INSTRUCTIONS TO ADMINISTRATIVE PERMIT APPLICANTS
1. If applicant Is not the owner, written authorization by the owner or other proof of
agency must be submitted in order for the applicant to legally sign the application.
Application shall be considered void if not signed by the owner or legal agent.
2. All items on application shall be filled in as completely as possible. If an item is not
applicable, please indicate by the term "N/A".
3. It is important that the applicant supply an accurate description of the location of
the proposed project, including the following:
a. Assessor's parcel number(s) (from the tax bills or Assessor's maps).
b. Street addresses (if available).
C. Distances and directions to named streets, bodies of water or railroads.
4. Eighteen (18) copies of a detailed plot plan of adequate scale to clearly show
proposed buildings and `1provellients shall accompany and be made part of the
"Application for Adminis 've Use Permit. The plot plan should be no larger than
11" x 17", be folded to E 2" x 11", and shall include the following information:
a. A scaled drawing `-e parcpl(s) boundaries.
b. Location and dimens,ins of all existing and proposed improvements on
the property, including buildings, driveways, parking areas, wells, septic
tanks and leach fields.
C. Location and name of bordering streets, access roads, nearby crossroads,
streams, bodies of water and railroads.
d. North arrow and scale of drawing.
5, The "Application for Administrative Permit" is subject to review by County Staff
and approval by the Planning Director. Any special conditions of approval shall
be made a part of the approved "Administrative Permit" and shall be binding on
the applicant. The procedures for County action on Administrative permit
applications are stated in Chapter 24 of the Butte County Code.
6. In approving an Administrative Permit, the Planning Director may include such
conditions as are deemed reasonable and necessary under the circumstances to
preserve the integrity and character of the zone and to secure the general
purposes of the Buktte County General Plan and Chapter 24, of the Butte County
Code. In general, said conditions will be listed as standards in Chapter 24 for
each use. In unique situations additional conditions may be added so long as
they are reasonably related to the use for which the permit is requesflo.
7. Application fees as of�� _(date) are $ ' K001 . Fees may
be paid in cash or by check made payable to "Treasurer of Butte County"
8, Before submitting an Administrative Permit application, applicant is requested to
discuss with staff all questions about application requirements, County procedures,
zoning provisions and possible conditions of approval,
REGULATIONS FOR SENIOR CITIZEN DWfELLINIa UNITS
BUTTE COUNTY PLANNING DEPARTMENT
The following conditions shall be applicable to all Senior Citizen Dwelling Units as defined in section 24-202 of the
Butte County Code and located within the unincorporated area of '- County, ,'It is the applicants responsibility
to Insure that these conditions have been or can be met prior to plication for an Administrative PcVMW The
applicant shall be responsible for providing, as requested by the U,,unty, Information or proof of compliance with
the conditions.
(1) The lot or parcel on which the senior citizen dwelling unit is proposed contains an existing single-family dwElling
unit.
(2) The "living area", meaning the Interior habitable floor space area. of a dwelling unit Including basements and
attics, but not including a garage or any accessory structure, shall not exceed 1,200 square feet for a detached
senior citizen dwelling unit. The "living area" of an attached dwelling unit shall not exceed 640 squr;re feet or
30% of the existing single-family dwelling unit living area, whichever Is greater.
(3) The senior citizen dwelling unit Is Intended for the sole occupancy of one (1) adult 62 years of age or over or
two (2) adult persons, one of whom Is 62 years of age or over. An affidavit of compliance with the age
