In the summer of 1971, August 26, 19'11, a Building Permit Was issued to Ed and. Lillian Meyer for the construction of their family, home t.tpon Parcel N4, 70. Attached as: Prior io the time that the Buildintr Permit was Exhibit f r, a legal description U1was prepared by Edgar St�r►ton, Licensed Civil Engineer and applied Surveyot of the State of California. Enclosed 8 Exhibit t 13 is a copy fr+�rrt. Edartboot. of 1/24/71.. You can see this is approximately ei�'ht months before, survey notes, page 39, dated the construction started and you will see that the legal description is for parL. I No. 70 Where the family home Was, in fact, constructed, in early 1972; before the house was completed, an agreement was entered into with the David and Carol Grein for the purchase of a portion of Parcel No. 84: A Parcel Map was prepared by Mr. Stanton. You will find it recorded at, Book 42 of Parcel Maps; page 4. That Parcel Map apparently wits filed in approximately May of 1572 as lite M8P was recorded at approximately �Y it p Clay that time and the notes and signatures b Castleberry and Edgar Stanton indicate preparation at that trm.. As you can see, the division of this property was commenced before the effective date of a requirement for the preparation of a Parcel Map in March '1972, and the parcel, in fact, predated the date of the Parcel Map because of the issuance of a Building Permit by the County (attached Exhibit "A.') 3. The creation of this parcel obviously predated the date of March 4, 1972 in that the deeds and description were prepared, the construction commenced and the only reason that the deed w.as not. recorded until after the dare of March 4, 1972, approximately ninety days thereafter, was apparently the delay in providing for the deed of reconveyance, 4. Each of the title companies involvedin the reconveyance and the sale to Grein treated the parcel as created legally. 5, As can be seen from the discussion of the issue in the CE13 California Subdivision Law, Pages 34 through 37, (copies of which are attached as Exhibit "D"), in good faith the parcels were created and the violation is technical only, a Certificate of Compliance should be issued since there is no abilit)T to compel merger in counties of the size of Butte County. Here, merger would accomplish nothing as the house has been constructed -and has existed and the parcels separated physically and by use for in excess of twenty years. We hereby request that a Certificate of Compliance be granted. This subject home and adjoining, orchard are subject to sales to Keith and Carol Anderson who will own both the home and the surrounding adjacent Parcel No. 84 walnut orchard, However, their financing requires separate there be upon the home and one from ;a different lender upon the thatwalnut orchard. deeds of trust -- one u This would appear to be an appropriate case for the issuance of a Certif cam of Cornpliance. A separate Certificate of Compliance isrequire�i for each parcel in light of the fact that there will be a separate loan upon the house and a separate low from a different lender upon the walnut orchard.
