WSTHVRow, AP 24-19-27,35 onrE:: September 24, 1987 This proposal is a boundary line modification of AP 24-19-27 and -35 which includes Lots 1.0, 19 and 27 of the Live Oak colony #1. The current zoning is A-40 (Agricultural - 40 -acre minimum parte cels) and the General Plan designation is Orchard & Field Crops. It has been the policy of the Butte County Planning Department not to recommend approval of boundary line modifications that make existing lots which conform to the zoning to not conform as paL*t of a boundary line modification. In this case, AP 24- 15-35 is presently over 40 acres in size and Would need to remain so after the BLM. Lot 19 alone is about 22.9 acres in size, and Lot 27 about 37.2 acres in size. In checking the County records and information provided by the applicant, it appears that the three lots and two parcels are legal and separate lots and parcels. Approval of the boundary line modification is recommended finding the project- is Categorically Exempt [Class 5(a)] from the requirements of the California Environmental Quality Act and subject to the following conditions; 1. The remainder parcel, of AP 24-19-35 to remain at 40+ acres. 2. When the Sacramento Northern Railroad right-of-way is acquired, the 10 -acre parcel is to be enlarged with the railroad right-of-way frbnting on the west boundary line and the remainder of the right-of-way to be merged with the 49+ -acre remainder parcel of AP 24-19-3.5.