requirements of this section shall be recorded in the office of the Recorder prior to Issuance of building permits.
Said affidavit shall include•the legal description of the lot or parcel and shall constitute a covenant running with
the land, binding upon the original owners and their heirs, successors and assigns, limiting the occupancy of
the senior citizen dwelling unit to the conditions described in this section.
(4) The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel containing the unit is created
In compliance with the existing zoning and subdivision ordinances and the resulting density is In conformance
with the General Plan. .
(5) Two off-street parking spaces shall be provided for the senior citizen dwelling unit in addition to the parking
spaces required for the primary dwelling unit,
(6) Adequate sewer and water facilities shall be provided subject to the approval of the Environmental Health
Department.
(7) All site development standards as required by the zoning district in which the unit is located shall be met.
(8) The Senior Citizen Dwelling llnit shall be a conventionally constructed building or a mobile home that complies
with the National Manufactured Housing Construction and Safety Standards Act of 1974, except that in the "A",
"FR", and 'TM" series of zones a mobile home, as defined in Section 24-21.28, may be used. Travel trailers and
recreational vehicles shall not be allowed as a Senior "Mizen Dwelling unit.
(9) The approval of this permit constitutes approval only to the extent that the project complies with the Butte
County Code and all other applicable regulations.
(10) Any proposed grading which will create cuts or fills in excess of 18" for roads, driveways, building sites,
drainage ways or ditches on parcels shall be shown on the map included with the application and shall be
reviewed and approved by the Department of Public Works.
(11) The requirements of all concerned governmental agencies having jurisdiction by law, including but not limited
to the Issuance of appropriate permits, shall be met.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Aaron D. Pugsley is hereby granted an Administrative Permit in
accordance with application filed: July 13, 1992 to allow a permanent dwelling no larger than
1,200 square foot for 1 or 2 persons over 62 years old on property zoned A-5, located at 52 W.
Evans Reimer Road, Gridley.
1. Failure to comply with the conditions specified herein as the basis for approval
of application and issuance of Permit, constitutes cause for the revocation of said
permit in accordance with the procedures set forth in the Butte County Zoning
Ordinance, including Butte County Code Section 24-62.
2. Unless otherwise provided for in a condition to an Administrative Permit, all
conditions must be completed by the permittee within 12 months of the delivery
of the countersigned permit to the permittee.
3. If any use for which an Administrative Permit has been granted is not established
within one year of the date of receipt of the countersigned permit by the
permittee, the permit shall be come null and void and reapplication shall be
required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns of
the Permittee.
SPECIAL CONDITIONS:
1. The living area, meaning the interior habitable floor space area of a dwelling -unit
including habitable basements and attics, but not including a garage or any accessory
structure, shall not exceed 1,200 square, feet.
2. The senior citizen dwelling unit shall be for the sole occupancy of one (1) adult 62 years
of age or over or two (2) adult persons, one of whom, is 62 years of age or over. An
affidavit of compliance with the age requirements of this ,section shall be recorded in the
office of the Recorder prior to issuance of building permits. Said affidavit shall include
the legal description of the lot or parcel and shall constitute a covenant ruining with the
land, binding upon the original owners and their heirs, successors and assigns, limiting

