(Continued open from 7/9/86) Staff stated that there was a request from the applicant for a continuance. Staff ;suggested December 10, 1986 at 10:00 a.m. The hearing was opened to '.he public. John Christofferson, GDA, stated that there were three owners of this property, Mr. Fuller, Mr. Johnson, and Mr. Christopherson. He asked the Commission to act on the application and to not continue the matter. He stated that the other two owners, Mr. Fuller and Mr. Johnson, are out of state owners. Hr stated that Mr. Christopherson has been ill and not able to attend the meetings, John Christofferson did not see any advantage to contintng the. hear -ng. He stated that the reason for the segregation was to get rid �f tie trailer house with the well and septic. He stated that a portion of kiwis uould be included in the segregated parcel with a possible leasa' -.k for ti:e ltwis. Chairman Vercruse questioned if John Christrfferson and spoken with Dudley Christopherson. John stated that he had dealt through an agent because of Mr. Christopherson`s illness, Commissioner Lynch stated that he spoke :.o Mr. Christopherson, that morning, 8/13/86, and the applicant had requested the continuance. He stated that they want to sell the property and the bank is pushing for the segregation feeling that it would be easier to sell if the homesite was segregat- i Mr. Christopherson has not had an opportunity to talk 'to his partners. Commissioner Lynch stated that the Water District is responsible for the care of ,he banks of the canal, that they have the maintenance of the canal, but there is no mention of how many feet the easement is for the maintenance of the canal. Commissioner Lambert questioned if Mr. Christopherson was responsible for repairs to the banks? Commissioner Lynch stated that it depended on how bad the leakage was as to whether the District is going to do anything about it, probably if the canal was in danger. Commissioner Lynch stated that the area is becoming commercial and industrial in use right next to this property. He stated that the adjoining property was bought by the State for a freeway that is tabled at this time, but the property is still owned by the State. Commissioner Lambert stated that she would like to have the applicant present to answer tc stions.
