Staff noted a change on Page 7 paragraph 4, line 5 changing 11670 acres' to 1160 acres". The hearing was opened to the public. John Christofferson, GDA, said there. are serious constraints on the septic requirements and that is why they are requesting 2.3' acres for the homesite. The hearing was closed. Tt was moved by Commissioner Lynch, seconded by Commissioner Forbes, and unanimously carried for approval as follow$: I A. Find that the requirements of CEQA have been completed and, considered and adopt a negative declaration; and B. Find that the project complieswith Butte County Code Section 24-54 and 24-47 and the project will not impair the integrity and character of the zone in which the Land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County because it fits the code section relative to agricultural segregation and 2.3 acres are necessary because of the requirements of Environmental Health and the requirements setbacks from the 833 ditch; and C. :Approve the proposed Use Permit to allow the creation of a 2.3 acre homesite in an A-40 zone on: AP 22-21-76 (Louise Hinaman) subject to the following conditions: l: Parcels to be created pursuant to Chapter 20 of the I Butte County Code and Subdivision Map. i 2.