the occupancy of the senior citizen dwelling unit to the conditions described in this
section.
3. The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel
containing the unit is created in compliance with the existing zoning and subdivision
ordinances and the resulting density is in conformance with the General Plan.
4. Two off-street parking spaces shall be provided for the senior citizen dwelling unit in
addition to the parking spaces required for the primary dwelling unit.
5. Adequate sewer and water facilities shall be provided subject to the approval of the
Environmental Health Department.
6. All site development standards as required by the zoning district in which the unit is
located shall be met.
7. The Senior Citizen Dwelling unit shall be a conventionally constructed building or a
mobile home that complies with the National Manufactured Housing Construction and
Safety Standards Act of 1974, except that in the "A", "FR", and "TM" series of zones a
mobile home, as defined in Section 2421.28, may be used. Travel trailers and
recreational vehicles shall not be allowed as a Senior Citizen Dwelling Unit.
8. The approval of this permit constitutes approval only to the extent that the project

9. The ,..iuirements of all concerned governmental agencies having jurisdiction by law,
including, but not limited to the issuance of appropriate permits, shall be met.

you must do so in writing with the appeal fee of $290.00, to the Planning Department,

1992. If you do not appeal and if there are no other appeal within the 8 -day appeal
period, your Administrative Permit will be issued after September 1, 1992
Recently enacted legislation (AB 3158, Chapter 1706, Statutes of 1990, effective January
1, 1991) requ-res that the Department of Fish and Game impose and collect filing fees
as specified to defray the cost of managing and protecting fish and wildlife trust
resources. These filing fees are collected during the environmental review process and
are to be paid at the time the County files a "Notice of Exemption" with the Cointy
Clerk pursuant to Section 21.152 of the Public Resources Code.
To increase administrative efficiency, the statute delegated the collection of filing fees
to the County Clerk and provided the County authority to collect a $25.00 documentary
handling fee. The fee due for your project is $25.00. A checks made payable to the
Butte County Treasurer should be submitted to this department by September 4, 1992.
Project applicants should be aware Section 21089(b) of the Fu'olic Resources Code,
provides that any project approved under CEQA is not operative, vested, or final until
the filing fees required under Section 711.4 of the Fish and Game Code are paid:
Enclosed is the affidavit form you are required to fill out, sign and notarize, and return
it to the Planning Department prior to the end of the 8 -day appeal period. The Butte
County Code provides that your affidavit is valid for a term of one year and ;must be
renewed annually if the use is to continue.

This is a reque-.t for an Administrative Permit to allow a detached Senior Citizen Dwelling
Unit c 1 a 2.11 acre parcel located at 52 W. Evans Reimers Road, west of Gridley. The
parcel is zoned A-5. The applicant proposes to construct a 1034 square foot second
dwelli ,g unit vAjacent to an existing agricultural building. The site m.zets all setback
requir,.,ments for the zone, is level and will not require significant earth work. The main
hose w q the pa --cel is currently under construction. Since a dwelli. g must be developed with
a nw,.Iling be ore a senior citizen dwelling can be constructed, this permit should be
conditioned to require the main house to hav a final building permit before the second
dwelling. The project appears to meet all of the conditions required for a Senior Citizen

(2) The "living area', meaning the interior habitable floor space area of a dwelling unit
including basements and attics, but not including a garage or any accessory ;structure,
shall not exceed 1,200 square feet.
(3) The senior citizen dwelling unit is intended for the sole occupancy of one (1) adult
62 ycars of age or over or two (2) adult persons, one of whom is 62 years of age or
over. An affidavit of compliance with the age requirements of this section. shall be
recorded in the office of the Recorder prior to issuance of building permits. Said
affidavit shall include the legal description of the lot or parcel and shah constitute
a covenant running with the land, binding upon the original owners and their heirs,
successors and assigns, limiting the occupancy of the senior citizen dwelling unit to
the conditions described in this section.
(4) The senior citizen dwelling unit shall not be sold as a separate unit unless a parcel
containing the unit is ereateu in compliance with the existing zoning and subdivision
ordinances and the resulting density is in conformance v„th the General Plan. .
(5) Two off-street parking spaces shall be provided for the senior citizen dwelling unit
in addition to the parking spaces required for the primary dwelling unit.
(6) AdegLute sewer and water facilities shall be provided subject to the approval of the
Environmental Health Department.
(7) All site development standards as required by the zoning district in which the unit
is located shail be met.
(8) The Senior Citizen Dwelling unit sham be a conventionally constructed building or
a mobile home that complies with the National Manufactured Housing Construction
and Safety Standards Act of 1974, except that in the "A", "FR", and "TM" series of
zones a mobile home, as defined in Section 24-2128, may be used. Travel trailers
and recreational vehicles shall not be allowed as a Senior Citizen Dwelling unit.
(9) The approval, of this permit constitutes approval only to the extent that the project
complies with the Butte County Code and all other applicable regulations.
(10) The requirements of all concerned governmental agencies having jurisdiction by law,
including but not limited to the issuance of appropriate permits, shall be met.

installed on permanent foundation systems.
Please follow the guide carefully and fill out all of HCD Form 433(A) except
for the five lines concerning local agency and permit number which we will
complete.
When applying for the required Butte County building permits, return the
completed HCD Form 433(A) to us together with all other applicable items
as listed on the user guide.

