The traffic is practically nil, Both ends of this 2 block street terminate on faxen land, With Highway 99 E running the same direatiori than half a mile away fail to see how there can ever. be �, need in the foreseeable future for the widening improve- ments as out lined in attached copy of the Use Permit. Not only that but in our block there are approach pattorns aftd flow patterns of a bounty drainage canal. The re- routing and replacement of this canal would be a night mare of --osts. Further to put a ',wridened roadway over and through this complex of canal, bridgt way and roadway ince: ?- section would be more than a nightmare engineering wise and costwise, it would be an impossibility. with a 4 foot water table predominate the whole structure would sink out of sight overnight. What would be the point of deeding a lot of land that would never be needed. About 2 years ago, maybe more or less,, I attended along with Mr Cole, a civil engineer of OroviLle, a Planning Commission meeting. Mr Cole explained at length all the ramifications Involved code wise and a-.1 that time the Chairman of the Planning Commission nulli.- fled the necessity of deeding to the county 30 foot right of way plus 20 'feet of radius return but allowed us to retain the right to have farm labor dwelling. I was surprised to see when a copy of the Use Permit re -appeared this time, that the Commissioner's ruling tha"u-(the-meeting attended with Mr Cole) had not been noted and recorded accordingly to the effect that the deeding of land was no longer a factor. I pointed this out to Mrs. Moseley. She said that the property in this area wov1d 5oon be zoned from A2 to A.5 and that WOU16 automatically liquidate the question of deeding, Could You Please reverse the process, turn the pages back in time, and re -write the whole sequence minus the deeding of land* There are a lot of rediculous features involved. In order to remove that condition from the use hermit now, it will be necessary to apply for a modification of the use permit pursuant to Butte County Code Section 24-48.4. This requires a filing fee of $419.00 and the same hearing process as before. this action may not be necessary note, due to the adoption of A-5 (Agricultural, 5 acre). zoning on your area. The A-5 zone lists, as a permitted use, housing facilities to accommodate agricultural workers If your development meets the requirements of the Butte County Building Depah'ltment, and the necessary affidavits are filed, then there would be no need to modify the use permit or even to continue with its provisions. If your property had been zoned A -S when you started in 1978, you would not have needed a use permit at all, but dealt with the Building Department instead.
