The Butte County Air Quality Management District Rule 207 — Residential Wood Combustion Summary Rule Requirements :f 1. No wood -burning device for which a building permit application is submitted may be installed in any dwelling unit in Butte County unless it is a "District - approved" device. District -approved devices are defined in the rule as follows: a. EPA -Certified Phase H wood burning devices. Many woodstoves and fireplace inserts currently available on the market today already meet this requirement. b. Uncertified devices, which can document compliance with EPA -Phase II emission limits. The attached table of "zero clearance" fireplaces lists the District -approved devices currently available. c. All Pellet -fueled wood heaters d. All Dedicated gas-fired fireplaces e. Other devices determined equivalent by the AFCO.. 2. Open masonry .fireplaces and pre -manufactured, zero clearance fireplaces, which do not meet the emission limits established is the rule; are not allowed in new construction. 3. wood burning devices in existing homes are exempt from this rule. There are no conditions placed on continued use of wood burning devices in existing homes upon the sale of an existing home. 4. Used wood burning devices, which do not meet the established emission limits, may not be resold, or reinstalled, within the county. 5. Retailers will be requested - to distribute literature containing clean burning tips and other relevant information with each sale of a wood -burning device.