USER GUID FOR INSTALLING MANUFACTURED HOMES, MOdILEHOMES
AND COhIMERCIAL COACHES ON FOUNDATION SYSTEMS
A. Prior to installation of the manufactured home, mobilehome, or commercial
coach on a foundation system, a building permit to construct the foundation
system and install the unit must be obtained from the local building
department. To apply for the permit the owner or contractor must comply
with certain provisions of Section 185:1 Health and Safety ^ide (H & SC) as
follows:
1. Provide evidence that the registered owner of the unit to be placed on
a foundation system either holds title or is purchasing the real
property on which the installation is to be made or holds a transferable
lease on the property with a term of 35 years or more. If the term of
the lease is for less than 35 years, the term must be iiwtually agreed
to by the lessor and lessee and may not be revocable by the lessor,
except for cause.
2. Provide written evidence that registered owner owns the unit free of
any liens or if there is a lienholder(s), that lienholder(s) has
consented to the placement of the unit on a foundation system.
3. Provide plans and specifications required by HCD regulations.
4. Provide the approved manufacturers installation instruct,'ons or plans
and specifications signed by a California licensed architect or
engineer covering the installation of the unit.
S. Pay building permit fees as required by the local jurisdiction issuing
the building permit.
6. Complete an original and three copies of the form HCD 433(A) (See
Appendix B) with all information available at the time the building
permit is issued.
7. Pay a state fee of $11 per transportable section.
B. After the installation is completed and before a certificate of occupancy
is issued the following requirements must be met:
1. If the unit has been sold to the owner by a dealer for placement on a
foundation system, any information not originally available to complete
the form 433(A) (such as manufacturers name, serial numbers, date of
manufacture, dealer's license number and Insignia/label number(s)) must
be completed. This information is required so HCD may properly mark
the records. Incomplete for --as may be returned for t,ompletion.
2. If the unit is one already owned by the individual requesting placement
on the foundation system, the following items are required to be
surrendered to the local building department ti„fore they issue the
certificate of occupancy.
(a) The certificate of title and registration issued by either NCD or
DSV.

(b) Any license plates or license decals issued by either RCD or - V.
CAUTION. DO NOT REMOVE THE FEDERAL (HUD) LABELS OR CALIFORNIA HCD
INSIGNIAS CERTIFYING COMPLIANCE OF THE UNIT.
3. When the form HCD 433(A) has been completed with all required
information and all titles, certificates, plates or decals (r
required) have been surrendered, a certificate of occupancy ;orm 513C
(See Appendix C) may be issued and the HCD form 433(A) recorded with
the county recorder. The owner is to be provided with a copy of the
new form NCO 433(x) (see Appendix D) by the building department, The
owner is required to fill out and submit form 433(x) to the county
assessor.
CAUTION: DO NOT REMOVE THE FEDERAL HUD LABELS OR CALIFORNIA HCD
INSIGNIAS FROM THE UNIT.
4. Upon recording the HCD form 433(A), the local building department shall
forward a copy of the completed and recorded form HCD 433(A), a copy -r
the certificate of occupancy, the $11 per transportable section fee
that was collected, and all applicable titles, certificates,
license plates or license decals to:

Notice is hereby given that the Butte County Planning Director is proposing to grant an Administrative Permit
to allow a detached Senior Citizen dwelling unit on property zoned A-5, identified as Assessors Parcel #024-
110-149 located at 52 West Evans Reimer Road, Gridley. The permit will be granted subject to the following
conditions:
(1) The lot or parcel on which the senior citizen dwelling unit Is proposed contains an existing single-
family dwelling unit. The dwelling must have a final building permit before the senior citizen unit
can be finalied.

use does or will melt all of the renditions and criteria, the Planning Director will approve the request on
August 24, 1992. Any interested person may appeal the decision of the Planning Director by submitting a
written appeal, accompanied by $290.00, to the Butte County Development Services Department at 7 County
Center Dr., Croville, Cly, 95965, The appeal must be received within 3 days of Planning Director's decision.
