes the mobile home, then only charges
actually incurred would be reimbursed from the bond or deposit with the
remainder being returned to the applicant. A, survey of several mobile home
t' : alerships in Butte. County has indicated a rather wide range of estimated costs
of removal. Cost, of course, would vary due to installation of landscaping,
decks, awnings, and physical site characteristics. Tasking the: median figures
and adding a small amount for administrative casts and storage costs, it appears
that a reasonable deposit would be $1,500 per single -wide and $2,000 for a
double -wide mobilo home. These amounts seem reasonable to ensure that the
mobile home is removed at no cost to the County or the taxpayers. The applicant
proposes to place a double -wide mobile home on the property. (Video taken)

accordance with the procedures set forth in the Butte County'
Zoning Enabling Ordinance,
2� Unless otherwise provided for in a condition to a use permit,
all conditions must be completed by the permittee within 12
months of the delivery of the countersigned permit to the
permittee,
3. If any use for which a use permit has been granted is not
established within one year of the date of receipt of the
countersigned permit by the permittee, the permit shall be
came null and void and reapplication shall be required to
establish the use.
SPECIAL CONDITIONS:

l.. Occupancy of the mobile home is limited to Mark and Deborah
TeStroete and their children.
2• No rent is to be charged to the occupant of the mobile home.
3. Deet the' requirements of the Butte County Environmental Health
P for domestic water supply and sewage disposal.
4• The mobile home is to be a, temporary use on the property pursuant to
the requirements of Section 24-304 of the Butte, County Code

5. The Use Permit shall expire two years from the date of issuance of
the Use Permit. Upon application, the Planning Commission may grant
an extension of the Use Permit pot exceeding one year.
6. In the event that the applicant who is residing within the mobile
home or the conventional residence, for any reason, moves to another
location or is deceased„ then in that event, the Use Permit granted
herein shall automatically expire and the mobile home shall be
removed within one hundred twenty (120) days. In the event the
mobile home ' is not removed within one hundred twenty (120) days
pursuant to the terms of the Use Permit, the County shall remove the
mobile home and store it at the owner'sexpense.
%. The applicant is to,, pay a deposit or post a bond to cover the cost o£
removal in the amount of $1,500.00 for a single -wide mobile or
$2,000.00 for a double -wide mobile.
8. Meet the requirements of the Building Division of the Butte County
Department of Public Works.
9. Applicant must also comply with all other appy cable State and local
statutes, ordinances, and regulations.
I hereby declare under penalty of perjury that I have read the
foregoing conditions, that they are in fact the conditions which were
imposed upon the granting of this usepermit, and. that I agree to abide
fully by said conditions.

At the regular meeting of, the Butte County Planning Commission held
April 12, 1990, your request for a Use Permit to allow a mobile home as a
temporary second dwelling on property zoned. A-5 located at the

approved subject to the following conditions:
