('L) The Commission waived the reading of the Staff 'Findings. A video of the site was shown. Staff said Condition 4a should be changed to read, "The property is rezoned to any designation that 'allows densities consistent with the requested parcel sizes". Commissioner Lynch questioned the rewording proposed in Condition 4 being different from; the ,code, b sand the Commission can go beyond Commissioner Nelson and the Ordinance with conditions if necessary. Commissioner Lynch commented that changing' the zoning suggested conditionld be a emread, "The A-40 to A 160 would constitute a rezone. He sugg property is rezoned to higher density agricultural zone or residential zone". The hearing was c+pened to the public. e John Christofferson, GDA, said this is a 30 acre parcel in a 40 acre zone. Ike said th applicant wants to segregate the home and kiwi Plant from the total acreage. He said there is no problem with the suggested change to the condition. He submitted a letter from Mr. Wheeler in support of the project. Commissioner Lambert asked if the property were to be rezoned, what zoning would the aWicant needto accommodate this project? Mr, Christofferson said the Ordinance is written that the remaining agricultural land that is to be under covenant, must be equal to or greater than what the zone is. Commissioner Lambert said to use this method to subdivide agricultural land is against the original intent of the Segregation Ordinance. Mr. Christofferson said he does' not have a problem with the zone. He said there needs to be wording in the ordinance for consideration of parcels that are less acreage than the Izone so the variance process would not be necessary. Commissioner Lynch said the variance process allows each applicant to be considered on an 'individual basis. He said the reason for the segregation is to ' get financing to improve the property, and that this was clearly in conformance with the intent of the Code: It was moved by Commissioner Lynch, seconded by Commissioner Lambert, and unanimously carried for approval as follows: A. rind that the project is Categorically Exempt from the provisions of CEQA; and B. Find that there are special circumstances applicable to the property, including' size, shape, topography, location or surroundings that the strict application of this chapter deprives the property of privileges enjoyed by other property in the vicinity and under identical zoning classification, because it is dealing with existing structures in. the area and the area around it is in siunilar smaller parcels; and C. Approve the Variance fromm the minimum lot size requirements of Sections 24-54 (c2) and 24-81. of the Butte County Code on AP 024-080-079; and D. ZONING HISTORY Zoned A-40 on 6-29-82 by Ordinance #2296. SURROUNDING ZONING:' A-5, A.-10, and A-40. SURROUNDING LAND USE: Orchards and rural' residential homesites. SITE IEYIS'I'OR'; A Use Permit and Variance was approved by the Planning Commission on March 3,' 1983 for a segregation request on the ;same property. Since the property is less than the 40 acre minimum of the A-40 zone, a Variance from the minimum lot size is also requested. As stattid in the site history, a Use Permit and Variance was approved for a homesite segregation in 1983, but a map was never recorded. This proposal netts all of the required conditions of the segregation standards except that the existing parcel does not meet the parcel' area requirements of the A.-40 zone. Therefore, :if the findings for a. Variance can be inad,e, the Use Permit can be supported. The Planning Commission must also consider and make the findings listed in Section, 2.4-47 ('Use Permits - Criteria for Granting) of the Butte County Code when approving a segregation request. Since no new development will occ,'?,_r should this project be approved and no change' in the conditions or operations of the property are expected, the project will not impair the integrity and character of the zone or impact or be incompatible with surrounding` uses :and properties. There' are specific findings that must be made prior to granting a Variance from the terms of the'local zoning ordinance. These findings require evidence that special circumstances apply to the subject property that deprives the individual of privileges enjoyed by other property in the vicinity. Special circumstances that would justify granting a variance from the minimu n parcel" size would be physical constraints such as ,size, shape, topography, 'location or surroundings. The circumstances that exist for this request are that theparcel is a legal noxi - conforming lot and only one lot in the immediate vicinity of this property ,is over 40 acres in size, Surrounding parcels range from less than one (1) acre in size to 43 acres, but predominantly range between 5-20 acres.
