Per your request (Legal Services Request # 03-185), if the Wildlife Conservation Board (WCB)'s consultant, West Yost,
has filed an application with your office prior to the effective date of Ordinance 3849 (amending Chapter 26), which I
believe would have been 5/23/03, then WCB would only be required to comply with the provisions of Chapter 26 which
were in effect on the date of the application, and would not be required to comply with the provisions of Ordinance 3849.

3309.8 Regular Grading Requirements. Each application for
a grading permit shall be accompanied by a plan in sufficient clar-
ity to indicate the nature and extent of the work. The plans shall
give the Iodation of the work, the name of the owner and the name
of the person who prepared the plan. The plan shall include the fol-
lowing information:
1. General vicinity of the proposed site.
2. Limiting dimensions and depth of cut and fill.
3. Location of any buildings or structures where work is to be
performed, and the location of any buildings or structures within
15 feet (4572 mm) of the proposed grading.
3309.9 Issuance. The provisions of Section 106.4 are applicable
to grading permits. The building official may require that grading
operations and project designs be modified if delays occur which
incur weather -generated problems not considered at the time the

SECTION 3310 - GRADING FEES
3310.1 General. Fees shall be assessed in accordance with the
provisions of this section or shall be as set forth in the fee schedule
adopted by the jurisdiction.
3310.2 Plan Review Fees. When a plan or other data are re-
quired to be submitted, a plan review fee shall be paid at the time of
submitting plans and specifications for review. Said plan review
fee shall be as set forth in Table A -33-A. Separate plan review fees
shall apply to retaining walls or major drainage structures as re-
quired elsewhere in this code. For excavation and fill on the same
site, the fee shall be based on the volume of excavation or fill,
whichever is greater.

We reviewed the proposed plan for the conversion of Little Dry Creek Farms into wildlife habitat
with you at a meeting on March 27, 2003. As we discussed at that time, the project involves
significant grading to convert the rice field flood irrigation system into a system to maintain
natural habitat. We have put significant effort into determining the flooding conditions for the
project area, and insuring that the proposed conversion project does not adversely impact the
current situation. This has included meetings with neighboring property owners, obtaining
anecdotal flooding information, and surveying tie-ins to establish flood elevations. It was our
understanding at that meeting that because Butte County (County) is in a transition period
regarding how to deal with this type of project, you would be consulting with others in the county
to give us direction on how to proceed.
Based on our telephone conversation with you this morning, it is our current understanding that
the project will not likely require a grading permit. However, because it is in the flood plain, the
project must comply with the County ordinance which requires that the grading not adversely
affect floodwater depth on Afton Road or the surrounding properties. A description of how the
project grading will comply with the provisions of the county ordinance follows.
Existing Flooding Patterns
Currently floodwaters flow through the site from two directions. Floodwater from the Sacramento
River to the south raises the hydraulic grade line in all the area tributaries and water backs up
across the site flowing to the north and east. Local storms can also cause Little Dry Creek to
overflow, prior to surcharging of floodwater from the Sacramento River, and these flood waters
can flow to the south and west across the property.

Proposed Grading
The grade of the road on the property adjacent to Little Dry Creek will not be raised or lowered,
and therefore will not change flooding patterns through the project site. Two north -south and two
east -west levees will be constructed through the site. The central section of the north -south levees
will be constructed at an elevation lower than any other levees on the site to allow a very large
path for floodwaters to flow through the site. The elevation of these levees will be approximately
one to two feet above existing ground, and will be lower than the road adjacent to Little Dry
Creek. Because we are providing a flow path through the site for floodwaters, created by both
surcharging from the south and flooding from the north and east, the new levees should not
increase floodwater depth on Afton Road or the surrounding properties.

EXPIRATION OF APPLICATION
Applications for which a permit has not been issued will expire one year after date of application. In order to renew action on an
application after expiration, a new application, plans and fees will be required.
REQUEST FOR FEE REFUNDS
Refunds can only be made upon written request by the person who paid the fee. The request must be made within two years from the date
of fee payment on permits not issued, and two years from the date of permit issuance for permits issued; however, on issued permits
refunds can only be made if no construction work has been done. Filing fees, plan check fees for work plan checked and other department
