George Boeqer - Variance to minimum parcel �qize to allow a 4.12 acre parcel in an "A-40 (Agricultural) zone, on property located 1/2 mile west of Biggs - Gridley Road, 1 1/4 mile south of Farms Road, south Of Biggs, identified as All 22-21-54 Staff fil-4dings were read by Mr. Lawson. A Negative Declaration regarding Environmental Impact was filed on February 3, 1975 with the County Clerk and there were no appeals. STaff findings were read by Mr. Lawson. Proponents: George Booger, 3564 Boeger Lane, San Jose, Ca., spoke in favo,r of the variance, as did Mike BoOqer, 419 Randolph, Gridleyo both stating that it was their desire to separate the Property that had the rice dryer on it from the other lands because there was no longer any connection with the dryer operation and the land use of the sures rounding properties. They further stated that they desired to combine the balance of this 40 -acre parcel with surrounding family-owned land and plan to form a corporation. The hearing was closed and Commissioner Watson (999+56) made a motion for approval, stating that this variance would enable Parcel 1 to be added to surrounding agricultural land, whid" would enhance its agri- cultural use and add to the productivity of the area in the spirit of the zoning ordinance that Placed the A-40 zoning on the area. That statement was in error. The unmarked building shown on the map is a rice dryer, There is also a parts storage shed on the premises, but it is of such small consequence it was not pictured. Mr. Boeger's objective in obtaining the variance is to enable him to later fife a parcel map dividing the parcel into two smaller parcels as depicted on the map which we sent you. Parcel 2 is, of course, less than forty acres in size and; therefore, it is necessary to obtain the variance before the parcel map can be processed. The purpose in applying for the variance and later filing the parcel map is not to change the land use of either parcel. Both parcel 1 and parcel 2 have his- torically been used for agricultural purposes. The rice dryer was constructed on parcel 2 in 1951 and added to in 1952. The dryer has been used continuously since that time in connection with the Boeger family's agricultural operations and will be so used in the future. The Boegers' plan to file the parcel map will not change any of this but is simply part of a reorganization under which a family owned corporation will own proposed parcel 2. The corporate form of ownership will facilitate use of the dryer and other facilities on parcel 2 by the various family members.
